HomeMy WebLinkAboutPresentation HAS Development Agreemtent April 25, 2011 Development agreement between: Town of Westlake and HAS, et al (Hillwood) For: Public transportation infrastructure improvements Development agreement reflects: MOU approved by Town Council on  March 28, 2011 Public/Private Partnership  Private Investment (HAS) $4,665,818 (their maximum obligation)  Construction to Town standards  Design & Management of project (no fees)  Monthly expenditure reports to Town  For capital improvements only on mutually agreed  upon projects (cannot be used for maintenance costs) Work with Town design review committee  Ottinger Road-provide additional ROW dedications  Maximum obligation to be used within 30 months  Public Investment (Town) Plan engineer review and approval  Design review committee involvement  Costs exceeding Town standards (via 380 grant)  Obligated to use private funds within 30 months  Use on agreed upon projects  Use in agreed upon order  Fee waiver  The Projects: Required(completed first)  Project 1: Ottinger Road at Deloitte entrance;  Completed by July 30, 2011 Project 2: Ottinger Road and Academy’s new north  entrance; Completed by August 23, 2011 Project 3: Dove Road culvert crossing (near fire station);  Completed by January 31, 2012 Project 4: Pearson/Dove Road intersection;  Completed by January 31, 2012 The Projects (continued): Elective(remaining)  All design, approvals and construction to be completed by September 2013 Project 5: Trail/Sidewalk and landscaping  Project 6: Remaining Dove & Ottinger Road  improvements (not covered by Projects 1-5 above) Project 7: Ottinger/Dove Road intersection  improvements Depiction of Projects 1-7 Other Terms & Conditions ROW  DCLI (Deloitte)  Removes Westerly Road (per 2008  agreement) Assignment 
