Subject: Authorizing an extension to the time frame allowed for temporary structures to be
placed or maintained on the Fire Department property at 2900 Dove Road.
The Town Council originally approved temporary structures to be placed on the property for a period of
two years. An extension was subsequently approved for another two years. These two approvals have
expired, it is necessary that the Town Council approve another extension in order to be in compliance
with Town ordinances.
EXECUTIVE SUMMARY
It is being proposed that this extension be granted “until the Town Council determines it is in the best
interest of the citizens of Westlake to remove the structures” as opposed to a specific time frame. This
will save staff and Council the time spent in going through the extension process over and over, taking
into consideration that significantly greater decisions will need to be made by the council prior to
deciding to remove the temporary structures.

RESOLUTION 11-11
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,
TEXAS, APPROVING AN EXTENSION TO THE TIME LIMITS FOR THE
PLACEMENT AND MAINTENANCE OF TEMPORARY STRUCTURES ON THE
PROPERTY ADDRESSED AS 2900 DOVE ROAD, BEING ABRTRACT 680, TR 7B OF
THE GREENBERRY B. HENDRICKS SURVEY, TOWN OF WESTLAKE, TARRANT
COUNTY, TEXAS; GENERALLY LOCATED ON THE SOUTH SIDE OF DOVE ROAD
AND EAST OF THE PAIGEBROOKE SUBDIVISION.
WHEREAS, the aforementioned property is properly zoned for the current uses and,
WHEREAS, the Town Council of the Town of Westlake originally approved the
placement of the temporary structures on the property for a period of two-years and subsequently
approved an extension of two-years due to the lack of funding for permanent facilities and,
WHEREAS, the funding for permanent facilities is not currently available and,
WHEREAS, the facilities currently located on the property are still needed by the Fire
Department to support the vital services that they provide and,
WHEREAS, the Town Council finds that the passage of this Resolution is in the best
interest of the citizens of Westlake.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
SECTION 1:
That, all matters stated in the Recitals hereinabove are found to be true
and correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2
: That the Town of Westlake Town Council hereby approves an extension
to the time frame allowing the placement and maintenance of temporary structures on the
property addressed 2900 Dove Road, being Abstract 680, Tract 7B, of the Greenberry B.
Hendricks Survey, Town of Westlake, Tarrant County, Texas. Said extension shall be until the
Town Council of the Town of Westlake determines that removal of the temporary structures is in
the best interest of the citizens of the Town of Westlake.
SECTION 3
: If any portion of this Resolution shall, for any reason, be declared invalid
by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof and the Council hereby determines that it would have adopted this Resolution without the
invalid provision.

SECTION
4: That this resolution shall become effective from and after its date of
passage.

Road.
In order to place and maintain the temporary structures on the academy property for more than a few
weeks, and be in compliance with town ordinances, it is necessary for the Town Council to approve them
until some specified time.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE,

WHEREAS, additional class room space is needed to accommodate the anticipated
student loads for the next several years and,
WHEREAS, the funding for permanent facilities is not currently available nor
anticipated to be available in the near future and,
WHEREAS, the Town Council finds that the passage of this Resolution is in the best
interest of the citizens of Westlake.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
