Regular Session… 4. CONSIDER APPROVAL OF RESOLUTION 12-30 TO PARTICIPATE IN THE DENTON COUNTY WEST NILE VIRUS AERIAL SPRAYING PROGRAM. 5. EXECUTIVE SESSION The Council will conduct a closed session pursuant to Texas Government Code, annotated, Chapter 551, Subchapter D for the following: a. Section 551.087: Deliberation Regarding Economic Development Negotiations – to deliberate the offer of a financial or other incentive to a business prospect. b. Section 551.071 Consultation with Attorney - to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: Town of Westlake Certificate of Convenience & Necessity (CCN) for water and sewer service. c. Section 551.071 Consultation with Attorney - to seek advice of counsel on legal matters involving pending or contemplated litigation, settlement offers, or other legal matters not related directly to litigation or settlement. Pending or contemplated litigation and settlement offers include but are not limited to the following: Michael Eaton vs. Town of Westlake. 6. RECONVENE MEETING 7. TAKE ANY ACTION, IF NEEDED, FROM EXECUTIVE SESSION ITEMS. 8. FUTURE AGENDA ITEMS: Any Council member may request at a workshop and / or Council meeting, under “Future Agenda Item Requests”, an agenda item for a future Council meeting. The Council Member making the request will contact the Town Manager with the requested item and the Town Manager will list it on the agenda. At the meeting, the requesting Council Member will explain the item, the need for Council discussion of the item, the item’s relationship to the Council’s strategic priorities, and the amount of estimated staff time necessary to prepare for Council discussion. If the requesting Council Member receives a second, the Town Manager will place the item on the Council agenda calendar allowing for adequate time for staff preparation on the agenda item. 9. Some areas have employed larvacidal briquettes, and/or local fogging measures, while others have progressed to aerial spraying. Denton County has contacted the municipalities within their county lines and as such, are offering to include the Town of Westlake in their aerial spraying efforts over the next few weeks. As of today, the recent information from cities around us includes: • Denton County has reported 112 cases of human West Nile virus • Denton County has had one death from the virus • Town of Trophy Club = 2 WNV cases • City of Keller = 9 WNV cases • City of Southlake = 4 WNV cases • City of Roanoke = 1 WNV case Town staff has sent out several updates to both the Academy community and Westlake residents advising them of the dangers associated with human exposure to mosquito infestations/bites and also described methods to reduce their risk through preventative measures. We have also notified residents (and the press) that Westlake offers residents complimentary ‘mosquito dunks’ for bodies of standing water and staff has also contacted our corporate partners offering to administer the tables along creeks and in pond areas. While this is beneficial, it is one component of the several methods available to help reduce the risk of West Nile. The Town could implement ground fogging measures to supplement the dunk applications if desired. Staff would utilize an outside contractor for this type of preventative application. Based on the attached notifications from Denton County, this item has been added as an addendum to the regularly scheduled Council meeting. Residents have been notified of the impending discussion in order to provide them with the opportunity to address the Council and voice their support and/or concerns. During this time, education has been the primary approach, with the Health Department emphasizing the Four Ds of staying indoors Dusk & Dawn, Dressing in long sleeves, using DEET, and Draining standing water for personal protection. In addition, the Health Department has trained a private non-profit organization (RSVP) to provide community education. Within the last few weeks, several municipalities including Denton, Lewisville, Flower Mound, and Carrollton have used ground based spraying to combat the disease within their city limits. At the same time, larvacide is being applied to pools and standing water by some cities and some Denton County departments. Despite these preventive efforts, the number of cases has continued to increase. As of August 22, 2012, a total of 112 cased have been reported. As a result, the Health Department has recommended that more aggressive strategies, in the form of aerial spraying, be considered. At this time, I have issued a Disaster Declaration and Executive Order to request state assistance for response and mitigation support to combat West Nile Virus and to continue our public outreach and education regarding preventive measures. As Denton County has requested state and federal resources to employ aerial spraying of the unincorporated areas of the County, we are asking for municipalities to provide us notice of whether they want to be included in these mitigation efforts. The resources will be available as early as next week so we would prefer to have notice from your local government by noon on Monday, August 27, or at the latest noon on Tuesday, August 28, advising us of your desire to be included or to opt out of aerial spraying. Denton County has recorded 105 cases of West Nile Virus, and the number of cases continues to increase daily. More importantly, Denton County has the highest WNV incidence rate in the State. “We are very concerned at the number, rate, and severity of cases of West Nile Virus among Denton County residents”, stated Bing Burton, Ph.D., director of Denton County Health Department. Ground spraying and the use of larvacide in ponds and standing water has not been successful in containing this disease outbreak. Although these strategies, coupled with education and the importance of personal protective measures will remain an important part of Denton County’s disease response, the geographic advantages of aerial spraying may be the most effective means of combating WNV. It is believed that the ability of aerial spraying to cover very large areas of the county at one time may provide the needed boost in preventive measures to reduce the growing number of cases occurring. The pesticide used in aerial spraying is very similar to the one employed in ground spraying. It is not a more concentrated dose, and it has been declared safe for humans and pets by the Centers for Disease Control. The persistence of this disease outbreak has led health officials to recommend that the county expand measures to protect County residents. The declaration of a Health Emergency will allow the County to request State and Federal resources. However, as in Dallas County, the municipalities in Denton County will determine whether they wish to be included in the spraying. Prompt response from the municipalities will be encouraged to enable optimal use of the aerial spray resource. Resolution 12-30 Page 1 of 2 TOWN OF WESTLAKE RESOLUTION 12-30 A RESOLUTION BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS, (TOWN) PROVIDING APPROVAL FOR THE TOWN OF WESTLAKE TO PARTICIPATE IN THE DENTON COUNTY AERIAL SPRAYING PROGRAM FOR THE PURPOSE OF MOSQUITO ERADICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, West Nile virus is a mosquito-borne disease that is capable of causing severe illness or death in humans; and WHEREAS, of all the recent occurrences of human West Nile virus infection in the United States, half of those cases have occurred in Texas; and WHEREAS, within Denton County, Texas there have been more than 112 cases of human West Nile virus infection, at least 16 confirmed cases of human West Nile virus infection within our neighboring communities, and more than one death has occurred in Denton County relating to human West Nile virus infection; and WHEREAS, aerial spraying is an effective method when used in conjunction with other local measures to control the spread of mosquitoes carrying the West Nile virus; NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1. THAT, all matters stated in the Recitals hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2. THAT, the Town Council of the Town of Westlake, Texas, hereby approves participation in the Denton County aerial application program measures to assist in the control and spread of the West Nile virus in the town limits of Westlake.
