RESOLUTION NO. 12-03
A RESOLUTION OF THE BOARD OF TRUSTEES OF WESTLAKE ACADEMY
APPROVING AN AMENDMENT TO INCREASE THE MAXIMUM STUDENT
ENROLLMENT FOR WESTLAKE ACADEMY.
WHEREAS, the Board of Trustees of Westlake Academy desires to increase the
maximum enrollment at Westlake Academy to 1,450 students; and
WHEREAS, the current charter granted to Westlake Academy by the State Board of
Education limits the maximum enrollment to 800 students; and
WHEREAS, Title 19 Texas Administrative Code Section 100.1033 allows the terms of
an open-enrollment charter to be revised with the consent of the charter holder by written
amendment approved by the commissioner of education; and
WHEREAS, the Board of Trustees of Westlake Academy has reviewed and considered a
business plan that includes the following components:
• a statement discussing the need for an increase in the maximum enrollment;
• a statement discussing the current and projected financial condition of the charter
holder and/or the charter school;
• an unaudited statement of financial position for the current fiscal year;
• an unaudited statement of activities for the current fiscal year;
• an unaudited statement of cash flows for the current fiscal year;
• a pro forma budget that includes the costs of operating the charter school,
including the implementation of the expansion amendment;
• a statement or schedule that identifies the assumptions used to calculate the
charter school's estimated Foundation School Program revenues;
• a statement discussing the use of debt instruments to finance part or all of the
charter school's incremental costs;
• a statement discussing the incremental cost of acquiring additional facilities,
furniture, and equipment to accommodate the anticipated increase in student
enrollment; and
• a statement discussing the incremental cost of additional on site personnel and
identifying the additional number of full-time equivalents that will be employed;
and
WHEREAS, the Board of Trustees of Westlake Academy has determined that Westlake
Academy meets all eligibility criteria for approval of an expansion amendment; and
WHEREAS, the Board of Trustees finds that the passage of this Resolution is in the best
interest of Westlake Academy.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
WESTLAKE ACADEMY, TEXAS:
SECTION 1: That all matters stated in the recitals above are hereby found to be true and
correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2: The Board of Trustees of the Westlake Academy hereby approves an
amendment to the Westlake Academy charter to increase maximum enrollment to 1,450 students,
subject to approval by the Texas Conunissioner of Education.
SECTION 3: If any portion of this Resolution shall, for any reason, be declared invalid
by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof and the Board hereby determines that it would have adopted this Resolution without the
invalid provision.
SECTION 4; That this resolution shall become effective from and after its date of
passage.
PASSED AND APPROVED BY THE BOARD OF TRUSTEES OF WESTLAKE
ACADEMY, A CHARTER SCHOOL OF THE STATE OF TEXAS, ON THE 9th DAY
OF JANUARY 2012.
