HomeMy WebLinkAboutOrd 37 Disannexing 30 acres in Tarrant CountyORDINANCE NO. 37 AN ORDINANCE DISCONTINUING TERRITORY CON- TIGUOUS AND ADJOINING THE LINES OF THE TOWN OF WESTLAKE, TEXAS; PROVIDING THAT SUCH TERRITORY SHALL CEASE TO BE A PART OF THE TOWN; PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID T014N AS HERETOFORE ADOPTED AND AMENDED; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of Aldermen of the Town of Westlake, Texas, deem it advisable and in the best interests and general welfare of the Town and its inhabitants that the fallowing de- scribed territory be discontinued as a part of the Town, pur- suant to the provisions of Acts of 1953, 53rd Legislature, Page 887, Chapter 366, §1, Codified as Article 973, Revised Civil Statutes of Texas: A tract of land containing 30 acres, more or less, out of the Heirs of C. M. Throop Survey, A-1510, Heirs of C. Dart Survey, A-2003, W. Mann Survey, A-1107 and W. Medlin Survey, A®1588, situated in Tarrant County, State of Texas, to -wit: BEGINNING at a point in the East line of County Road No. 4026, said point being 20 feet South of the intersection of the East line of said County Road with the North line of the Heirs of C.M. Throop Survey, A-1510 and also being in the cor- porate limits of the Town of Westlake, Texas; THENCE South with and following the East line of said County Road No. 4026 to a curve toward East and continuing the same to its joinder with the North line of County Road No. 3080; THENCE Easterly with and following the North line of County Road No. 3080 to an angle corner of said Road; THENCE Southerly with and following the East line of County Road No. 3080 to an angle corner of said Road; THENCE East and Southeasterly with and follow- ing the meanders of the North line of County Road No. 3080 to its intersection with the West line of County Road No. 3088; THENCE North and Northwesterly with and following the meanders of the West line of said County Road No. 3088 to a point for corner, said point being due West of the Northwest corner of the G. H. Harmon, Jr. 3.83 -Acre Tract out of the W. Medlin Survey, A-15889 THENCE East crossing County Road No. 3088 and continuing on following the North line of said G.H. Harmon, Jr. 3.83 -Acre Tract to a point in the Northeast corner of such Tract; THENCE South with the East line of said G.H. Harmon, Jr. 3.83 -Acre Tract to a point at the Southeast corner of such. Tracts THENCE West with the South line of said G.H. Harmon 3.83 -Acre Tract to a point at the Southwest corner of such Tract, said point also being in the East line of County Road No. 3088; THENCE South and Southeasterly with and fol- lowing the meanders of the East line of County Road No. 3088 to its intersection with the North line of County Road No. 3080 and continuing across said County Road No. 3080 to a point on the South line of said County Road No. 30809 THENCE West with and following the South. line of County Road No. 3080 to its intersection with the East line of County Road No. 30889 THENCE South with and following the East line of said County Road No. 3088 a distance of 600 feet to a point for• corner; THENCE West across County Road No. 3088 to the West line of said County Road and continuing due West from such West line a distance of 200 feet to a point for corner; THENCE North and at all times 200 feet from and parallel to the West line of County Road No. 3088 to a point for corner in the South line of County Road No. 3080; THENCE West and Northwesterly with and follow- ing the meanders of the South line of County Road No. 3080 to a point for corner at its intersection with the East line of the A. M. Tate 11.32 -Acre Tract out of the Hrs. of C.M. Throop Survey, A-15109 THENCE South with the East line of said A.M. Tate 11.37 -Acre Tract to a point for a corner at the Southeast corner of said Tract; THENCE 'West with the South line of said A.M. Tate Tract passing the Southwest corner of such Tract and crossing County Road No. 3035 to a point for corner in the vilest line of County Road No. 3035; THENCE North with and following the West line of County Road No. 3035 to its intersection with the South line of County Road No. 3080; THENCE Northwesterly and West with and following the meanders of the South line of County Road No. 3080 to an angle corner of said Road; THENCE North with and following the West line of County Road No. 3080 to an angle corner of said Road; THENCE West with and following the South line of County Road No. 3080 to a curve toward North and continuing with same to its Ioinder with the West line of County Road No.4026; THENCE North with and following the West line of County Road No. 4026 to a point for a corner; said point being 20 feet South of the intersection of the vilest line of County Road No. 4026 with the North line of the Hrs. of C.M. Throop Survey, A-1510, extended; THENCE East with the corporate limits cross- ing County Road No. 4026 to the point of Beginning. A plat of said territory showing its location with respect to the Town of Westlake being attached hereto and marked Exhibit "A"; and WHEREAS, said territory comprises approximately 30 acres contiguous and adjoining the lines of the Town which is uninhabited or on which there are fewer than one (1) occupied residence or business structure for every two (2) acres of such territory and fewer than three(3) occupied residences or business structures on any one 1) acre of said territory; and WHEREAS, it appearing to the Board of Aldermen of the Town that all statutory requirements in connection with said proposed discontinuance of territory have been fulfilled; BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: 1. That said territory hereinabove described being adjacent and contiguous to the limits of the Town be and it is hereby dis- continued as a part of the Town of Westlake, Texas; 2. That the official map and boundary of the Town of Westlake, Texas, as heretofore adopted and amended, be and it is hereby amended so as to discontinue the aforementioned territory as a part of the Town of Westlake, Texas; 3. The Mayor of the Town of Westlake, Texas is hereby authorized and directed to enter an Order on the Minutes of the Town Council to the effect that this Ordinance has been duly passed. 4. This Ordinance shall become effective and be in full force and effect from and after its passage and approval by the Mayor, duly attested by the Town Secretary, and the entry of said Order on the Minutes of the Town Council. THE STATE OF TEXAS TOWN OF WESTLAKE, TEXAS COUNTY OF TARRANT I, A. L. ODOM, Town Secretary of the Town of Westlake, Texas, do hereby certify that the foregoing is a true and correct copy of Ordinance No. 37, duly presented and adopted by the Board of Aldermen of said Town of West- lake, Texas, at a meeting held on the 30th day of July, 1966, as same appears in the minutes of said meeting, in Book No. 2, Pages 347- 30 - WITNESS NY HAND AND SEAL OF THE TOWN OF WESTLAKE, I TEXAS, this the day of jo L 1966.
