Ord 36 Disannexing 47 acres in Tarrant County
ORDINANCE NO. 36 AN ORDINANCE DISCONTINUING TERRITORY CON- TIGUOUS AND ADJOINING THE LINES OF THE TOWN OF WESTLAKE, TEXAS; PROVIDING THAT SUCH TERRITORY SHALL CEASE TO BE A PART OF THE TOWN; PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID TOWN AS HERETOFORE ADOPTED AND AMENDED; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of Aldermen of the Town of Westlake, Texas, deem it advisable and in the best interests and general welfare of the Town and its inhabitants that the following de- scribed territory be discontinued as a part of the Town, pur- suant to the provisions of Acts of 1953, 53rd Legislature, Page 887, Chapter 366, 91, Codified as Article 973, Revised Civil Statutes of Texas: A tract of land containing 47 acres, more or less, out of the Jesse Gibson Survey, A-592, the G. B. Hendricks Survey, A-680, and the M. Hunt Survey, A-756 situated in Tarrant County, State of Texas, to -wits BEGINNING at the intersection of the East line of County Road No. 4057 with the North line of Tarrant County and the South line of Denton County, said point also being in the Corporate Limits of the Town of Westlake, Texas; THENCE Southwesterly and South with and following the meanders of the East line of said County Road No. 4057 to the point of its inter- section with the North line of County Road No. 4o8©; THENCE Southeasterly with and following the Northeasterly line of County Road No. 4080 around a curve to the East and continuing East and North- easterly with and following the meanders of the North line of County Road, No. 4080 to a point for corner, said point being 20 feet West of the inter- section of the North line of County Road No. 4080 with the West line of County Road Into. 4026; THENCE South and crossing County Road No. 4080 to a point in the South line of said Road; said point being 20 feet West of the intersection of the South line of County Road No. 4080 with the nest line of County Road No. 4026; THENCE West and Southwesterly with and follow- ing the meanders of the South line of County Road No. 4080 to its intersection with the East line of County Road No. 4041; THENCE South and following the East line of said County Road No. 4041 to a point 660 feet North of the South line of the G. B. Hendricks Survey, A-6809 THENCE East a distance of 300 feet to a point for corner; THENCE South and at all times 300 feet East of and parallel to the East line of County Road No. 4041 a distance of 660 feet to a point for corner in the South line of said G. B. Hendricks Survey; THENCE West with the South line of said G.B. Hendricks Survey and crossing County Road No. 4041 to a point for corner in the West line of County Road No. 4041; THENCE North with and of County Road No. 4041 to the South line of the J.A. out of the G. B. Hendricks following the West line its intersection with Medford 20 -Acre Tract Survey, A-680; THENCE West with the South line of said J.A. Medford 20 -Acre Tract a distance of 200 feet to a point for corner; THENCE North and at all times 200 feet West of and parallel to the West line of County Road No. 4041 to a point for corner in the South line of County Road No. 4080; THENCE West with and following the South line of County Road No. 4080 to a point for cor- ner, said point being 660 feet East of the East line of County Road No. 4057; THENCE South 1300 feet to a point for corner, said point being in the South line of the W.T. Sharpless 40 -Acre Tract out of the Jesse Gibson Survey, A-592; THENCE West with South line of said W.T. Sharpless Tract to a point at its intersection with the East line of County Road No. 4057; THENCE South with and following the East line of said County Road No. 4057 to a point for corner at the Northwest corner Of the Margie Wood 6 -Acre Tract out of the Jesse Gibson Survey, A-592; THENCE East with the North line of said Mar- gie Wood Tract a distance of 200 feet to a point for corner; THENCE South and at all times 200 feet from and parallel to the East line of County Road No. 4057 to a point for corner in the South line of the said Margie Wood 6 -Acre Tract; THENCE West with the South line of said Margie Wood 6 -Acre Tract and crossing County Road No. 4057 to a point for corner in the blest line of said County Road; THENCE North with and following the West line of County Road No. 4057 to a point for cor- ner at the Southeast corner of the H.C. Winterbauer 40 -Acre Tract out of the Jesse Gibson Survey, A-592; THENCE West with the South line of said H.C. Winterbauer Tract a distance of 200 feet to a point for corner; THENCE due North to a point for corner in the North line of said H.C. Winterbauer Tract; THENCE East with the North line of said H.C. Winterbauer Tract to the Northeast corner of same and being in the West line of County Road No. 4057; THENCE North and Northeasterly with and fol- lowing the meanders of the West line of County Road No. 4057 to its intersection with the North line of Tarrant County and the South line of Denton County; THENCE East with said North line of Tarrant County and crossing said County Road No. 4057 to the point of Beginning. A plat of said territory showing its location with respect to the Town of Westlake being attached hereto and marked Exhibit "A"; and WHEREAS, said territory comprises approximately 47 acres contiguous and adjoining the lines of the Town which is uninhabited or on which there are fewer than eine (I) occupied residence or business structure for every two (2) acres of such territory and fewer than three 3 occupied residences or business structures on any one 1 acre of said territory; and WHEREAS, it appearing to the Board of Aldermen of the Town that all statutory requirements in connection with said proposed discontinuance of territory have been fulfilled; BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: 1. That said territory hereinabove described being adjacent and contiguous to the limits of the Town be and it is hereby dis- continued as a part of the Town of Westlake, Texas; 2. That the official map and boundary of the Town of Westlake, Texas, as heretofore adopted and amended, be and it is hereby amended so as to discontinue the aforementioned territory as a part of the Town of Westlake, Texas; 3. The Mayor of the Town of Westlake, Texas is hereby authorized and directed to enter an Order on the Minutes of the Town Council to the effect that this Ordinance has been duly passed. 4. This Ordinance shall become effective and be in full force and effect from and after its passage and approval by the Mayor, duly attested by the Town Secretary, and the entry of said Order on the Minutes of the Town Council.
