AN ORDINANCE PROHIBITING THE DUMPING OF
GARBAGE, TRASH AND OTHER RUBBISH IN
CERTAIN AREAS WITHIN THE CORPORATE LIMITS
OF THE TOWN OF WESTLAKE, 'TEXAS, PROVIDING
A PENALTY; AND PROVIDING FOR AN EFFECTIVE
DATE
1=i4REAS, the dumping of garbage, trash and other
waste materials in streams, dry stream beds, drainage or
erosion ditches and gullies, and on public and private lands
w itliin the Limits of the Town will create an unsanitary con-
dition and a hazard to the public health and welfare; and
the Board of Aldermen have determined that it is proper for
the government of the Town and in the best interest and
general welfare of the Town and its inhabitants to prohibit
such dumping within the Limits of the Town;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
ALDERMEN OF THE TOWN OF WESTLAICE, TEXAS:

It shall be unlawful for any person to throw,
place, dump or deposit any rubbish, trash, kitchen and house-
hold waste, ashes, paper food containers, tin cans, bottles,
paper, hedge and lawn trimmings and other rubbish and waste
material in any stream, dry stream bed, drainage or erosion
ditch or other gully within the Limits of the Town, or on
the private property of any other person within the Limits
of the Town, or on or in any gutter, street, road or public
property within the Limits of the Town.

Any person who shall violate any of the provi-
sions of this Ordinance, or shall fail to comply therewith
or with any of the requirements thereof, shall be deemed
guilty of a misdemeanor, and any such person upon receipt
of written notice from the Mayor of the Town specifying
such person's violation of or failure to comply with this
Ordinance shall be liable to a fine, and upon conviction
of any violation shall be fined in any sum of not more
than One Hundred Dollars (100.00); and each day any such
violation shall be permitted to exist shall constitute a
separate and distinct offense.

This Ordinance shall become effective and be in
full force and effect from and after its passage and ap-
proval by the Mayor and duly attested by the Town Secretary,
and shall be enforceable after publication as prescribed by
the laws of the State of Texas.

ed and adopted by the Board of Alder -men of said Town of
Westlake, Texas, at a meeting held on the aday of
January, 1905, as same appears in the minutes of said meet-
ing, in Book No. 2, Pages 5®3- X30/ -
