HomeMy WebLinkAboutOrd 90 Regulating Outdoor Signage AdvertisingNo. 90 AN ORDINANCE TO THE TOWN OF WESTLAKE, REGULATING THE USE OF OUTDOOR ADVERTISING SIGNS WITHIN THE TOWN LIMITS; PROVIDING A PENALTY; AND DECLARING AN EFFECTIVE DATE. THE COUNCIL OF THE TOWN OF WESTLAKE, TEXAS, HEREBY ORDAINS: PART I That an ordinance be adopted regulating and controlling the use of outdoor advertising in areas adjacent to federal highways, and state highways. SECTION I. SIZE OF SIGNS. a. The maximum area for any one sign shall be 1200 square feet with a maximum height of 25 feet and maximum length of 60 feet, inclusive of border and trim but excluding the base or apron, supports, and other structural members. b. The area shall be measured by the smallest square, rectangle, tri- angle, circle, or combination thereof which will encompass the en- tire sign. C. The maximum size limitations shall apply to each side of a sign structure or structures visible to approaching traffic. d. Signs may be placed back--to-back, side-by-side, stacked, or in V type construction with not more than two displays to each facing and such sign structure or structures shall be considered one sign. e. Signs which exceed 350 square feet in area may not be stacked or placed side-by-side. SECTION II. SPACING OF SIGNS. a. Signs may not be located in such a manner as to obscure or otherwise interfere with the effectiveness of an official traffic sign, signal or device, or which obstruct or interfere with the driver's view of approaching, merging or intersecting traffic. b. Signs may not be located within 500 feet of any public park, public forest, public playground or scenic area designated as such by the State Highway Department of other Governmental Agency having and exercising such authority, which is adjacent to the highway. C. Signs may not be located adjacent to or within 500 feet of inter- changes, intersections at grade and rest areas on Interstate and Freeway highways outside incorporated municipalities or which will tend to obscure or otherwise interfere with the driver's view of approaching, merging or intersecting traffic. Such distance shall be measured along the highway from the nearest point of the begin- ning or ending of pavement widening at the exit from, or entrance to, the main traveled way. d. Signs may not be erected on the Interstate and Freeway Primary Sys- tems closer than 500 feet apart on the same side of the highway. e. Signs may not be erected on the non -freeway Primary System in in- corporated cities, towns and villages closer than 100 feet apart on the same side of the highway. f. The above spacing between signs shall not apply to signs separated by buildings, natural surroundings or other obstructions which caus only one sign located within the specified spacing to be visible at any one time. g. The above spacing rules do not apply to on -premise or directional or other official signs, as defined in Section 131(c) of the Fed- eral Act, nor shall measurements be made from such signs for the purposes of this agreement. SECTION III. LIGHTING. i I a. Signs which contain, include or are illuminated by any flashing, 1 intermittent or moving Light or lights are prohibited, except those giving public service information such as time, date, temperature, i weather or similar information. b. Lights which are not effectively shielded as to prevent beams or rays of light from being directed at any portion of the traveled ways of the Interstate or Primary Highway and which are of such intensity or brilliance as to cause glare'or to impair the vision of the driver of any motor vehicle, or which otherwise with any driver's operation of a motor vehicle are prohibited. c. No sign shall be so illuminated that it interferes with the effec- tiveness of or obscures an official traffic sign, device or signal. SECTION IV. STATE LICENSE REQUIREMENTS. a. Prior to the issuance of a permit for a sign by the Town of Westlake, the applicant must possess a valid State of Texas license to erect said sign. SECTION V. On. any streets not designated as federal or state highways within the town limits, outdoor advertising signs shall not exceed the dimensions of i I two feet by three feet with a maximum heighth of ten feet, inclusive of j border and trim but excluding the base or apron, supports, and other structural members. Signs larger than provided by this section shall only be erected after permission has been granted by the town council and I the city secretary has granted a permit for the same. i PART II. PENALTY. i That the violation of any provision of this ordinance shall be deemed an offense punishable by a fine not exceeding Two Hundred ($200.00) Dolla s i and each violation thereof shall be and is hereby deemed to be a distinct; I i and separate offense and punished as such. j I PART III. ' i It is hereby declared to be the intention of the town council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judg- ment or decree of any court of competent jurisdiction, such unconstitu- tionality shall not affect any of the remaining phrases, clauses, senten- ces, paragraphs and sections of this ordinance since the same would have been enacted by the town council without the incorporation in this ordi- nance of any such unconstitutional phrase, clause, sentence, paragraph or section.
