HomeMy WebLinkAboutOrd 75 Granting a Petition for Annexation of certain landORDINANCE NUMBER 75 AN ORDINANCE GRANTING A PETITION FOR THE ANNEXATION OF CERTAIN LAND TO THE TOWN OF WESTLAKE, TEXAS: WHEREAS, at a meeting of the Board of Aldermen of the Town of Westlake held on January 21, 1974, the Board approved the request of Johnson-Loggins, Inc., the owners of the land de- scribed by metes and bounds below, that a public hearing before the Board of Aldermen be called for the purpose of considering annexation of the land described below; and WHEREAS, pursuant to public notice given in accordance with law, a public hearing was held on February 19, 1974, at 7:30 p.m. at the Bilbo Ranch House before the Board of Alder- men to consider the annexation of the land described below; and WHEREAS, at a meeting of the Board of Alderman convening shortly following the public meeting, at 7:45 p.m. at the Bilbo Ranch House in Westlake, Texas, a Petition, signed by Johnson- Loggins, Inc., the owner of all of the Nand hereinbelow de- scribed, asking that such land be included within the Town of Westlake, Texas, was presented to the Board of Aldermen for their consideration at the next meeting of the Board; and WHEREAS, the annexation of the land described hereinbelow which is wholly contiguous and adjacent to the present boun- daries of the Town of Westlake, will result in providing more orderly development and use of said land, and will promote the general health, safety and welfare of the persons residing thereon. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: Section 1. That the matters and facts set out hereinabove are found to be true and correct. Section 2. That this meeting held. on March 11, 1974, at 7:30 p.m. at the Bilbo Ranch House in Westlake, Texas, was called and notice given thereof in accordance with law. Section 3. That all actions taken at the meetings of the Board of Aldermen of the Town of Westlake, Texas, held, on January 21, 1974, and on February 19, 1974, are hereby approved, ratified and affirmed. Section 4. That attached to this Ordinance and made a part hereof is the Petition for the annexation of the following described property to the Town of Westlake, Texas: In Denton County, Texas, beginning at the intersection of the North boundary line of the Medlin Road and the East boundary line of a public road running along the West boundary line of that certain one acre tract of land conveyed to H. J. Gray, et ux. by Deed recorded in Volume 568, Page 119, of the Deed Records of Denton County, Texas; THENCE S 75052'55" E, 29.55 feet; THENCE S 89051'30" E, 91.2 feet, THENCE N 00044' E, 383.8 feet; THENCE N 89051'30" W, 120.0 feet; THENCE N 00*44' E, 1,015.4 feet; THENCE S 89053'30" E, 300.0 feet; THENCE N 00030' E, 903.54 feet; THENCE N 89049' W, 300.0 feet; THENCE S 00030' W, 388.94 feet; THENCE N 89023' W, 559.71 feet to an iron pin in the Southwest corner of that certain tract of land con- veyed to Deloris Jane Perry by Deed recorded in Volume 527, Page 409, of the Deed Records of Denton County, Texas; THENCE S 00000'30" E, 845.5 feet; THENCE S 89052'30" E, 407.05 feet; THENCE S 00014'30" W, a distance of approximately 1,125.4 feet to the North boundary line of the Medlin Road; THENCE S 76052'55" E, with the North boundary line of the Medlin Road approximately 175.0 feet to the place of beginning Such Petition is hereby granted, and the above-described territory is hereby annexed .into the corporate limits of the. Town of Westlake, Texas, as a part of said Town from and after the date hereof. -2- Section 5. That this ordinance is passed by unanimous vote of the Board of Aldermen on this 11th day of March, A.D. 1974, and shall take effect immediately upon its approval by the Mayor. In support of this request, the undersigned would respectfully show the following: I. That the territory to be annexed is situated wh:?1_r within Denton County, Texas, situated in the M, Medlin !,-iir• vey, A-832 and the J. W. II. That no part of the territory to be annexed is within the limits of any city, town or village, or within the extraterritorial jurisdiction, as that term is defined in Article 970x, Vernon's Texas Civil Statutes, of any incorpor- ated city, town or village except the Town of Westlake, Texas, and all of said territory may be properly annexed to the Town of Westlake. There are no qualified voters presently residing within the territory to be annexed. IV. That the territory to be annexed is depicted on a map attached hereto as Exhibit "A". WHEREFORE, the undersigned respectfully pray that the attached and foregoing petition and this request be filed with the Mayor of the Town of Westlake, Texas, and that the petition be in all things granted and the territory described herein be annexed to the Town, and the present and future inhabitants thereof be entitled to all the rights and privi- leges of other citizens of the Town of Westlake, Texas.
