HomeMy WebLinkAboutOrd 101 Determining the rate to be charged for sales of natural gasNO. /®/ AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS FIXING AND DETERMINING THE GENERAL SERVICE RATE TO BE CHARGED FOR SALES OF NATURAL GAS TO RESIDENTIAL AND COMMERCIAL CONSUMERS WITHIN THE TOWN LIMITS OF WESTLAKE, TARRANT COUNTY AND DENTON COUNTY, TEXAS, AND PROVIDING FOR THE MANNER IN WHICH SUCH RATE MAY BE CHANGED, ADJUSTED AND AMENDED, AND DECLARING AN EMERGENCY, BE IT ORDAINED BY THE TOW14 COUNCIL OF THE TOWN OF WESTLAKE: SECTION I. Effective with the first gas bills rendered from and after thirty (30) days from the date of the final passage of this ordin- ance, the maximum general service rate for sales of natural gas rendered to residential and commercial consumers within the town limits of Westlake by Lone Star Gas Company, its successors and assigns, it hereby fixed and determined as follows: First 1000 Cu. Ft. or Fraction Thereof $3.000 Over 1000 Cu. Ft. at $2,120 Per Mcf No gas bill will be rendered to any residential or commercial con- sumer served under the above rate not consuming any gas any monthly billing period, except that where customer's only use for gas service is in an outdoor grill and/or a fireplace starter, the amount shown for the first consumption block shall constitute a minimum monthly bill. ADJUSTMENTS The amount of each monthly bill computed at the above stated rates shall be subject to the following adjustments: Plus or minus the amount of any increase or decrease, respectively, above or be- low the $1.3488 per Mcf level in the intracompany city gate charge as authorized by the Railroad Commission of the State of Texas or other regulatory body having jurisdiction for gas delivered to Lone Star Gas Company's distribution system for sale to residential and commercial consumers where such changes are caused by increases or decreases in the cost of gas purchased by the Company; plus an amount equivalent to the proportionate part of any new tax, or in- creased tax, or any other governmental imposition, rental, fee or charge (except state, county, city and special district ad valorem taxes and taxes on net income) levied, assessed or imposed subse- quent to July 1, 1976, upon or allocable to the Company's distri- bution operations, by any new or amended law, ordinance or contract. Company, at its option, may forego the application of any adjust- ment if such adjustment would result in an increase in the monthly bill; however, failure of Company to apply any adjustment shall not constitute a waiver of Company's right from time to time, or at any time, to make any adjustment, in whole or in part, in any subsequent current monthly bill that may be applicable to such bill. All bills shall be due and payable when rendered. The above rate is applicable to each residential and commercial consumer per meter per month or for any part of a month for which gas is used at the same location. Company shall have the right to collect such reasonable charges as are necessary to conduct its business and to carry out its rea- sonable rules and regulations in effect, and to include the schedule of service charges attached hereto as Exhibit "A" and incorporated by reference herein and made a part hereof as though fully written word for word be and are hereby adopted and approved upon final passage of this ordinance. SECTION II. The rate set forth in Section I may be changed and amended by either the Town or Company furnishing gas in the manner provided by law. Service hereunder is subject to the orders of regulatory bodies having jurisdiction, and to the Company's Rules and Regulations cur- rently on file in the Company's office. SECTION III. ISHAN, TOWN ATTORNEY TOWN OF WESTLAKE, TEXAS DALE WHITE, MAYOR TOWN OF WESTLAKE, TEXAS -3- EXHIBIT "A" CLASS OF SERVICE: Residential and Commercial Summer Air Conditioning MONTHLY RATE: Applicable to gas consumed by Texas residential and commercial summer air conditioning customers between the meter reading dates in May and October each year. RESIDENTIAL The regular general service rate shall apply to the first 8,000 cubic feet consumption (regular consumption) per month. Beginning with the first step, the regular general service rate less $.25 per Mcf shall be applied to all gas used in excess of 8,000 cubic .feet. These amounts will be combined to determine the total bill. A bill is also calculated by applying the regular general service rate to the total consumption. The two bills are compared and the lower of the two is the amount billed to the customer. COMMERCIAL There are two ways of determining the air conditioning consump- tion on a commercial account. One way is to compute the air condition- ing MCF per nominal ton installed capacity from the following schedule: June - 8 MCF per nominal ton installed capacity July - 9 MCF per nominal ton installed capacity August - 9 MCF per nominal ton installed capacity September 8 MCF per nominal ton installed capacity October - 5 MCF per nominal ton installed capacity The other way of determining the air conditioning MCF is to have a separate meter that measures the air conditioning consumption. In either case, the air conditioning consumption cannot exceed 95% of the total consumption. The regular general service rate shall apply to gas consumed for all purposes other than for summer air condition- ing. Beginning with the first step, the regular general service rate less $,25 per Mcf shall be applied to the air conditioning consump- tion. These amounts are combined to determine the total bill. PROMPT PAYMENT PROVISION: Any prompt payment provision established for non -air con- ditioning period under the general service rate for the muni- cipality being billed is applicable, OTHER PROVISIONS: The normal gas cost adjustment applicable in each town will be applied to the total consumption including gas consumed for pur- poses other than air conditioning. Any other billing adjustments applicable to the regular rates shall also apply to billing under this rate, EFFECTIVE IN THE FOLLOWING TOWNS: This supplemental rate is available to all residential and commercial summer air conditioning customers through the Company's Texas operating area except in those towns set out on other rate schedules. -2- EXHIBIT A LONE STAR GAS COMPANY RATE SCHEDULE NO. 300-A GRAPEVINE RECONNECTION CHARGES .Reconnection Charge during the hours of 8:00 A.M.'to 5:00 P.M. Monday through Friday Reconnection Charge during the hours of 5:00 P.M. to 8:00 A.M. Monday through Friday, weekends and holidays APPLICATION OF RECONNECTION CHARGES Charge $ 7.50 $19.00 whenever gas service has been discontinued at any consumer's premises, a charge will be made for restoration of service to such premises except under the following conditions: (1) a builder who uses gas temporarily during construction and display purposes; (2) the first occupant of the premises; (3) whenever service has been temporarily interrupted because of systems outage, service work or appliance installation done by Gone Star Gas Company; (4) any reason deemed necessary for Company operations. Main line Extension Rate The charge for extending mains beycnd the free limit established by Lone Star Gas, or any free limit established by city franchise is $5.00 per foot except for large commercial and industrial consumers which are handled on an actual cost per foot basis. Page 4 LONE STAR GAS C0b1PANY RATE SCHEDULE NO, 301 RETURNED CHECK CHARGES A returned check handling charge of $3.00 is made for each check returned to the Company for reasons of Non -Sufficient Funds, Account Closed, Payment Withheld, Invalid Signature, or Improper Preparation.
