AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, ESTABLISHING
A CONSTRUCTION AND SIGN APPLICATION AND FEE SCHEDULE;
PROVIDING FOR A PENALTY; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS:
PART I.
That the Town hereby adopts this Construction and Sign Application
and Fee Schedule which consists of Sections 1-14 which shall hereinafter
read as follows:
SECTION 1. PURPOSE
That any person, firm or corporation desiring to place any
signs, commence the construction of any structure or the
construction of any alterations or repairs to any existing
structure within the jurisdiction of the Town of
Westlake, Texas, or move any structure within the
jurisdiction of the Town, or divide any piece of property
into two (2) or more pieces, shall first file an application
with the Town Secretary, together with a filing fee
according to the appropriate fee schedule before any
governing body or official will start the process of
reviewing for approval or denial. It is the responsibility
of the Applicant to read all ordinances related to the
application. Copies of ordinances may be purchased from
the Town Secretary."
"SECTION 2. AMOUNT OF FEES
The amount of the fee or fees is listed on the appropriate
schedules attached to this Ordinance. If the specific type
of proposed work is not included in the fee schedule, the
Town Building Official shall determine the fee by
selecting an item that would be similar in nature of
action or work."
"SECTION 3. REFUNDS• THERE WILL BE NO REFUNDS OF FEES
EXCEPT IN THE FOLLOWING INSTANCES
A. When it is determined that a permit cannot be
legally issued, a full refund may be authorized.
B. In cases where a building permit has been issued
and the fee paid, and no portion of the work has
been commenced, the Town will, in any case retain
ONE HUNDRED DOLLARS ($100.00), or the total
amount paid if less than ONE HUNDRED DOLLARS
($100.00)."
"SECTION 4. FEE EXEMPTION
No permit fee or plan review fee is required for work
involving buildings or structures, the title of which is
directly vested in the U.S. Government, State of Texas,
Counties of Denton and Tarrant, Texas, Town of Westlake,
Texas, or public school districts."
"SECTION 5. DOUBLE FEES
Where work for which a permit is required, is started, or
proceeded with prior to obtaining said permit, the fees
herein specified shall be doubled, but the payment of such
fee shall not relieve any persons from fully complying
with the requirements of the applicable code or ordinance
in the execution of the work nor from any other penalties
prescribed in such codes or ordinances."
"SECTION 6. VALUATION ESTIMATE
The valuation method is not used to determine the permit
fee for construction; however, the dollar value of the
proposed work shall be reported because it is important
to accurately report the total building activity in the
Town of Westlake and to determine the amount of a
maintenance or performance bond if required. The
estimate should consist of the total market value (all of
owner's costs including contractor's overhead and profit)
of the proposed construction work, excluding the value of
raw land."
"SECTION 7. NEW BUILDING PERMIT FEE
A new building permit fee includes all fees for the
building, electrical, plumbing, mechanical, fire protection
systems and concrete work to be done according to the
plans submitted. Work done after the final inspection has
been made for said permit will require additional permits
as repairs, alterations, additions or finishing of shell
buildings or other specific permits or miscellaneous
permits."
"SECTION 8. SERVICES COVERED BY FEES

"SECTION 9. COMPLETE PLANS REQUIRED
All applications for permits shall be accompanied by
complete plans and drawings according to the following:
A. Single Family Resident:
1. New House Construction - two (2) complete
sets of certified drawings.
2. Additions to Existing Structures - two (2)
complete sets of drawings of addition,
attached to original plans of dwelling.

3. Site Plan - all plans shall include a site plan
accurately drawn to scale showing location
of construction work to be performed.
4. Easements - all site plans shall show details
of all easements, streets, and alleys.
B. Commercial, Industrial and Multifamily - refer to
zoning ordinance for requirements."
"SECTION 10. ADDITIONAL EXPLANATION
If the appropriate application does not allow for full
explanation by the applicant, please attach a letter of
explanation to the application."
"SECTION 11. CONTRACTORS
All contractors must be licensed by the Town of
Westlake, Texas. General contractors, electrical and
plumbing contractors shall be bonded for a minimum of
FIVE THOUSAND DOLLARS ($5,000.00)."
"SECTION 12. EXPIRATION
All applications shall expire at the end of one (1) year
from the date of application."
"SECTION 13. PAYMENT OF FEES
All fees and building permit charges are payable at the
time of application unless specified otherwise on the fee
schedule."
"SECTION 14. PERFORMANCE BONDS
At the discretion of the Board of Aldermen of Westlake,
Texas, Performance Bonds may be required of
subdividers/developers and general contractors."

That any person, firm or corporation who violates, disobeys, omits,
neglects or refuses to comply with or who resists the enforcement of any
of the provisions of this Ordinance shall be fined not less than Five
Dollars ($5.00), nor more than One Hundred Dollars ($100.00) for each
offense. Each day that a violation is permitted to exist shall constitute a
separate offense.
PART III.
That this Ordinance shall be cumulative of all other ordinances of
the Town of Westlake affecting construction and sign applications and
fees and shall not repeal any of the provisions of such ordinances, except
in those instances where provisions of such ordinances are in direct
conflict with the provisions of this ordinance.
PART IV.
It is hereby declared to be the intention of the Town Board of
Aldermen that the sections, paragraphs, sentences, clauses and phrases of
this Ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this Ordinance shall be declared void, ineffective
or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such voidness, ineffectiveness or
unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs or sections of this Ordinance, since the same would
have been enacted by the Town Board of Aldermen without the
incorporation hereof of any such void, ineffective or unconstitutional
phrase, clause, sentence, paragraph or section.
PART V.
That this Ordinance shall become effective and be in full force and
effect from and after the date of its passage and publications, as required
by law, and it is so ordained.

SINGLE FAMILY RESIDENCE FEE SCHEDULE
Single family dwelling, new construction $ 400.00
$400.00 plus ten cents for each square foot + $ .10 psf
of floor area in dwelling, garage floor and patio
Additions to main building NO FEE

Alterations repair or remodeling of less than $4,000.00 NO FEE
where there is no increase in square footage of NO PERMIT
floor area in building or slab and no electrical,
plumbing, or mechanical work involved
Alterations repair or remodeling in excess of $4,000.00 NO FEE
and where electrical, plumbing, mechanical work NO PERMIT
is involved. All costs must be verified by contracts
from contractors or itemized list if work is performed
by owner.
Detached building (any building over 120 square foot NO FEE
floor area) NO PERMIT
Accessory portable building with no slab, no electrical $ 5.00
and less than 120 square foot floor area.
Accessory building with slab, no electrical and less $ 15.00
than 120 square foot floor area. Add $25.00 for
electrical inspection if required.
Fence NO FEE

Swimming pool, in ground NO FEE
NO PERMIT
Sprinkler systems for yards NO FEE
NO PERMIT
Antenna (tower or dish types) NO FEE

Additional inspections including Red Tag inspections $ 50.00
Moving permit for buildings moved on any Town street:
Permanent house relocation ($200.00 plus all direct and $ 200.00
indirect costs incurred by the Town of Westlake due to Plus
such relocation.)

COMMERCIAL, INDUSTRIAL, AND MULTIFAMILY FEE SCHEDULE
New construction of and additions to Main Building:
Shell buildings shall pay sixty percent (60%) of the
following schedule and each part of the finish out shall
require a new permit:
Up to 3,000 square feet $ 750.00
3,000 square feet to 5,000 square feet $ 850.00
5,000 square feet to 10,000 square feet $ 850.00
$850.00 plus ten cents per square foot (total sq. ft.) + $ .10 psf
10,000 square feet to 50,000 square feet $ 1,850.00
$1,850.00 plus ten cents per square foot + $ .10 psf
Over 50,000 square feet $ 6,850.00
$6,850.00 plus eight cents per square foot + $ .08 psf
Swimming pools, in ground only $ 250.00
Fence, if included in Building Permit $ 0.00
Fence where no other Building Permit issued $ 50.00
Additional inspections including Red Tag Inspections $ 60.00
Alterations repair or remodeling of less than $2,000.00 $ 50.00
