AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS,
EXTENDING THE EXTRATERRITORIAL JURISDICTION OF THE TOWN TO
INCLUDE APPROXIMATELY 1,176.49 ACRES OF LAND CONSISTING OF FIVE
(5) TRACTS, THREE PARCELS BEING SITUATED IN THE WILLIAM R. KELSAY
SURVEY, ABSTRACT 705, THE WILLIAM PERREY SURVEY, ABSTRACT 1633,
THE M. BEALL SURVEY, ABSTRACT 87, THE WALTER BEALL SURVEY,
ABSTRACT 8, AND THE C.W. KELSAY SURVEY, ABSTRACT 716, ALL IN
DENTON COUNTY, TEXAS, AND TWO PARCELS OF LAND SITUATED IN THE
A. V. DUNHAM SURVEY, ABSTRACT 358, THE R. A. CARRUTH SURVEY,
ABSTRACT 1517, THE R. A. CARRUTH SURVEY, ABSTRACT 1519, THE F. M.
WOODWARD SURVEY, ABSTRACT 1421, THE GALLANT GRAHAM SURVEY,
ABSTRACT 483, THE A. P. SHAMBLIN SURVEY, ABSTRACT 1177 AND THE
JOHN KENNEDY SURVEY, ABSTRACT 701, ALL IN DENTON COUNTY,
TEXAS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN
EMERGENCY AND AN EFFECTIVE DATE.
WHEREAS, TEX. REV. CIV. STAT. ANN. art. 970a (Vernon 1963)
provides that a city may extend its extraterritorial jurisdiction beyond the distance
limitations imposed by the statute to include any territory contiguous to the
otherwise existing extraterritorial jurisdiction of such city, provided that the owner or
owners of such contiguous territory request such expansion; and
WHEREAS, Betty Slaughter Williams and Gloria Slaughter Hammack own
the approximate 1,176.49 acres of land consisting of five (5) tracts of land
described more fully on Exhibits "A" and 'B" attached hereto and incorporated
herein, and have requested that the Town of Westlake expand its extraterritorial
jurisdiction to include said tracts of land; and
WHEREAS, the approximate 1,176.49 acres of land consisting of five (5)
tracts of land owned by Betty Slaughter Williams and Gloria Slaughter Hammack is
contiguous to the existing extraterritorial jurisdiction of Westlake; NOW,
THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
PART I.
That the extraterritorial jurisdiction of the Town of Westlake is hereby
extended to include the approximate 1,176.49 acres of land consisting of five (5)
tracts of land owned by Betty Slaughter Williams and Gloria Slaughter Hammack,
said tracts being more fully described in Exhibits "A" and "B" which are attached to
and incorporated into this ordinance as if fully set out herein.
PART 11.
That this Ordinance shall be cumulative of all other ordinances of the Town
of Westlake affecting its extraterritorial jurisdiction and shall not repeal any of the
provisions of such ordinances, except in those instances where provisions of such
ordinances are in direct conflict with the provisions of this ordinance.
PART 111.
It is hereby declared to be the intention of the Town Board of Aldermen that
the sections, paragraphs, sentences, clauses and phrases of this Ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance shall be declared void, ineffective or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such voidness,
ineffectiveness or unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs or sections of this Ordinance, since the same
would have been enacted by the Town Board of Aldermen without the
incorporation hereof of any such void, ineffective or unconstitutional phrase,
clause, sentence, paragraph or section.
PART 1V.
That the Board of Aldermen does hereby find that an emergency exists.
Therefore, this Ordinance shall become effective and be in full force and effect
immediately upon its passage, and it is accordingly so ordained.
