BE IT ORDAINEDY THE Or. rtiD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: PART 1. That the land located within the corporate limits of the Town of Westlake which is described in Exhibit "A" (attached to this Ordinance and hereby incorporated by reference as if fully set forth herein) be, and hereby is, disannexed from the Town of Westlake and shall no longer be included within the boundary limits of the City, and the pre=sent boundary limits of the City are hereby altered and amended to be contiguous with the eni=_ting City boundary and the boundary or the land described in Enhibit .A+. FART _ That the boundary adjustment agreement attached thereto as E:;Ihibit "B" (acrd hereby incorporated by reference as if fully, _etforth herein) be, and hereby is, approved and the Mayor is authorized to execute the same on behalf of the Town of Westlake. PART _ if any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a. person or set of circumstances is for any reason held to be unconstitutional, void, or invalid, the invalidity of the remaining portions of this ordinance shall not be affected thereby, it being the intent of the Board of Aldermen in adapting this ordinance that no portion thereof or provisions, or regulations contained herein, shall become inoperative or fail by reason of any unconstitutionality of any ogler- portion hereof and all provisions of this ordirhanue are declared to be severable for that purpose. Redman by deed recorded in Volume 668, Page 465 of the Deed Records of Denton County, Texas; Thence North 89 degrees 33 minutes 30 seconds East 1018.2 feet; Thence South 10 degrees 12 minutes East 1,203.1 feet; Thence North 28 degrees 59 minutes East, 1,362.4 feet; Thence North 89 degrees 29 minutes 30 seconds East, 626.0 feet; Thence South 01 degrees 04 minutes East, 493.95 feet; Thence South 88 degrees 57 minutes East, 324.6 feet; Thence North 11 degrees 45 minutes East, 501,5 feet; Thence North 89 degrees 07 minutes East, 289.3 feet; Thence North 89 degrees 38 minutes 30 seconds East, 362.8 feet; Thence North 89 degrees 17 minutes East 606.4 feet to a point at the northeast corner of said Carr 16.42 acre tract in the west line of a public road; STATE OF TEXAS § § BOUNDARY ADJUSTMENT AGREEMENT COUNTY OF DENTON § IHEREAS, the Town of Trophy Club, Texas ("Trophy Club") and the Town of Westlake, Texas ("Westlake") (together, the "Towns") are duly incorporated municipalities under the laws of the State of Texas and are located in Denton County, Texas; and WHEREAS, pursuant to Ordinance No. 156 of the Town of Westlake, Texas, Westlake relinquished and discontinued from its extraterritorial juris- diction all of that territory which comprises the corporate boundaries of Trophy Club, less a ten (10) foot strip (the "ten (10) foot strip") of land which generally surrounds all of the territory lying within Trophy Club north of State Highway 114, which ten (10) foot strip is more accurately described by metes and bounds in Exhibit "A" attached hereto and incorporated herein for all purposes; and WHEREAS, the ten (10) foot strip is contiguous and adjacent to the corporate limits of Trophy Club; and WHEREAS, the Towns are authorized and empowered pursuant to article 970a, §7.B -1.(a), Vernon's Texas Revised Civil Statutes, as amended, to accomplish mutually agreeable adjustments in their boundaries of areas that are less than five hundred (500) feet in width; and WHEREAS, the Towns mutually agree that because of the proximity of the ten (10) foot strip to Trophy Club, said strip of land would be more adequately served by Trophy Club with e1.services; and t WHEREAS, the the respective Town Councils of the Towns have heretofore determined that this Boundary Adjustment Agreement is in the best interest of the health, safety, morals and welfare of the citizens of the respective and have authorized the Mayor of each of the Cities to execute this Agreement. NOW, THEREFORE, for and in consideration of the mutual promises and benefits flowing to both parties to this Agreement, the receipt and sufficiency of which is hereby acknowledged, the Town of Trophy Club and the Town of Westlake do hereby CONTRACT, COVENANT, WARRANT and AGREE as follows: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this Boundary Adjustment Agreement as if copied herein in their entirety. Section 2. Westlake hereby disannexes, discontinues and relinquishes from its corporate jurisdiction all that certain ten (10) foot strip of land, together with all extraterritorial jurisdiction attached thereto, as described in Exhibit "A," attached hereto and incorporated herein for all purposes, and grants Trophy Club all of its rights, powers and privleges in and to such strip of land. Section 3.
