HomeMy WebLinkAboutOrd 153 Temporary Road Closing and Relocation of Sam School-Peytonville RoadORDINANCE NO. 153 TEMPORARY ROAD CLOSING AND RELOCATION OF SAM SCHOOL/PEYTONVILLE ROAD AN ORDINANCE OF THE TOWN OF WESTLAKE PROVIDING FOR A TEMPORARY CLOSING OF PEYTONVILLE ROAD/SAM SCHOOL ROAD WHERE IT RUNS WITHIN THE TOWN OF WESTLAKE; PROVIDING FOR A RELOCATION OF SUCH ROAD; AND DECLARING AN EMERGENCY. WHEREAS, pursuant to TEX.REV.CIV.STAT.ANN. art. 1016, Maguire/Thomas Partners -Wes tlake/ Southlake Partnership ("MTP") which is the owner of all property abutting Sam School/ Peytonville Road (the "Road") within the Town of Westlake has petitioned the Board of Aldermen of the Town of Westlake to vacate, abandon and close the Road where its current right-of-way runs through the Town of Westlake and to relocate it through the Town of Westlake in accordance with that preliminary subdivision plat and site plan approved by the Town of Westlake on July l; 1986, in Ordinance No. 151; and WHEREAS, MTP will begin construction of the proposed relocated Sam School/ Peytonville Road and the proposed parkway as shown on the preliminary subdivision plat and site plan approved in Ordinance No. 151 shortly; and WHEREAS, MTP owns all the land abutting the Road lying with the Town of Westlake and desires to have the present right-of-way closed and the Road relocated; and WHEREAS, all notices and hearings for the closing and relocation of the Road within the Town of Westlake have been given and held; and WHEREAS, the Board of Aldermen of the Town of Westlake is of the opinion that the proposed closing and relocation of the Road will promote the public health, safety and welfare of the people; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE: Section 1 That the foregoing preamble is hereby adopted and incorporated herein and declared to be true and correct. Rr rfi i nn 7 That the petition by MTP seeking a closing and abandonment of the present right-of-way of Sam School/Peytonville Road where it runs through the Town of Westlake is hereby granted and the city, by this ordinance does hereby permanently vacate, abandon and close such road where it runs through the Town of Westlake conditioned upon the reconstruction and realignment of Sam School /Peytonville Road through the Town of Westlake in accordance with the preliminary subdivision plat and site plan approved by the city in Ordinance No. 151. Section 3 That the Mayor of the Town of Westlake is hereby authorized to sign a Quitclaim Deed to MTP quitclaiming any interest which the Town of Westlake might have in and to the right-of-way for the present alignment of Sam School/Peytonville Road through the Town of Westlake. Sect i on 4 That the closing and realignment of Sam School/ Peytonville Road has been made to lessen congestion in the streets, to secure the safer passage of the citizens of Westlake and surrounding areas, and to facilitate adequate provision of transportation in the area. Section 5 That this ordinance shall become effective and be in full force and effect from and after the date of its passage, and is so ordained. PASSED AND APPROVED THIS 4th DAY OF AUGUST, 1986.
