AN ORDINANCE TO THE TOWN OF WESTLAKE, TEXAS, AMENDING ORDINANCE
NO, 49, COMPREHENSIVE ZONING ORDINANCE OF 1972, AS AMENDED, BY
AMENDING ARTICLE Iii, SECTION 2B "Building Regulations, Lot
Size"; AND DECLARING AN EFFECTIVE DATE,
WHEREAS, The Town of Westlake, Texas, consists mainly
of ranches and rural homesites situated on tracts in excess
of five (5) acres; and
WHEREAS, The Town of Westlake does not have treated water
to provide for its inhabitants nor does the town provide a
sanitary sewer system and treatment facilities; and
WHEREAS, all the residents of the Town of Westlake rely
on individual wells for their water needs; and
WHEREAS, due to the growth of the area surrounding The
Town of Westlake and its extraterritorial jurisdiction., the
water level has dropped resulting in expense to the citizens
of Westlake to extend their wells in order to have water; and
WHEREAS, The Town of Westlake is greatly concerned about
the use of well water in the area and the supply of such water
to all of those that desire to use it, particularly large
land developers whose needs would require large amounts of
well water, and
WHEREAS, The Town of Westlake desires to continue as a
rural community consisting of ranch homes on large tracts of
land and to preserve its low density and country atmosphere;
and
WHEREAS, it is necessary to protect the health, safety
and general welfare of the citizens of the Town of Westlake
by conserving the water supply and restricting the development
of the land within the corporate limits of the town so as to
preserve its low density; NOW, THEREFORE,
THE COUNCIL OF THE TOWN OF WESTLAKE, TEXAS, HEREBY ORDAINS:
PART I,
That Ordinance No. 49, Article IV, Section 2 "Building
regulations" as amended by Ordinance No. 69 is amended so
that Subsection B will hereafter read as follows:
"Section 2. Building Regulations.
B. Lot Size - The minimum area of the lot shall be ten
(10) acres.
PART 11.
That this ordinance shall be in full force and effect
immediately
after its passage
and
approval.
