IN REPLY REFER TO Attached is a copy of State Department of Highways and Public Transportation Minute Order 86417, dated October 28, 1987, authorizing the proposed construction of a freeway between Interstate 35W and State Highway 114 in Tarrant and Denton Counties. The provisions of the Minute Order must be accepted by the Cities of Westlake, Fort Worth, Town of Trophy Club, and Denton and Tarrant Counties, by January 26, 1988, or the action contained therein shall automatically be cancelled. Upon acceptance of this Minute Order by the City Council of Westlake, please furnish us with a certified original and one copy of the council's action. Sincerely, (7, If, " 4 J. R. Page I of 4 Pages WHEREAS, in DFNTON AND TARRANT COUNTIES from Interstate Highway 35W, approximately 8.0 miles north of Interstate Highway 820 to State Highway 114, approximately 1®0 mile east of U. S. Highway 377, a distance of approximately 6.8 miles, local officials and developers have requested a controlle' access facility be constructed; and WHEREAS, local officials and developers have offered to donate one hundred percent of the right of way free of cost to the State; and WHEREAS, local officials and developers have offered to provide the environmental clearance, schematics, right of way maps, field notes, construction plans, landscape and beautification plans, specifications and estimates for stage construction; and WHEREAS, in conjunction with this proposed freeway, it is desirable to relocate a 1.5 mile section of U. S. Highway 3117; and WHEREAS, local officials and developers have offered to provide the environmental clearance, schematics, right of way maps, Meld notes, construction plans, landscape and beautification plans, specifications and estimates for the relocation of U. S. Highway 377; and v1HEREAS, local officials and developers have offered to provide one hundred percent of the cost of the right of way to relocate U. S. Highway 377; and 10US County trict No. VARIOUS (2) & (18) Page 2 of 4 Pages WHEREAS, rapid and extensive development in this area and projected traffic volumes warrant proceeding with this project; NOW, THEREFORE, IT IS ORDERED that the Engineer -Director is directed to tender the following proposal to the Cities of Fort Worth and Westlake, Town of Trophy Club and Denton and Tarrant Counties: Provided the Cities Fort Worth and Westlake, Town of Trophy Club and Denton and Tarrant Counties will: 1. Provide one hundred percent of the cost of the right of way clear of obstructions and free of cost to the State with acquisition procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property for the proposed freeway from Interstate Highway 35, approximately 8.0 miles north of Interstate Highway 820 to State Highway 114, approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 6.3 miles. 2. Provide one hundred percent of the cost of the right of way clear of obstructions and free of cost to the State with acquisition procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property for the l.i mile section required for the relocation of U. Provide the environmental clearance, schematics, right of way maps, field notes, construction plans, landscape and beautification plans, specifi(-atioris and estimates for stage construction with the location, design and right of way width subject to the approval of the State Department of Highways and Public Transportation for both the proposed freeway and the relocation of U. S. Highway 377. The State Department of Highways and Public Transportation will: 1. Designate the proposed freeway as a State Highway. 2. Designate the proposed freeway as a controlled access facility. 3. Add these projects to the 4 -Year Letting Schedule, Category 3, of the 10 -Year Project Development Plan. 4. Provide one hundred percent of the cost of utility adjustments as may be required in accordance with policies of the State Department of Highways and Public Transoortation. 5. Provide relocation assistance as may be determined to he eligible under the Relocation assistance Program. 6. Provide for stage construction. 0 1 US County rict No. VARIOUS (2 & 18) MINUTE ORDER Page 4 of 4 Pages Upon acceptance of the provisions of this Minute Order by the Cities of Fort Worth and Westlake, Town of Trophy Club and Denton and Tarrant Counties, IT IS ORDERED that a STATE HIGHWAY, be and is hereby designated from Interstate Highway 35W, approximately 8.0 miles north of Interstate Highway 820 to State Highway 114, approximately 1.0 mile east of U. S. Highway 377; and BE IT FURTHER ORDERED that this State Highway be and is hereby designated a CONTROLLED ACCESS FACILITY for development, maintenance, and operation in accordance with the provisions of H. B. 179, 55th Legislature, Interstate Highway 35W, approximately 8.0 miles north of Interstate Highway 820 to State Highway 114, approximately 1.0 mile east of U. S. Highway 377; and BE IT FURTHER ORDERED that the Engineer -Director is authorized to add these projects to the 4 -Year Letting Schedule of the 10 -Year Project Development Plan; and after the Cities, Town and Counties have fulfilled their responsibilities, proceed in the most feasible and economical manner with project development to include any necessary agreements, right of way acquisitions, utility adjustments, relocation assistance and stage construction at an estimated cost of $25,000,000; and BE IT FURTHER ORDERED that the construction stage of this project shall be commenced on a schedule commensurate with the progress of area development. This Order shall become operative upon acceptance by the Cities of Fort Worth and Westlake, Town of Trophy Club and Denton and Tarrant Counties; and if not accepted within 90 days of the (1it(-? t1he action herein contained shall be automatically canceled. fitted by Examined and recommended by: le) Administrative Assistant Approved Deputy Director Engineer -Director Minu+-e Number 86417 Date Passed OCT 28 87 RESOLUTION /j-- WHEREAS, j " WHEREAS, the Town of Westlake is desirous that a Spur Freeway be constructed between Interstate 35W and State Highway 114 in Tarrant and Denton Counties; and WHEREAS, the State of Texas Department of Highways and Public Transportation has passed Minute Order 85417 dated October 28, 1987, regarding such project; and WHEREAS, the State of Texas Department of Highways and Public Transportation staff has approved the language and exhibits of the attached letter of agreement dated 11/6/87 with respect to State Highway 114, Roanoke Bypass, U.S. 377 Segment and the Spur Freeway; and WHEREAS, it is necessary for the Town to accept Minute Order 86417 in order for the construction project to proceed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: That the State of Texas Department of Highways and Public Transportation Minute Order 86417 dated October 28, 1987, is hereby accepted and the Mayor of the Town of Westlake is authorized to execute, on behalf of Westlake, any documents regarding the implementation of the Minute Order. This Resolution of approval is conditioned upon the State Department of Highways and Public Transportation delivering written notice to the Town of Westlake and obtaining the Town's additional approval if the location of the Spur Freeway or the relocation of U.S. 377 through Westlake is changed or revised in any manner from the alignment as discussed and shown in the Letter of Agreement dated 11/6/87 and Exhibits, attached hereto as Exhibit "A", between the State Department of Highways and Public Transportation and the landowners agreeing to donate the right- of-way for the Spur Freeway and relocated U.S. 377.
