IN REPLY REFER TO Attached is a copy of State Department of Highways and Public Transportation Minute Order 86418, dated October 28, 1987, authorizing the proposed construction of sections of State Highway 114 in Tarrant and Denton Counties. The provisions of the Minute Order must be accepted by the Cities of Westlake, Roanoke, Southlake, Town of Trophy Club, and Denton and Tarrant Counties, by January 26, 1988, or the action contained therein shall automatically be cancelled. S. Highway 377, a distance of approximately 3.0 miles, a project is included in the 4 - Year Lettting Schedule of the 10 -Year Project Development Plan; and WHEREAS, in Denton County on State Highway 114 from approximately 1.0 mile east of U. S. Highway 3117 in Denton County t,) the Denton/Tarrant County Line, a distance of approximately 2.5 a project is currently approved in the 4 -Year Letting Schedule of the 10 -Year Project Development Plan; and WHEREAS, in Tarrant County from the Denton/Tarrant County Line to Loop 382 in Tarrant County, a distance of approximately 5.3 miles,a project is currently approved in the 5 -Year Development Schedule of the 10 -Year Project Development Plan; and WHEREAS, local officials and developers have requested a project to develop State Highway 114 to a freeway, from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 4.1 miles; and z IOUs County Strict No. VARIOUS (2) & (18) MINUTE ORDER Page 2 of 7 Paqes WHEREAS, local officials and developers have requested the section from the Denton/Tarrant County Line to 0.3 mile southeast of Dove Road, a distance of approximately 1.6 miles, be moved into the 4 - Year Letting Schedule; and WHEREAS, local officials and developers have offered to provide one hundred percent of the cost of the preliminary engineering for the section of State Highway 114 from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0®3 mile southeast of Dove Road in Tarrant County, a distance of approximately 4®1 miles; and WHEREAS, local officials and developers have offered to provide the environmental clearance, schematics, and right of way maps, on the section from 0.3 mile east of Henrietta Creek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles; and WHEREAS, local officials and developers have offered to provide one hundred percent of the cost of the right of way from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0.3 -mile southeast of Dove Road in Tarrant County, a distance of approximately 4.1 miles; and WHEREAS, local officials and developers have offered to provide ten percent of the cost of right of way from 0.3 mile east of Henrietta Creek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles; and IOUs County trict No. VARIOUS (2) & (18) Page 3 of 7 Pages WHEREAS, local officials and developers 'nave offered to provide up to $365,000 toward right of way required to complete the interchange located at Sam School Road in Tarrant County; and WHEREAS, traffic volumes warrant proceeding with this project in an expeditious manner; NOW, THEREFORE, IT IS ORDERED that the Engineer -Director is directed to tender the following proposal to the Cities of Roanoke, Westlake, and Southlake, Town of Trophy Club and Denton and Tarrant Counties: Provided the Cities of Roanoke, Westlake and Southlake, Town of Trophy Club and Denton and Tarrant Counties will: 1. Provide one hundred percent of the cost of the right of way clear of obstructions and free of cost to the State with acquisition -procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies [or acquiring real property from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 4.1 miles, except for the right of way required to complete the Sam School Road interchange. IBM McGuire -Thomas has offered to provide up to $365,000 toward the right of way required to complete this interchange. Provide ten percent of the cost of the right of way clear of obstructions and free of cost to the State with acquisition procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property from approximately 0.3 mile east of Henrietta k -_reek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles. 3. Provide the environmental clearance, schematics, right of way maps, field notes, construction plans, landscape and beautification plans, specifications and esti-mates on State Highway 114 with the right of way width and design subject to the approval of the State Department of Highways and Public Transportation, from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 4.1 miles. 4. Provide for the environmental clearance, schematics and right of way maps with the location, right of way width, and design subject to approval of the 3tate Dapartment of Highways and Public Transportation, on State Highway 114 from 0.3 mile east of Henrietta Cfeek, west of Roanoke, northeasterly and southeasterly to approximately'l.0 mile east of U. Designate State Highway 114 from Interstate Highway 35W in Denton County to Loop 382 in Tarrant County, a distance of approximately 12.4 miles, a controlled access facility. 2. Provide ninety percent of the cost of right of way with acquisition procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property from approximately 0.3 mile east of Henrietta Creek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles. 3. Provide one hundred percent of the cost of utility adjustments as may be required in accordance with policies of the State Department of Highways and Public Transportation from 0.3 mile east of Henrietta Creek, west of Roanoke in Denton County, northeasterly and southeasterly to approximately 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 7.1 miles. 4. Provide relocation assistance as may be determined to be eligible under the Relocation Assistance Program. Provide for construction on State Highway 114 from the Denton/Tarrant County Line to 0.3 mile southeast of Dove Road, a distance of approximately 1.6 miles, by adding this section of State Highway 114 to the 4 -Year Letting Schedule. 6. Provide for construction on State Highway 114 from 0.3 mile east of Henrietta Creek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles as previously authorized by Minute Order 85712 dated April 30, 1987. 7. Provide for construction on State Highway 114 from approximately 1.0 mile east of U. S. Highway 377 to the Denton/Tarrant County Line, a distance of approximately 2.5 miles, as previously authorized by Minute Order 85091 dated November 25, 1986. Upon acceptance of the provisions of this Minute Order by the Cities, Town and Counties, IT IS ORDERED that State Highway 114 from Interstate Highway 35W in Denton County to Loop 382 in Tarrant County, a distance of approximately 12.4 miles, be and is hereby designated a CONTROLLED ACCESS FACILITY for development, maintenance, and operation in accordance with the provisions of H. B. 179, 55th Legislature; and =11"N DOUR-96(on 4 to VA 6 LOW ZIOUS County ;trict No. VARIOUS (2) & (18) )-mitted by MINUTE ORDER Page 7 of 7 Paqes BE IT FURTHER ORDERED that the Engineer -Director is authorized to add the section on State Highway 114 from the Denton/Tarrant County Line to 0.3 mile southeast of Dove Road, a distance of approximately 1.6 miles, to the 4 -Year Letting Schedule of the 1986 10 -Year Project Development Plan; and BE IT FURTHER ORDERED that after the Cities, Town and Counties have fulfilled their responsibilities, the Engineer -Director is authorized to proceed with project development in the most feasible and economical manner to include any necessary agreements, right of way acquisition, utility adjustments, and relocation assistance for the section of State Highway 114 from approximately 1.0 mile east of U. S. Highway 377 in Denton County to 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 4.1 miles; and BE IT FURTHER ORDERED that the Engineer -Director is authorized to proceed with construction at an additional estimated cost of $22,400,000 for the section on State Highway 114 from 0.3 mile east of Henrietta Creek, west of Roanoke, northeasterly and southeasterly to approximately 1.0 mile east of U. S. Highway 377, a distance of approximately 3.0 miles; arv] BE IT FURTHER ORDERED that the Engineer -Director is authorized to proceed with construction at an estimated cost of $8,700,000 for the section on State Highway 114 from the Denton/Tarrant County Line to 0.3 mile southeast of Dove Road in Tarrant County, a distance of approximately 1.6 miles. This Order shall become operative upon acceptance by the Cities of Roanoke, Westlake and Southlake, Town of Trophy Club and Denton and Tarrant Counties; and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically canceled. ,,tle) Administrative Assistant Approved Deputy Director Engineer -Director Minute Number 86418 Date Passed OCT 28 87 RESOLUTION ' c' t�X WHEREAS, the Town of Westlake is desirous that State Highway 114 be improved in Tarrant and Denton Counties; and WHEREAS, the State of Texas Department of Highways and Public Transportation has passed Minute Order 86418 dated October 28, 1987, regarding such project; and WHEREAS, the State of Texas Department of Highways and Public Transportation staff has approved the language and exhibits of the attached letter of agreement dated 11/6/87 with respect to State Highway 114, Roanoke Bypass, U.S. 377 Segment and the Spur Freeway; and WHEREAS, it is necessary for the Town to accept Minute Order 86418 in order for the construction project to proceed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: That the State of Texas Department of Highways and Public Transportation Minute Order 86418 dated October 28, 1987, is hereby accepted and the Mayor of the Town of Westlake is authorized to execute, on behalf of Westlake, any documents regarding the implementation of the Minute Order. This Resolution of approval is conditioned upon the State Department of Highways and Public Transportation delivering written notice to the Town of Westlake and obtaining the Town's additional approval if the location of the improvements to S.H. 114 through Westlake is changed or revised in any manner from the alignment as discussed and shown in the Letter of Agreement dated 11/6/87 and Exhibits, attached hereto as Exhibit "A", between the State Department of Highways and Public Transportation and the landowners agreeing to donate the right -of --way for the improvements on S.H. 114.
