CONSENT TO INCLUSION OF LAND WITHIN
LEGISLATIVELY CREATED UTILITY DISTRICTS
WHEREAS, sources of ground water are rapidly being depleted
and a critical shortage of water is anticipated on that land on
the western side of the general law town of Westlake, said land
being commonly known as the Circle T Ranch;
WHEREAS, to address said anticipated water shortage, Lake
Turner Water Supply Corporation, a Texas nonprofit water supply
corporation incorporated pursuant to TEX. REV. CIV. STAT. ANN.
art. 1434a (Vernon 1980) (hereinafter "NWSC"), was formed as an
interim vehicle to pursue alternative sources of water supply for
the Circle T Ranch;
WHEREAS, the Board of Aldermen of Westlake have consented to
the inclusion of the Circle T Ranch within NWSC's service area
and have recognized NWSC's intent to sell, transfer, convey and
assign its facilities and service rights to one or more utility
districts formed for the purpose of said conveyance, and for the.
purpose of more fully providing water supply and other
infrastructure improvements beneficial to the Circle T Ranch; and
WHEREAS, Notice of Intent to Introduce Legislation is to be
or has been given regarding creation of utility districts by the
70th Legislature of Texas, 1987, pursuant to Article XVI, Section
59 of the Texas Constitution;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE TOWN OF WESTLAKE, that Westlake hereby consents to formation
of utility districts and assignment by NWSC of its facilities and
service to said districts.
