HomeMy WebLinkAboutRes 96-22 Establishing a Public Hearing Date to Consider Adoption of Capital Improvement Plans and Imposition of Impact FeesTOWN OF WESTLAKE RESOLUTION 96-22 A RESOLUTION OF THE TOWN OF WESTLAKE ESTABLISHING A PUBLIC HEARING DATE TO CONSIDER ADOPTION OF CAPITAL IMPROVEMENTS PLANS AND IMPOSITION OF IMPACT FEES FOR WATER, WASTEWATER AND ROADWAY FACILITIES WHEREAS, the Board of Aldermen for the Town of Westlake {"Board") has authorized an impact fee study to determine whether to adopt water, wastewater and roadway impact fees in accordance with Chapter 395 of the Local Government Code; and WHEREAS, the Board has approved the land use assumptions formulated as a part of the impact fee study; and WHEREAS, Chapter 395 requires the Board to set a public hearing to consider adoption of capital improvements plans and imposition of impact fees for such facilities; NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the Town of Westlake, Texas that: 1) A public hearing shall be held on Monday, February 10, 1997, at 7:00 p.m. at the Westlake Town Hall, 3 Village Circle, Suite 207, Solana, Westlake, Texas, to consider capital improvement plans and the imposition of impact fees for water, wastewater and roadway facilities. 2) A notice of the hearing shall be published in one or more newspapers of general circulation in Tarrant and Denton Counties, once a week for three consecutive weeks, the first notice to appear before the 30`x' day but on or after the 60t' day before the date set for the hearing. The notice shall not be in the part of the newspaper in which legal notices and classified ads appear and shall not be smaller than one-quarter page of a standard -size or tabloid -size newspaper. The headline for the notice shall read as follows: "NOTICE OF PUBLIC FEARING ON ADOPTION OF IMPACT FEES." The headline shall be in 18 -point or larger type. The text of the notice shall contain the following information. a) The time, date and location of the hearing. b) A statement that the purpose of the hearing is to consider the adoption of impact fees for water, wastewater, and roadway facilities. c) An easily understandable map or maps of the service areas on which the proposed fees will be levied. d) the amount of the proposed impact fees per service unit. e) A statement that any member of the public has the right to appear at the hearing and present evidence for or against the plan and proposed fee. 3) the Town Secretary shall send a notice of the hearing by certified mail to any person who has given written notice by certified or registered mail to the Town Secretary or other designated official of the Town requesting notice of the hearing within two years preceding the date of adoption of this resolution.. These notices shall be sent by certified mail before the 30' day before the date of the hearing.. 4) This resolution shall take effect when adopted.
