RESOLUTION 96-13
A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, AUTHORIZING EFFORTS TO DISSOLVE LAKE
TURNER MUNICIPAL UTILITY DISTRICT NO. 2, AND LAKE TURNER
UTILITY DISTRICT NO. 3, AND SECURING WATER AND WASTEWATER
FACILITIES FOR THE TOWN OF WESTLAKE; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, Lake Turner Municipal Utility District No. 2 ("MUD 2"); and
Lake Turner Municipal Utility District No.3 ("MUD 3") were created by the Texas
Legislature in 1987 when Nelson Bunker Hunt owned the Circle T Ranch and it was
represented to the Board that the municipal utility districts were needed in order to
provide water to the expensive thoroughbred race horses training at the Circle T Ranch;
and
WHEREAS, Nelson Bunker Hunt no longer owns the Circle T Ranch and it is
no longer operated as a ranch for training race horses and the original purpose for
creating the MUDs no longer exists; and
WHEREAS, the Board of Aldermen believes that the Town should control the
water and wastewater services provided to residents and businesses within the corporate
boundaries of the Town; and
WHEREAS, the Town is capable and desirous of providing or securing such
services for the residents and businesses within the Town; and
WHEREAS, none of the MUDS currently serves any customers; and
WHEREAS, the Town is willing and able to assume all of the obligations of the
MUDS; and
WHEREAS, in 1992 the Town adopted a comprehensive plan including
comprehensive plans for providing water and wastewater services to all residents and
businesses; and
WHEREAS, the additional layer of bureaucracy represented by these MUDs is
wasteful and burdensome and misallocates the Town's resources for furnishing water and
sewer services to all residents and businesses on a non-discriminatory and cost-efficient
basis; and

WHEREAS, the Town is opposed to the existence of MUD 2, and MUD 3
within the Town's boundaries and believes that such MUDS are no longer necessary to
provide utility services to the Circle T Ranch or any other properties within Westlake;
and
NOW, THEREFORE, DE IT RESOLVED, by the Board of Aldermen of the
Town of Westlake, Texas:
SECTION 1: That the officials of the Town of Westlake proceed with efforts to
obtain the dissolution of MUD 2, and MUD 3, and to secure water and wastewater
facilities for the Town, and the Mayor is hereby authorized to direct and coordinate the
activities that are needed to carry out the provisions of this resolution so that the Town
shall be in control of the water and wastewater facilities within the Town's boundaries.
SECTION 2: That the Town respectfully urges State Senator Jane Nelson and
District 98 Representative Nancy Moffat to sponsor legislation in the 1997 session of the
Texas Legislature that would allow the Town of Westlake to dissolve MUD 2, and MUD
3 in the manner provided under Chapter 43 of the Local Government Code, which
dissolution provisions apply to almost every other MUD in the State of Texas.
SECTION 3: That this resolution shall be effective from and after its date of
passage.
PASSED AND APPROVED by the Board of Aldermen of the Town of Westlake
this 9"' day of September, 1996.
