RESOLUTION 97-2
A RESOLUTION EXPRESSING INTEREST IN ENTERING INTO A STANDARD
CONTRACT FOR WATER SERVICE BETWEEN THE TOWN OF WESTLAKE
AND THE CITY OF FORT WORTH AND ACKNOWLEDGING SPECIAL
INDEMNIFICATION REQUIREMENTS.
WHEREAS, it is in the long term mutual best interest of the Town of Westlake
and the City of Fort Worth to enter into a standard contract for wholesale water service,
and
WHEREAS, there exists certain known disputes regarding local development
issues that do not involve the City of Fort Worth, and
WHEREAS, it is acknowledged that the City of Fort Worth should bear no
unnecessary liability or expense if any actions (including lawsuits, administrative hearings
and regulatory hearings) are commenced as a result of the City of Fort Worth entering into
the contract.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Aldermen of the
Town of Westlake that:
SECTION 1: The Town of Westlake is interested in entering into the City of Fort
Worth's standard contract for water services.
SECTION 2: The Town of Westlake agrees to indemnify, defend and hold
harmless the City of Fort Worth from any claims, damages, judgments or expenses related
to any actions brought against the City of Fort Worth or as to which the City of Fort Worth
is made a party as a result of entering into the standard water contract with the Town of
Westlake.
PASSED AND APPROVED by the Board of Aldermen of the Town of Westlake
this 13' day of January, 1997.
