AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, PROHIBITING
UNINVITED PEDDLERS WITHIN THE CORPORATE LIMITS OF THE TOWN;
PROVIDING FOR A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, various citizens and residents of the Town of
Westlake, Texas, have indicated a desire that their privacy in
their homes be protected from uninvited solicitors; NOW
THEREFORE,
THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS HEREBY
ORDAINS:
Section 1. Uninvited Peddlers Prohibited. The practice of
going in and upon private residences in the Town by
solicitors, peddlers, hawkers, itinerant merchants or
transient vendors of merchandise, not having been requested
or invited to do so by the owner or occupant of said private
premises, for the purpose of soliciting orders for the sale
of goods, wares and merchandise and/or disposing of and/or
peddling or hawking the same is hereby prohibited. Owners
or occupants of private premises shall indicate to peddlers
that they are not invited by posting notice to that effect
at or near the entrance to the private premises.
Section 2. Penalty. That any person, firm or corporation
who violates, disobeys, omits, neglects or refuses to comply
with or resists the enforcement of any of the provisions of
this Ordinance shall be fined not less than five dollars
($5.00), nor more than one hundred dollars ($100.00) for
each offense. Each day that a violation is permitted to
exist shall constitute a separate offense.
Section 3. Severability. It is hereby declared to be the
intention of the Town Board of Aldermen that the Sections,
paragraphs, sentences, clauses, and phrases of this
Ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this Ordinance shall be
declared void, ineffective or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction,
such voidness, ineffectiveness or unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences,
paragraphs or sections of this Ordinance, since the same
would have been enacted by the Town Board of Aldermen
without the incorporation hereof of any such void,
ineffective or unconstitutional phrase, clause, sentence,
paragraph or section.
Section 4. Effective Date. That this Ordinance shall
become effective and be in full force and effect from and
after its passage and publication as required by law, and it
is so ordained.
