AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, ADOPTING THE
WATER AND WASTEWATER SYSTEMS STUDY PERFORMED BY THE HOGAN
CORPORATION AS THE MASTER PLAN FOR WATERWORKS AND
WASTEWATER SYSTEMS IN WESTLAKE; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, The Hogan Corporation was engaged by the Board
of Aldermen to perform a waterworks and wastewater systems study
for the Town of Westlake; and
WHEREAS, such study has been completed and presented to
the Board of Aldermen; NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS:
Section 1. The Water and Wastewater Systems Study
performed by The Hogan Corporation attached hereto as
Exhibit "A", be and the same is hereby adopted and
designated as the master plan for waterworks and
wastewater systems in Westlake.
Section 2. That Waterworks Plan No. 2 and Wastewater
Plan No. 2 contained in the Study are hereby specifically
adopted as the Waterworks Plan and the Wastewater Systems
Plan for the Town of Westlake.
Section 3. It is hereby declared to be the intention of
the Town Board of Aldermen that the sections, clauses and
phrases of this ordinance and the Water and Wastewater
Systems Study are severable, and if any phrase, clause,
sentence, paragraph or section of this Ordinance or the
Water and Wastewater Systems Study shall be declared
void, ineffective or unconstitutional by the valid
judgment or decree of any court of competent
jurisdiction, such voidness, ineffectiveness or
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs or sections of
this Ordinance or the Comprehensive Plan since the same
would have been enacted by the Town Board of Aldermen
without the incorporation hereof of any such void,
ineffective or unconstitutional phrase, clause, sentence,
paragraph or section.
Section 4. That this Ordinance shall become effective and be
in full force and effect from and after the date of its
passage and publication, as required by law, and it is so
ordained.
