HomeMy WebLinkAboutOrd 201 Rezoing land on the Circle T RanchORDINANCE NO. 201 AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF 1992, ORDINANCE NO. 200, TO REZONE THOSE TRACTS OF LAND AND CERTAIN PROPERTIES SHOWN ON EXHIBIT "All TO THE ZONING DESIGNATIONS REFLECTED ON EXHIBIT "All; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; AND MAKING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake embarked on a lengthy and thorough process to develop a Comprehensive Plan and a new Comprehensive Zoning Ordinance for the Town, and that process included the appointment of an advisory committee to make recommendations to the Planning & Zoning Commission and Board of Aldermen; and WHEREAS, numerous meetings and public hearings have been held during the past 18 months to discuss how the Town should be developed, the types of zoning classifications that should be permitted in the Town, and the standards and regulations that should be allowed in those classifications; and WHEREAS, the Town adopted a Comprehensive Plan for the Town, with the adoption of Ordinance No. 199, and it adopted a new Comprehensive Zoning Ordinance with the adoption of Ordinance No. 200; and WHEREAS, the Town desires to rezone the properties and tracts of land within the Town to conform with the newly adopted Comprehensive Plan and Comprehensive Zoning Ordinance and to prevent congestion in the streets; to secure safety from fire, panic and other damages; promote the health, safety, morals and general welfare of the Town; to prevent overcrowding of the land and undue concentration of population; to provide adequate light and air; and to facilitate the adequate provision of transportation, water, sewers, schools, parks and other public requirements; and WHEREAS, the Town of Westlake has published notice in an official newspaper and sent written notice to each resident and landowner affected by the proposed changes, all in accordance with the notice provisions of Chapter 211 of the Local Government Code of Texas; and WHEREAS, the Board of Aldermen has received a final report on the proposed zoning changes from the Planning and Zoning Commission of the Town of Westlake, 1 NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: Section 1. That Ordinance No. 200, the Comprehensive Zoning Ordinance of 1992, be and is hereby amended to impose the various zoning classifications as depicted on Exhibit "A" on the properties within the Town as reflected on Exhibit "A". Exhibit "A" is a map of the Town reflecting the Town boundaries and the zoning classifications that are to be imposed on the properties within the Town. Those zoning classifications are 1'R200" - Country Residential, 1IR40" - Estate Residential, "MF" - Multi -Family, ""R" - Retail, "O" - Office Park, "'0-I"' - Office -Industrial Park, and "PD11' - Planned Development District No. 1. Said re -zonings will also be reflected on the Official Zoning Map of the Town which will be attached hereto as Exhibit '"B". Section 2. That the zoning regulations and districts, as herein established, have been made in accordance with the Comprehensive Plan of the Town of Westlake for the purpose of promoting the health, safety, morals and general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic and other damages; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. Section 3. That the above described properties shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of 1992, as amended herein by the granting of these zoning classifications. Section 4. That this Ordinance shall be cumulative of all other Ordinances of the Town of Westlake affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance. Section 5. That all rights or remedies of the Town of Westlake, Texas, are expressly saved as to any and all violations of Ordinance No. 200 or of any amendments thereto of said Town of Westlake, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, the court shall have all of the powers which existed prior to the effective date of this Ordinance. Section 6. That all necessary notices have been issued and all requisite public hearing have been held in which every person desiring to do so had the free and fair opportunity to be heard. Section 7. It is hereby declared to be the intention of the Board that the sections, paragraphs, sentences, clauses and phrases of the ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, paragraphs or sentences of this ordinance, since the same would have been enacted by the Board without the incorporation hereof of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. Section 8. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined an amount not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 9. That this Ordinance shall become effective and be in full force and effect from and after the date of its passage and publications, as required by law, and it is so ordained. 3 PASSED AND APPROVED this day of November, 1992.
