AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS AN DING ARTICLE XIII,
CHAPTER 12 C.1. "PUBLIC FACILITIES" OF THE WESTLAKE UNIFIED
DEVELOPS CODE (ORDINANCE NO. 224) TO REMISE SECTION 1a.,
PERT TER STREET FEES; AND DECLARING AND EFFECTIVE DATE.
WHEREAS, on August 8, 1994, the Board of Aldermen adopted
Ordinance No. 224 which authorized the assessment of Perimeter
Street Fees in connection with the subdivision of property; and
WHEREAS, the provisions adopted by the Board. of Aldermen
provide that the Town may waive Perimeter Street Fees when a
roadway is constructed by another party; and
WHEREAS, the Board of Aldermen desires to clarify the
regulations so as to male it clear that the Town will not waive the
fees when a perimeter street is constructed by a municipal utility
district or other special district; NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERS OF THE TOWN OF WESTLAKE,
TEXAS:
SECTION 1. That Article XIII "Platting", Section 12
"Construction Requirements", Subsection C. "Public Facilities" is
hereby amended by amending Paragraph 1a. so that the last sentence
of said paragraph shall hereinafter read as follows:
Section 1a. Perimeter Street Fees. .... The Town
may waive or reduce the perimeter street fee if
the majority of the street frontage is already
developed according to the Town's Thoroughfare
Plan or the street improvements are anticipated
to be constructed by assessment or by another
party such as the state, county, or federal
government but not a municipal utility district
or other special district.
SECTION 2. That this ordinance will become effective from and
after its date of passage.
