AN ORDINANCE AMENDING ORDINANCE NO. 157 OF THE TOWN OF WESTLAKE,
TEXAS, AMENDING THE CONSTRUCTION AND SIGN APPLICATION AND FEE
SCHEDULE PROVIDING FOR A PENALTY; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE TO ALL ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on the 5th day of October, 1987, the Town of
Westlake adopted an ordinance, Ordinance No. 167, which, in part,
established a construction and sign application and fee schedule;
and
WHEREAS, the fees established by Ordinance No. 167 were
attached as Schedules and the Town is now desirous of amending
Schedules; and
WHEREAS, the Town is also desirous of amending the penalty
provision of Ordinance No. 167; NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS:
PART I.
That the Town hereby adopts the Schedule attached hereto and
incorporated herein as the amended Fee Schedule for construction
(building permits) and sign applications. Any fee not changed by
the attached Schedule remains the same in accordance with
Ordinance No. 167.
PART II.
That any person, firm or corporation who violates, disobeys,
omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this Ordinance shall be
fined not less than Five Dollars ($5.00), nor more than Two
Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate
offense.
PART III.
That this Ordinance shall be cumulative of all other
ordinances of the Town of Westlake affecting construction and
sign application fees and specifically Ordinance No. 167 as it
relates to such fees; but shall not repeal any of the provisions
of said ordinance, except in those instances where provisions of
said ordinance are in direct conflict with the provisions of this
ordinance.
PART IV.
It is hereby declared to be the intention of the Town Board
of Aldermen that the sections, paragraphs, sentences, clauses and
phrases of this Ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this Ordinance shall be
declared void, ineffective or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such
voidness, ineffectiveness or unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs or
sections of this Ordinance, since the same would have been
enacted by the Town Board of Aldermen without the incorporation
hereof of any such void, ineffective or unconstitutional phrase,
clause, sentence, paragraph or section.
PART V.
That this Ordinance shall become effective and be in full
force and effect from an after the date of its passage and
publications, as required by law, and it is so ordained.

BUILDING PERMITS
I. PRE-APPLICATIONfPRE-DESIGN CONFERENCE.
This is intended to provide the applicant with a verbal interpretation of
ordinances, codes and processes, and to respond to any questions they may
have. The Conference may involve the Building Official and Town Engineer.
Subsequent meetings shall be held after the application is submitted. This fee
shall be credited toward the next ongoing fee, if any, when due.

Vi. Building Inspection Waiver

The Applicant must submit a site plan showing the location of the
proposed improvement. If the proposed improvement is set back more than
twice the height of the improvement (minimum 501) from any existing or master
planned right-of-way, the request may be presented to the Planning and Zoning
commission to waive all further building inspection and building permit
requirements. If the proposed improvement does not constitute a safety or
nuisance problem, and is for the land owners personal use, the Planning and
Zoning commission may waive any further building inspection and building
permitting requirements.
