AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, ESTABLISHING A
MORATORIUM PROHIBITING THE PROCESSING OF PLATS, REPLATS, ZONING
APPLICATIONS, OR BUILDING PERMITS FOR SUBDIVISIONS, DEVELOPMENT, OR
CONSTRUCTION WHERE THE USE OF SEPTIC TANKS IS CONTEMPLATED FOR THE
TREATMENT OF SEWAGE UNLESS THE LOT OR LOTS HAS A MINIMUM SIZE OF
TEN (10) ACRES; TO BECOME EFFECTIVE UPON PASSAGE AND APPROVAL.

WHEREAS, the Town of Westlake previously had a requirement that the
minimum residential lot in the Town should be ten (10) acres
because of the problems arising from the treatment of sewage by
septic tanks and the reliance on water wells for water; and
WHEREAS, the Town of Westlake adopted a new comprehensive zoning
ordinance in October, 1992, and inadvertently failed to carry over
a minimum lot size for residential development when septic tanks
are used as the method of treating sewage,-
WHEREAS,
ewage;
WHEREAS, the Town of Westlake is desirous of reviewing and studying
the requirements for minimum lot sizes when septic tanks are used;
and
WHEREAS, pending the result of this study it is appropriate to
establish a moratorium on any proposed development that is
contemplating the use of septic tanks;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN
OF WESTLAKE, TEXAS:
1. That there is hereby instituted a moratorium prohibiting the
approval of any plats, replats, subdivisions, zoning changes, or
building permits for any development or construction that includes
the use of septic tanks as the method of treating sewage. Lots of
the size of ten (10) acres or greaten are excluded from the
provisions of this moratorium.
2. That this moratorium should remain in effect for a period of
ninety (90) days or until sooner canceled by the Board of Aldermen.
3_ That this ordinance shall be in full force and effect from and
after its passage and approval.
PASSED AND APPROVED BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS, THIS 7th day of March, 1994.
