HomeMy WebLinkAboutOrd 245 Fee and Use schedule charges for responding to False AlarmsORDINANCE NO. o� AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS PROVIDING FOR CHARGES FOR RESPONDING TO FALSE ALARMS; PROVIDING FOR A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the Board of Aldermen of the Town of Westlake, Texas does hereby implement the following set of charges for responding to false alarms: (a) A service charge shall be made by the Town to the person or entity responsible for causing a response to a false alarm the on the basis of the number of false alarms occurring at an alarm site during the previous twelve months as follow: (1) False Alarms - Single family residential, multiple family dwellings, and commercial, industrial, and retail: Number of False Alarms Service Charge 0-$ 17-10 No Charge $50.00 (2) For each and every alarm above 10, the charge will be increased by $25.00 for each false alarm so that 11 will be $75.00, 12 will be $100.00, etc. (b) Failure to pay the charge as required in this section within sixty (50) days of billing will result in interest at 10% being added to the invoice. (c) "False alarm" means an alarm notification to a communication dispatch center which causes the dispatch of a police and/or fire emergency vehicle or emergency medical service ("EMS") ambulance, and the responding officer finds no evidence of unauthorized intrusion, attempted unauthorized intrusion, robbery, attempted robbery, other type of serious crime or attempted crime, fire or activated sprinkler system, injury, illness or medical condition requiring an EMS response. (d) All residences, businesses, and other structures equipped with operational alarm systems shall configure those systems so that alarms are received by an independent concern that can monitor the calls prior to contacting police, fire, or EMS, and in no event, shall such systems be hooked directly into the 9-1-1 communications dispatch center. SECTION 2: If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held unconstitutional or unenforceable, such holding shall not affect the validity of the ORDINANCE NO. z; (415'—Page Two ( 2 ) remaining portions of this ordinance. SECTION 3: .Any person, firm, or corporation violating any of the provisions of this ordinance or failing to pay the charges set out herein shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the Town of Westlake, Texas, shall be subject to a fine not to exceed the sum of two hundred dollars ($200.00) for each offense. SECTION 4: This ordinance shall become effective upon its adoption. PASSED AND APPROVED THIS DAY OF ��i , 1995.
