HomeMy WebLinkAboutOrd 242 Canvassing the August 12, 1995 Sales and Use Tax ElectionORDINANCE NO. 242 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD ON AUGUST 12, 1995 ON THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX PURSUANT TO SECTION 4A, ARTICLE 5190.6, V.T.C.S. WHEREAS, an election was held in the Town of Westlake, Texas on the 12th day of August, 1995, for the purpose of submitting a certain proposition for the adoption of an additional one-half cent sales and use tax to the resident electors of the Town pursuant to the provisions of Section 4A of Article 519x.6, V.T.C.S.; and WHEREAS, it is hereby found and determined that notice of the election was duly given in the form, manner and time required by law, and said election was in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings calling and governing the holding of such election; and WHEREAS, the returns of said election have been duly and legally made and submitted to the Board of Aldermen for canvassing, and a tabulation of the returns for each polling place and for absentee voting, as canvassed and tabulated by this governing body, reflect that the sum of totals "FOR" and "AGAINST" the proposition submitted is as follows: PROPOSITION "Shall the Town of Westlake, Texas adopt an additional one- half cent (1/2) sales and use tax within the Town, pursuant to the provisions of Section 4A, Article 5190.6, Vernon's Texas Civil Statutes, as amended, for the promotion and development of new and expanded business enterprises?" "FOR" "AGAINST" 19 votes 1 vote THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That all of the recitals contained in the preamble of this ordinance are found to be true and are the adopted findings of fact by this governing body and as part of its judgment. SECTION 2: That it is further found and determined that the results of the election are as canvassed and tabulated in the preamble hereof, and, a majority of the electors voting at said election having voted in favor of the proposition, the Board of Aldermen is hereby declared and authorized and empowered to levy an additional one-half cent sales and use tax for the purposes stated in the above proposition, all as more fully set forth and identified above and in the proceedings ordering said election. ORDINANCE NO. 9d, August 14, 1595 Page Two (2) SECTION 3: The Town Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation in the election register maintained by the Town in accordance with the provisions of Section 67.006 of the Election Code. Isham, Town Attorney MINUTES AND CERTIFICATION On August 14, 1995 the Board of Aldermen of the Town of Westlake, Texas convened in a regular meeting at its regular meeting place in Westlake, Texas. The roll of the duly constituted officers and members of the Board of Aldermen was called, which are as follows: Name Title Scott Bradley Mayor Alvin Oien Alderman Carroll Huntress Alderman Jerry Moore Alderman Howard Dudley Alderman Fred Held Alderman all of whom were present except the following absentee(s): none _ thus constituting a quorum. Among other business, a written Ordinance bearing the following caption was introduced: AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD ON AUGUST 12, 1995 ON THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX PURSUANT TO SECTION 4A, ARTICLE 5190.6, V.T.C.S. After due discussion, it was duly moved and seconded that the Ordinance be adopted. The Presiding Officer put the motion to a vote of the Board of Aldermen, and the Ordinance was adopted by the following vote: AYES: 5 NOES: 0 ABSTENTIONS: a The Presiding Officer then declared the Ordinance to be adopted. MINUTES APPROVED AND CERTIFIED TO BE TRUE AND CORRECT and to correctly reflect the duly constituted officers and members of the Board of Aldermen, and the attached copy of the Ordinance is hereby certified to be a correct copy of an official copy thereof, on file among the official records of the Board of Aldermen, on this 14th day of August, 1995.
