HomeMy WebLinkAboutOrd 241-A Amending the Fee and Use ScheduleORDINANCE NO. 241-A AN ORDINANCE AMENDING ORDINANCE 140. 167 OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE FEES FOR SPECIAL BUILDING PERMITS; PROVIDING FOR A PENALTY; PROVIDING THAT THIS ORDINANCE BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on the 5th day of October, 1987, the Town of Westlake adopted an ordinance, Ordinance No. 167, which, in part, established construction and sign application and fee schedule; and WHEREAS, on the 4th day of April, 1994, the Town of Westlake adopted an ordinance, Ordinance No. 213, amending the fee schedules attached to Ordinance No. 167 except for the fees for special building permits; and WHEREAS, the Town of Westlake is now desirous of adopting a new schedule of Special Building Permit Fees; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: :PART 1: That the Town now adopts the Schedule attached hereto and incorporated herein as the amended Fee Schedule for Special Building Permit Fees. PART II: That any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not less than Five Dollars ($5.00), nor more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. PART III: That this Ordinance shall be cumulative of all other ordinances of the Town of Westlake affecting Special Building Permit Fees and specifically Ordinance No. 167 as it relates to such fees; but shall not repeal any of the provisions of said ordinance, except in those instances where provisions of said ordinance are in direct conflict with the provisions of this Ordinance. PART IV: If any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance, since the same would have been enacted by the Town Board of Aldermen without the incorporation hereof of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. PART V. That this Ordinance shall become effective and be in full force and effect from and after the date of its passage and ORDINANCE NO. 241-A Page Two (2) publication, as required by law.
