HomeMy WebLinkAboutOrd 236 Annexing 43.071 acres in the MEP & PRR survey A923ORDINANCE NO. 236 AN ORDINANCE ANNEXING A 'TRACT OF LAND CONTIGUOUS AND ADJACENT TO THE TOWN OF WESTLAKE, TEXAS PURSUANT TO THE PROVISIONS OF SECTION 43.471 OF THE LOCAL GOVERNMENT CODE AND BEING A PORTION OF THE LOOTS, TRACTS, OR PARCELS OF LAND OUT OF THE M.E.P. & P.R.R. COMPANY SURVEY, ABSTRACT NO. 923 IN DENTON COUNTY, TEXAS; CLASSIFYING THE SAME AS O -OFFICE PARR; OUTLINING A MUNICIPAL SERVICE PLAN; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Lake Turner Municipal Utility Districts No. 1, 2 & 3 (MUDS #1, #2 & #3 respectively) were created by acts of the Texas Legislature in 1987; and WHEREAS, all of the property within MUDS #2 & #3 were entirely within the corporate limits of the Town of Westlake at the time of the passage of the acts and substantially all of the property within MUD #1 was within the corporate limits of the Town of Westlake; and WHEREAS, the only property within MUD #1 that was not within the corporate limits of Westlake at the time of the passage of the act is the tract made the subject of this annexation; and WHEREAS, MUDS #1, #2 and #3 have settled various differences between them so that the tract made the subject of this annexation is no longer within the boundaries of MUD #1, but has been entirely annexed into the boundaries of MUD #3; and WHEREAS, at least one-half of the area of MUD #3 is within the corporate boundaries of the Town of Westlake; and WHEREAS, pursuant to Section 43.071 of the Local Government Code, the Town of Westlake may annex land that is located within a water or sewer district provided that it annexes the entire portion that is outside its boundaries; and WHEREAS, the tract of land made the subject of this annexation is within Westlake`s extra -territorial jurisdiction; and WHEREAS, no part of MUD #3 lies within the corporate boundaries of any other city, town or village; and WHEREAS, this annexation will result in MUD #3 being located entirely within the corporate boundaries of the Town of Westlake; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF WES'TLAKE, TEXAS; SECTION 1. That a tract of land out of the M.E.P. & P.R.R. Company Survey, Abstract No. 923 of Denton County, Texas as more fully described on Exhibit 1 attached hereto and incorporated Annexation - Land in MUD Page Two (2) herein is hereby annexed to the Town of Westlake, Texas, and the same is made a part of said Town and the land and any present or future inhabitants shall be entitled to all the rights and privileges of other citizens of said Town and shall be bound by the acts and ordinances of said Town now in effect or which may hereinafter be enacted. SECTION 2. The tract of land described on Exhibit 1 is hereby classified and zoned as O -Office Park Use property and shall appear on the official zoning map of the Town of Westlake, Texas as such, which map shall be amended accordingly. SECTION 3. The tract of land being annexed pursuant to this ordinance is subject to the following muncipal service plan: a. Police patrolling and emergency ambulance service will be provided at a level substantially equivalent to the level of services provided other areas of the Town by the Town of Trophy Club, and fire protection will be provided at a level substantially equivalent to the level of services provided other areas of the Town by Trophy Club MUD #1. b. Water will be furnished in accordance with agreements reached between the property owner and the Town of Westlake. C. Sewage disposal will be provided in accordance with agreements reached between the property owner and the 'Town of Westlake. d. Public roads and streets will be maintained on the same basis as other roads and streets in the Town. e. No capital improvements are necessary to provide the same level of municipal services to the annexed tract. PASSED AND APPROVED ON THIS THE 6TH DAY OF MARCH, 1995. Vallie Noah to J$mes M. and Joe Noah on September 20, 1963, and recorded in Volume 501, Page 695, Deed Records of said county, this tract being adjacent to the original Townsite of Roanoke and being more particularly described as follows: BEGINNING at the Southeast corner of said M.E.P. & P.R.R. Survey on a fence at a turn in a public road; THENCE north 89 degrees 08 minutes 27 seconds West with a fence on the South line of said survey 1955.90 feet to a found rock; THENCE north 00 degrees 15 minutes 15 seconds East on or near a fence 623.08 feet to a found fence corner; WENCE !North 70 degrees 05 minutes 25 seconds West with a fence, 335.24 feet to a found fence corner; THENCE North 24 degrees 17 minutes 25 seconds East with the East line of the Roanoke original Townsite along and near a fence, 561.80 feet to a found 1/4 inch iron rod; THENCE South 84 degrees 00 minutes 45 seconds East, 449.78 feet to a found 1/4 inch iron rod, THENCE North 00 degrees 31 minutes 45 seconds West, 44.00 feet to a found fence corner at the Southwest corner of the Bluebonnet Addition as recorded in Volume 343, Page 446, Decd Records, Dallas County, Texas; I3 r.toh THENCE South 89 degrees 37 minutes 03 seconds East with the South line of said Addition 1593.53 feet to a corner on the Fast line of said M.E.P. & P.R.R. Survey in the middle of a road; THENCE South 00 degrees 09 minutes 15 seconds West with said line in said road 1265,08 feet to the POINT OF BEGINNING and CON'T'AINING 2,568,144 square feet or 58.96 acres of land, mere or less.
