AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS RESTRICTING THE OPERATION OF CERTAIN
MOTOR VEHICLES ON PUBLIC STREETS WITHIN THE TOWN;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE;
AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE TOWN OF
WESTLAKE, TEXAS:
SECTION l:
(a) No person shall operate or cause to be operated any motor vehicle, tractor -
trailer, truck -trailer, bus, trailer, semitrailer, road trailer, pole trailer, mobile home, truck
or combination thereof with three (3) or more axles and/or rated capacity in excess of one
and one-half (1 and 1/2) tons according to the manufacturer's classification upon any
public street, alley, parkway, boulevard or roadway within the corporate limits of the
Town except upon designated state and/or federal highways.
(b) The terms of Section 1 (a) above shall not apply to recreational vehicles,
horse trailers, dog trailers, boat trailers, street construction, maintenance or repair
equipment engaged in the construction and repair of public roadways within the corporate
limits of the Town; trucks, equipment, trailers and vehicles used by public service
companies engaged in repairing or extending public service utilities within the corporate
limits of the Town; authorized emergency vehicles; and the Town's franchised garbage
collection contractor while engaged in garbage collection activities pursuant to the
contract with the Town.
( c) Vehicles restricted to the designated state and/or federal highways within the
corporate limits of the Town may depart from such where it is necessary to load or unload
merchandise at locations situated off the designated state and/or federal highways;
provided, however, such vehicles shall not leave such state and/or federal highway until
they have reached a turning off point that can be described as the shortest distance
practical to the ultimate destination of the vehicle which is consistent with the reasonable
operation of the vehicle.
(d) Any person operating a commercial motor vehicle, truck -tractor, trailer,
semitrailer, pole trailer, mobile home. or combination thereof on any street or roadway
which is not a designated state and/or federal highway shall have in possession for
inspection of police officers such person's log book, delivery slips, or other evidence of
such person's destination and point of origin to justify the presence of the vehicle on a
street or roadway other than a designated state and/or federal highway.

SECTION 2: It is hereby declared to be the intention of the Board of Aldermen
that the sections, clauses, and phrases of this Ordinance be severable, and if any phrase,
clause, sentence, paragraph or section of this Ordinance shall be declared void,
ineffective, or unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such voidness, ineffectiveness, or unconstitutionality shall not affect any of
the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since
the Board would have enacted the same without any void, ineffective, or unconstitutional
phrase, clause, sentence, or paragraph.
SECTION 3: Any violation of the Ordinance is subject to the maximum fine
permitted under the laws of the State of Texas for violations by operators of motor
vehicles.
SECTION 4: This Ordinance becomes effective upon its passage and approval.
