HomeMy WebLinkAboutOrd 318 Amending the Unified Development Code ORDINANCE NO. 318 AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE WESTLAKE UNIFIED DEVELOPMENT CODE BY AMENDING ARTICLE V "ZONING DISTRICT DEVELOPMENT STANDARDS" BY ADDING A NEW SUBSECTION 2.2 "ACCESSORY BUILDING SETBACK", AND AMENDING ARTICLE VIII "LANDSCAPE REQUIREMENTS" BY AMENDING SUBSECTION 3.411 "ROADWAY LANDSCAPE ZONES", PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE. WHEREAS, as a result of recent rezonings of property to Planned Development districts, the Town's planner has recommended changes to the Westlake Unified Development Code ("UDC"); and WHEREAS, proper notice has been given, public hearings have been held before the Planning and Zoning Commission and Board of Aldermen, and the Planning and Zoning Commission has forwarded a recommendation on the changes to the UDC to the Board; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: (a) That Article V. "Zoning District Development Standards" of the Westlake Unified Development Code ("UDC") is hereby amended by adding a new Subsection 2.2 "Accessory Building Setback"which shall hereinafter read as follows: 2.2 Accessory Building Setback Accessory buildings on residential lots shall meet all front and side yard requirements for primary structures. However, when the accessory building is located behind the rear facade of the primary structure,then it may meet the following setback: A. If the accessory building is 200 square feet or less in area and eight (8)feet or less in height, then it may be setback a minimum of three (3)feet from the property line. B. If the accessory structure is greater than 200 square feet in area or eight (8) feet in height,then it must be set back one (1) foot from the property line for each one (1) foot in height up to the minimum setback for a primary structure. C. Notwithstanding the above, any garage or carport must be setback a minimum of 10 feet from a laneway right-of-way. Ordinance No. —�?/y Page 2 (Amendments to Westlake UJ)n (b) That Article VIII. "Landscape Requirements" of the Westlake Unified Development Code is hereby amended by amending Subsection 3 AB which shall hereinafter read as follows: 3.4B. Application. Roadway Landscape zones occur on all roadways in the Town. SECTION2: If any portion of this Ordinance, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Board hereby determines that it would have adopted this Ordinance without the invalid provision. SECTION 3: That this Ordinance shall become effective upon its passage and approval. PASSED AND APPROVED BY THE BOARD OF ALDERMEN ON THIS 23RD DAY OF NOVEMBER, 1995.
