ORDINANCE NO. 309-01
AN ORDINANCE AMENDING ORDINANCE NO. 309, WHICH REZONED A
516 -ACRE TRACT ON THE CIRCLE T RANCH KNOWN AS PLANNING AREA
3, TO REMOVE A 24.59 -ACRE TRACT TO BE KNOWN AS THE WESTLAKE
CIVIC CAMPUS SITE; PROVIDING FOR A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on September 14, 1998, the Board of Aldermen of the Town of
Westlake, Texas adopted Ordinance No. 309, which rezoned a 516 -acre tract on the
Circle T Ranch known as Planning Area 3; and
WHEREAS, on July 10, 2002, the Town of Westlake purchased a 24.59 -acre
tract, in the J. Gibson Survey, A-592, R. Eads. Survey, A-492 and Jesse Sutton Survey,
A-145, Tarrant County, Texas, located in Planning Area 3 of PD 3 on the Circle T
Ranch; and
WHEREAS, it is the Town's intention to locate the Westlake Civic Campus on
this 24.59 acre tract and wishes to remove it from PD 3-3-2; and
WHEREAS, on August 8, 2002, the Planning and Zoning Commission of the
Town of Westlake has recommended approval of this action; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE TOWN OF WESTLAKE, TEXAS:
SECTION 1: All matters stated in the preamble are found to be true and correct
and are incorporated herein as if copied in their entirety.
SECTION 2; That the 24.59 -acre tract is hereby removed from PD 3-3-2.
SECTION 3: Sections, paragraphs, sentences, phrases, clauses and words of this
Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word
in this Ordinance or application thereof to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the Board of Aldermen hereby
declares that it would have passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
SECTION 4: This Ordinance shall become effective upon its passage by the
Board of Aldermen.
