HomeMy WebLinkAboutOrd 302 Amending Thoroughfare Plan, the Land Use Section of the Comprehensive Plan and the Open Space PlanORDINANCE NO. 302 AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, AMENDING THE THOROUGHFARE PLAN FOR THE TOWN OF WESTLAKE BY AMENDING THE CONCEPTUAL THOROUGHFARE PLAN, AND AMENDING THE LAND USE SECTION OF THE WESTLAKE COMPREHENSIVE PLAN BY REVISING THE CONCEPTUAL OPEN SPACE PLAN; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the Town of Westlake is considering the rezoning of a portion of the Town into a "PD" Planned Development District for Maverick Commercial Investments, Inc., and WHEREAS, the adoption of the Planned Development District would result in revising the Thoroughfare Plan for the Town and the present Conceptual Open Space Plan contained in the Westlake Comprehensive Plan; and WHEREAS, the Board of Aldermen adopted a Comprehensive Plan for Westlake in 1992, and a Thoroughfare Plan for the Town of Westlake on November 25, 1996; and WHEREAS, the Board of Aldermen is desirous of amending the Thoroughfare Plan by adopting a new Conceptual Thoroughfare Plan and amending the Conceptual Open Space Plan contained in the Land Use Section of the Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the Thoroughfare Plan for the Town of Westlake adopted by the Board of Aldermen on November 25, 1996 is hereby amended by replacing the Conceptual Thoroughfare Plan contained in the Thoroughfare Plan attached hereto as Exhibit "1" and Exhibit "1" is hereby adopted as the Conceptual Thoroughfare Plan for the Town of Westlake, Texas. This revision results in Kirkwood Blvd. ending at Precinct Line Road and Lake Turner Parkway intersecting SH 114 so that a Major Boulevard Arterial does not cross the Maverick Commercial Investments, Inc. (Fidelity Investments) property. SECTION 2: That the Land Use Section in the Westlake Comprehensive Plan adopted by Ordinance No. 199, as amended, is hereby amended by replacing the Conceptual Open Space Plan, Illustration 13 with the revised Conceptual Land Use Plan, Illustration 13 attached as Exhibit "2" hereto and incorporated herein. This revision makes the open space on the Maverick Commercial Investments, Inc. (Fidelity Investments) property private open space instead of public open space exept for an area along SH 114. Ordinance No. 302 Page 2 SECTION 3: That this Ordinance shall become effective upon its passage and approval and upon the adoption of an ordinance rezoning an approximately 311 -acre tract of land to "PD" Planned Development District No. 2 and the conditions contained in Part VII, of that ordinance being satisfied. SECTION 4: If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Board hereby determines that is would have adopted this Ordinance without the invalid provision.
