HomeMy WebLinkAboutOrd 298 Adopting a revised Unified Development CodeORDINANCE NO. 298 AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, ADOPTING AN AMENDED UNIFIED DEVELOPMENT CODE FOR THE TOWN OF WESTLAKE; PROVIDING FOR A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake, Texas adopted a Unified Development Code in May, 1994; and WHEREAS, the Town's consultants and land use attorneys have recommended amendments and changes to the existing Unified Development Code; and WHEREAS, a new amended Unified Development Code has been prepared which incorporates the amendments and changes recommended to the Town of Westlake; and WHEREAS, the Planning and Zoning Commission has considered the amended Unified Development Code and recommends its passage to the Board of Aldermen; and WHEREAS, the Board of Aldermen has held numerous public hearings for many months to allow interested property owners to comment on the proposed amended Unified Development Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION I: That an amended unified development code entitled the TOWN OF WESTLAKE UNIFIED DEVELOPMENT CODE, February, 1998, attached hereto as Exhibit "A" be and the same is hereby adopted and designated as the Unified Development Code for the Town of Westlake, Texas, and it replaces the Unified Development Code adopted by Ordinance No. 218 in May, 1994. SEC77ON 2: Any violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violations of a municipal ordinance governing the public health and sanitation and safety of the Town. In the event that it is determined that this Ordinance does not constitute the governing of public health and sanitation and safety, or the maximum fine is set by state law, than a violation of this Ordinance is subject to the maximum fine permitted under the laws of the State of Texas for violation of town ordinances or set by state law. SEC770N 3: If any phrase, clause, sentence, paragraph or section of this Ordinance shall be deemed void, ineffective, or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity, ineffectiveness, or ORDINANCE NO. _O Page Two (2) unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance since the Board of Aldermen would have enacted the same without any void, ineffective, or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4: This Ordinance shall become effective from and after the date of its passage. All pending development applications and proposals shall be processed in accordance with the standards and requirements and pursuant to the procedures established by this Ordinance.
