HomeMy WebLinkAboutRes 98-17 Approving a Variance for Lots No. 3 and 4 in The Estates of WestlakeTOWN OF WESTLAKE RESOLUTION NO. 98-17 A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, APPROVING A VARIANCE FROM THE SETBACK LIMITATION FOR THE RICHARD MYERS HOME TO BE CONSTRUCTED ON LOTS NO. 3 & 4 IN THE ESTATES OF WESTLAKE, AN ADDITION TO THE TOWN OF WESTLAKE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Richard Myers has requested that the Town of Westlake grant a variance to its setback limitation reducing the 40 foot building setback to 30 feet on his home to be constructed on lots 3 & 4 in The Estates of Westlake, an addition to the Town of Westlake. WHEREAS, the Board of Aldermen has conducted a public hearing concerning the proposed variance; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That a variance be granted to Richard Myers permitting a setback of 30 feet on his home to be constructed on lot 3 & 4 in The Estates of Westlake, an addition to the Town of Westlake. SECTION 2: That this resolution shall become effective upon its passage and approval. PASSED AND APPROVED by the Board of Aldermen of the Town of Westlake this 23"' day of November, 1998. Myers President November 3, 1998 Town of Westlake Attn: Dennis Wilson 2 Village Circle, Suite 207 Westlake, Texas 76262 RE: Building Line Variance, The Estates of Westlake Dear Dennis: While preparing our house building plans for Lot 3 at The Estates of Westlake, we noticed that our house would destroy a beautiful cluster of approximately twenty native oak trees if built where planned. The only way to avoid those trees is to slide the house ten feet to the south to mare sure that the home's foundation is outside of the critical root zone of those trees. In order to move the house to the south, we need to receive a variance from the Town of Westlake which would reduce the 40 -foot building line to 30 feet in just the location marked on the attached site plan. As you can see on the site plan, the home is "sandwiched" in between the trees and the building line. Please note that we are also purchasing Lot 4 and are requesting the same building line variance on just a small portion of that lot. For your review and for submission to the Town of Westlake for our variance request, I have included fifteen copies of the site plan and tree survey and one large copy of the plan and house elevation. please call me at metro (817) 577-8880 with any questions or comments regarding this variance request. It should be noted that the guest house overlaps the property line with Lot 4, and that Lots 3 & 4 must be combined through platting prior to receiving a building permit for that structure. In addition, the drawing notes wood fences, which the Town does not allow. R£comMENQATICIN Due to the location of Lots 3 & 4 facing a cul de sac, and the fact that a ma;arity of Let 4 will remain open space, it is recornmended that the building setback along the property lines adjacent to the cul de sac be reduced to 30 feet as shown on the attached drawing.
