A RESOLUTION OF THE TOWN OF WESTLAKE, TEXAS, AWARDING A
CONSTRUCTION CONTRACT TO REYNOLDS ASPHALT AND CONSTRUCTION
COMPANY IN AN AMOUNT NOT TO EXCEED $40,301.95 FOR THE EMERGENCY
RECONSTRUCTION OF SAM SCHOOL ROAD; DECLARING AN EXEMPTION
FROM THE COMPETITIVE BIDDING REQUIREMENTS OF SECTION 252.022 OF
THE TEXAS LOCAL GOVERNMENT CODE; AND AUTHORIZING A BUDGET
AMENDMENT TO ALLOW FOR THIS EXPENDITURE; DECLARING AN
EFFECTIVE DATE; AND PROVIDING A SAVINGS CLAUSE.
WHEREAS, the Texas Department of Transportation will temporarily close access from
Kirkwood to State Highway 114 for construction purposes on or about June 1, 2001; and
WHEREAS, Sam School Road in the Town of Westlake will be used as the primary
detour route once the closure of Kirkwood access to State Highway 114 is implemented; and
WHEREAS, Sam School Road's pavement and subgrade are in poor condition and will
not uphold to the increased traffic due to this detour; and
WHEREAS, a reconstruction of Sam School Road is necessary to preserve or protect the
public health or safety of the Town's residents pursuant to Section 252.022 of the Texas Local
Government Code; and
WHEREAS, the Town of Westlake has procured competitive proposals for the
reconstruction of Sam School Road and the most competitive proposal is from Reynolds Asphalt
and Construction Company.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
TOWN OF WESTLAKE, TEXAS:
Section l: That all the recitals contained above are found to be true and correct and
are incorporated into this Resolution in their entirety.
Section 2: That the Town Manager be authorized to execute a construction contract
in an amount not to exceed $40,301.95 with Reynolds Asphalt and Construction Company.
Section 3: That the Town's budget be amended to account for this expenditure.
Section 4: It is hereby declared to be the intention of the Board of Aldermen of the
Town of Westlake, Texas, that sections, paragraphs, clauses and phrases of this Resolution are
severable, and if any phrase, clause, sentence, paragraph or section of this Resolution shall be
declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs or sections of this Resolution since the same would have been enacted by the Board
of Aldermen of the Town of Westlake without the incorporation in this Resolution of any such
unconstitutional phrase, clause, sentence, paragraph or section.
Section 5: This Resolution shall become effective upon its passage.
