RESOLUTION NO. 02-41 A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, CONCURRING IN THE STATE'S DETERMINATION THAT A PORTION OF THE STATE'S RIGHT-OF-WAY IS NO LONGER NEEDED FOR THE USE OF CITIZENS AS A ROAD AND THAT THE RIGHT- OF-WAY BE QUITCLAIMED TO THE TOWN OF WESTLAKE IN ACCORDANCE WITH STATE REGULATIONS. WHEREAS, the State of Texas acquired and holds in its name right-of-way on old U.S. Hwy. 377 as described in Exhibit A attached hereto and made a part hereof, and WHEREAS, the State of Texas has determined that said right-of-way is no longer needed for the construction, maintenance and operation of old U.S. Hwy. 377, and WHEREAS, Town Staff has studied the public need for said right-of-way and has determined that the right-of-way is no longer needed for the use of citizens as a road or for public transportation purposes, and WHEREAS, the Town of Westlake, Texas desires that the State of Texas convey its title to the right-of-way to the Town of Westlake, Texas. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the State's right-of-way shown on the attached Exhibit A is no longer needed for the use of citizens as a road, public transportation or similar purposes. SECTION 2: That the Board of Aldermen of the Town of Westlake, Texas desires that this right-of-way be conveyed to the Town of Westlake, Texas. SECTION 3: That this Resolution shall become effective upon the date of its passage. PASSED AND APPROVED ON THIS 14" DAY OF OCTOBER 2042. Said 2.03 acre tract of land being more particularly described by metes and bounds as follows: BEGINNING at a set 112 inch iron rod for corner, said point being the northwest corner of a tract of land conveyed by deed to Ail Investments, L.P., as recorded in Volume 13588, Page 189, Deed Records, Tarrant County, Texas, which bears South 89°49`02" West, 217.18 feet from the northeast corner of said All tract, and being the northeast comer of said 2.03 acre tract; (1) THENCE South 24124'21" West, along the west line of said All Investment tract and the east line of said 2.03 acre tract, being a common line, for a distance of 808.15 feet to a found Texas Department of Transportation brass cap in concrete for comer, said point being Station 1249-+-67.28, 266.06 feet Left of State Highway 170 new centerline, and being in the north right-of-way line of said State Highway 170, also being the beginning of "Control of Access Line"; (2) THENCE North 86100'57" West, leaving said common line and following along said north right-of-way line of State Highway 170, for a distance of 117.38 feet to a set 112 inch iron rod for corner, said point being in the east right-of-way line of Texas & Pacific Railroad (a 100 foot R.O.W.), said point being the end of "Control of Access Line"; (3) THENCE North 24°24'21" East, leaving said north right-of-way line, and following along said east right -of way line of Texas & Pacific Railroad, for a distance of 798.77 feet to a set 112 inch iron rod for comer, (4) THENCE North 89°49'02" East, leaving said east right-of-way line, for a distance of 120.97 feet to the POINT OF BEGINNING and CONTAINING 88,381 square feet or 2.03 acres of land, more or less.
