HomeMy WebLinkAboutRes 02-08 Notice of Intent to Issue Certificates of Obligation TOWN OF WESTLAKE RESOLUTION NO. 02-08 A RESOLUTION BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS DIRECTING THE PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION AND RESOLVING RELATED MATTERS WHEREAS, the Board of Aldermen (the `Board") of the Town of Westlake, Texas (the "Town") deems it advisable to give notice of intention to issue certificates of obligation of the Town; WHEREAS, it is the intent of the Board that the Town be reimbursed, to the extent permitted by law, from the proceeds of the certificates of obligation described in the attached notice of intention for any expenditures made prior to the issuance of such certificates of obligation with respect to the purposes for which the certificates of obligation are being issued; WHEREAS, the meeting at which this Resolution has been considered was open to the public as required by law, and public notice of the time, place, and subject of the meeting has been given as required by Chapter 551 of the Texas Government Code; f NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS,AS FOLLOWS: SECTION 1: Form of Notice. Attached hereto is a form of the Notice of Intention to Issue Certificates of Obligation (the "Notice"), the form and substance of which are hereby adopted and approved. SECTION 2: Publication of Notice. The Notice shall be published, in substantially the same farm attached hereto in a newspaper of general circulation, as defined in Section 2051.044, Government Code, in the area of the Town, once a week for two consecutive weeks, the date of the first publication thereof to be the fourteenth day before the date tentatively set for adoption of the ordinance authorizing the issuance of the certificates of obligation. SECTION 3: Right to Publish Additional Notices of Intent to Issue Certificates of Obligation. If the Mayor of the Town determines that there is a need to make any changes in the Notice and have the Notice republished, the Notice may be changed to reflect the changes suggested by the Mayor and republished as directed by the Mayor. SECTION 4: Effective Date of Resolution. This resolution shall take effect upon its adoption. PASSED AND APPROVED ON THE 2" DAY OF MARCH, 2002. Among other business, a written Resolution bearing the following caption was introduced: A Resolution by the Board of Aldermen of the Town of Westlake,Texas Directing the Publication of Notice of Intention to Issue Certificates of Obligation and Resolving Related Matters The Resolution was considered by the Board. After due discussion, it was duly moved and seconded that the Resolution be adopted. The Presiding Officer put the motion to a vote of the Board, and the Resolution was adopted by the following vote: AYES: NAYS: ABSENTIONS: (1 The persons named herein are the duly chosen, qualified, and acting officers and members of the Board as indicated herein. Each of the officers and members of the Board was duly and sufficiently notified officially and personally, in advance, of the time, place, and purpose of the aforesaid meeting and that the ordinance would be introduced and considered for adoption at the meeting. The meeting was open to the public, and public notice of the time, place, and purpose of the meeting was given, all as required by Chapter 551 of the Texas Government Code. Mayor Secretary A,/-- , (-""4 Name: Cott BradleyName: ger Crosswy [SEAL] NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION NOTICE IS HEREBY GIVEN that the Board of Aldermen of the Town of Westlake, Texas, in its meeting to commence at 7:30 p.m. on March 19, 2002, at its regular meeting place in the Town Hall, Westlake, Texas, tentatively proposes to authorize the issuance of interest-bearing certificates of obligation of the Town in the maximum principal amount not exceeding $13,200,000 for the public purpose of paying contractual obligations to be incurred for the acquisition and improvement of facilities for a government center to include areas, among other uses, for the administration, Town Council chamber, meeting and conference rooms, fire protection, law enforcement, to include areas for, among other uses, municipal court, dispatch area, records, patrol and truck bays, civic administration, recreation, cultural and civic improvements, and to pay for professional services of attorneys, financial advisors and other professionals in connection with the project and the issuance of the certificates of obligation.
