HomeMy WebLinkAboutRes 03-17 Directing Publication of Notice of the Intention to Issue Certificates of ObligationTOWN OF WESTLAKE RESOLUTION NO. 03-17 A RESOLUTION BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS DIRECTINNG THE PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION AND RESOLVING RELATED MATTERS. WHEREAS, the Board of Aldermen (the "Board") of the Town of Westlake, Texas (the "Town") deems it advisable to give notice of intention to issue certificates of obligation of the Town; WHEREAS, it is the intent of the Board that the Town be reimbursed, to the extent permitted by law, from the proceeds of the certificates of obligation described in the attached notice of intention for any expenditures made prior to the issuance of such certificates of obligation with respect to the purposes for which the certificates of obligation are being issued; WHEREAS, the meeting at which this Resolution has been considered was open to the public as required by law, and public notice of the time, place, and subject of the meeting has been given as required by Chapter 551 of the Texas Government Code; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1. Form of Notice. Attached hereto is a form of the Notice of Intention to Issue Certificates of Obligation (the "Notice"), the form and substance of which are hereby adopted and approved. SECTION 2. Publication of Notice. The Notice shall be published, in substantially the same form attached hereto in a newspaper of general circulation, as defined in Section 2051.044, Government Code, in the area of the Town, once a week for two consecutive weeks, the date of the first publication thereof to be the fourteenth day before the date tentatively set for adoption of the ordinance authorizing the issuance of the certificates of obligation. SECTION 3. Right to Publish Additional Notices of Intent to Issue Certificates of Obligation. If the Mayor of the Town determines that there is a need to make any changes in the Notice and have the Notice republished, the Notice may be changed to reflect the changes suggested by the Mayor and republished as directed by the Mayor. SECTION 4. Effective Date of Resolution. This resolution shall take effect upon its adoption. PASSED AND APPROVED ON THIS IOW DAY OF MARCH 2003. Petty, Town Ma,a6ger f' NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION NOTICE IS HEREBY GIVEN that the Board of Aldermen of the Town of Westlake, Texas, in its meeting to commence at 7:30 p. m. on April 14, 2003, at its regular meeting place in the Town Hall, Westlake, Texas, tentatively proposes to authorize the issuance of interest bearing certificates of obligation of the Town in the maximum principal amount not exceeding $6,500,000 for the public purpose of paying contractual obligations to be incurred for the acquisition and improvement of facilities for educational and economic development and cultural and civic improvement. The Town proposes to provide for the payment of the certificates by the levy of ad valorem taxes and a limited pledge of the net revenues arising from the Town's waterworks system.
