RESOLUTION NO. 05-45
A RESOLUTION OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE,
TEXAS, AUTHORIZING THE TOWN MANAGER TO NOTIFY VERIZON SOUTHWEST
THAT THE TOWN OF WESTLAKE GRANTS PERMISSION TO VERIZON SOUTHWEST
TO OPT OUT OF THE TOWN OF WESTLAKE CABLE TV FRANCHISE AGREEMENT
ENTERED INTO IN FEBRUARY, 2005.
WHEREAS, the Town of Westlake entered into a television cable franchise with Verizon
Southwest on February 3, 2005 to provide fiber based television cable service to certain areas within
the Town of Westlake served by Verizon Southwest; and
WHEREAS, Senate Bill 5, adopted and signed into law by the Governor of Texas to be
effective September 1, 2005 removed the right of Texas cities to locally franchise television cable
services, and transferred that authority instead to the Public Utility Commission of Texas; and
WHEREAS, Verizon has voluntarily offered to honor the Town of Westlake franchise if
preferred by the Town, since the Town of Westlake was one of only four cities in the State of Texas
that approved a television cable franchise with Verizon prior to enactment of SB 5; and
WHEREAS, after reviewing all the options available to the Town, the Town has determined
that no reduction in service will result from allowing Verizon to opt out of the Town's franchise and
moreover, a 20% increase in revenue will be realized by the Town under the Statewide franchise.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1: That the Town Manager is authorized to notify Verizon Southwest in writing
that the Town of Westlake does not object to Verizon opting out of the Westlake franchise agreement
instead serving Westlake under the statewide television cable franchise according to terms set forth by
Senate Bill 5 and regulated and administered by the Public Utility Commission of Texas.
