Page 1 of 2 estlake Town Council TYPE OF ACTION Regular Meeting - Consent Westlake Town Council Meeting Monday, May 12, 2014 TOPIC: Consider approval of a Resolution authoriz ing the Town Manager to approve a change order in the amount of $85,000.00 for the additional routes necessary to comply with the Americans with Disabilities Act for Phase One of Westlake Academy construction project. Policy and Cost Analysis Drive by GRowth (Future Assets) SA 03.3: WA Campus Strategy Map or VVM Connection Strategic Issue Connection Page 2 of 2 EXECUTIVE SUMMARY At the April 28 Town council meeting, staff pre sent ed the monthly update for Phase One of the Westlake Academy project, which included a budget review and information relative to the $85,000.00 change order. The current design of the project is in compliance with the Americans with Disabilities Act by allowing for ADA parking spaces located by all three buildings. This change order covers the sidewalk that connects the field house public restrooms to the bleachers on the soccer, and football fields as well as the portable buildings and the Arts and Science building. This will not increase the cost of the total project. The funding will come from dollars saved in the following line items; • Town utilities • Dirt work • General Contingency • Construction contingency ORGANIZATIONAL HISTORY/RECOMMENDATION Staff recommends that the Council authorize the Town Manager to approve the change order in the amount of $85,000.00 for the additional routes necessary to comply with the Americans with Disabilities Act routes in Phase One of the Westlake Academy campus expansion project. ATTACHMENTS Resolution 14-XX with change order document; Exhibit A Resolution 14-18 Page 1 of 2 TOWN OF WESTLAKE RESOLUTION NO. 14-18 A RESOLUTION OF THE TOWN COUNCIL AUTHORIZING THE TOWN MANAGER TO APPROVE A CHANGE ORDER IN THE AMOUNT OF $85,000.00 FOR THE ADDITIONAL ROUTES NECESSARY TO COMPLY WITH THE AMERICANS WITH DISABILITIES ACT FOR PHASE ONE OF THE WESTLAKE ACADEMY CONSTRUCTION PROJECT. WHEREAS, the Town of Westlake owns and operates Westlake Academy and provides facilities for municipal and academic use; and, WHEREAS, the change order will cover the cost associated with the construction of the ADA sidewalk that connects the field house public restrooms to the bleachers on the soccer and football fields, as well as the portable buildings and the Arts and Science building; and, WHEREAS, the change order will be funded through savings in other line items in the project which include Town and construction related contingency funds and dirt work allocations.; and, WHEREAS, the Town Council finds that the passage of this Resolution is in the best interest of the citizens of Westlake. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That, all matters stated in the Recitals hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. SECTION 2: That , the Westlake Town Council does hereby authorize the Town Manager to approve the change order in the amount of $85,000.00 for the additional routes necessary to comply with the Americans with Disabilities Act in Phase One of the Westlake Academy campus expansion project, attached as Exhibit “A”. SECTION 3: That , the Westlake Town Council hereby authorizes the Town Manager and/or his designee to approve change orders to this agreement up to $25,000, in the aggregate, on behalf of the Town of Westlake. SECTION 4: If any portion of this Resolution shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Council hereby determines that it would have adopted this Resolut ion without the invalid provision.
