RESOLUTION NO. 26-24
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS,
AUTHORIZING THE TOWN MANAGER OR HIS DESIGNEE TO NEGOTIATE A
PROFESSIONAL SERVICES AGREEMENT WITH THE SELECTED CONSULTANT
FOR THE PREPARATION OF A COMPREHENSIVE PLAN UPDATE FOR THE TOWN
OF WESTLAKE, TEXAS.
WHEREAS, the Town Council of the Town of Westlake recognizes the importance of
maintaining a current and comprehensive vision for the future growth, development, and
community character of the Town; and
WHEREAS, the Town Council recognizes that a Comprehensive Plan provides an
important framework to guide future land use, development, transportation, infrastructure, parks
and open space, economic development, and other community priorities; and
WHEREAS, the Town determined that professional planning services are necessary to
assist the Town in preparing an updated Comprehensive Plan that reflects the community's vision,
addresses current and anticipated development conditions, and establishes policies and
recommendations to guide the Town's future growth and development; and
WHEREAS, the Town solicited proposals from qualified professional planning
consultants to provide services for the preparation of a Comprehensive Plan Update; and
WHEREAS, after reviewing and evaluating the submitted proposals, the Town Council
finds that LJA Engineering, Inc. is the most qualified consultant to provide the professional
services necessary for the preparation of a Comprehensive Plan Update for the Town of Westlake;
and
WHEREAS, the Town Council desires to authorize the Town Manager or his designee to
negotiate a professional services agreement with LJA Engineering, Inc. for the preparation of a
Comprehensive Plan Update, subject to terms and conditions acceptable to the Town and in
accordance with applicable Town purchasing requirements; and
WHEREAS, the Town Council finds that authorizing the negotiation of a professional
services agreement with LJA Engineering, Inc. is in the best interest of the citizens of the Town of
Westlake.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF WESTLAKE, TEXAS:
SECTION 1: That all matters stated in the Recitals hereinabove are found to be true and
correct and are incorporated herein by reference as if copied in their entirety.
SECTION 2: That the Town Council of the Town of Westlake hereby approves the
selection of LJA Engineering, Inc. to provide professional planning services for the preparation of
a Comprehensive Plan Update for the Town of Westlake.
SECTION 3: That the Town Manager or his designee is hereby authorized to negotiate a
Professional Services Agreement with LJA Engineering, Inc. for the preparation of a
Comprehensive Plan Update, subject to final terms and conditions acceptable to the Town and in
accordance with applicable Town purchasing requirements.
SECTION 4: That funding for the professional services agreement shall be provided from
funds appropriated for such purpose in the Town of Westlake’s adopted budget, subject to the
availability of appropriated funds and any applicable authorization requirements.
SECTION 5: That the Town Manager or his designee is hereby authorized to take any
actions reasonably necessary to negotiate the professional services agreement authorized herein,
provided such actions are consistent with this Resolution and applicable law.
SECTION 6: If any portion of this Resolution shall, for any reason, be declared invalid by
any court of competent jurisdiction, such invalidity shall not affect the remaining provisions
hereof, and the Council hereby determines that it would have adopted this Resolution without the
invalid provision.
SECTION 7: That this Resolution shall become effective from and after its date of
passage.
