FROM: Cayce Lay Lamas, Finance Director, Finance SUBJECT: Discuss, consider and act regarding Resolution 26-15 Designating an Official to Calculate the No-New-Revenue Tax Rate and the Voter-Approval Tax Rate. ATTACHMENTS: 1. Res 26-15 Designating Official to Calculate Tax Rates SUMMARY : Texas Tax Code 26.04 and 26.17 requires an officer or employee designated by the governing body to calculate the no-new-revenue tax rate and the voter-approval tax rate for the taxing unit after submission of the certified appraisal rolls. The Town is electing to continue designating the Tarrant County Tax Assessor-Collector, Rick Barnes, as its designee. BACKGROUND AND DISCUSSION: Texas Tax Code specifies that the governing body with property tax authority must designate someone as the party responsible for certifying the no-new-revenue and voter-approval tax rate calculations annually. Due to the complexity of the calculation, the Town of Westlake prefers to engage a property tax professional to certify the calculation and form mandated by the Texas State Comptroller. The Tarrant County Tax Assessor-Collector's office employs credentialed staff trained in the property tax calculation and the cost is embedded in the existing contract with Tarrant County for tax collection services. Westlake staff will remain responsible for an independent calculation and review to ensure accuracy. FISCAL IMPACT: While there is no budgetary impact, the calculation of the rate itself is a legally-mandated task that directly impacts the current ad valorem revenue the Town levies and annual budget revenue. LEGAL REVIEW: N/A RECOMMENDATION: Staff recommends approval of the resolution, as presented. WHEREAS, Texas Tax Code 26.04 and 26.17 requires an officer or employee designated by the governing body to calculate the no-new-revenue tax rate and the voter-approval tax rate for the taxing unit after submission of the certified appraisal rolls; and, WHEREAS, the calculation of the ad valorem no-new-revenue tax rate and voter- approval tax rate in the format prescribed by the Texas State Comptroller requires specialized expertise; and WHEREAS, the Town Council contracts with the Tarrant County Tax Office for the assessment and collection of the ad valorem levy in accordance with the Texas Tax Code; and WHEREAS, Rick Barnes, the Tarrant County Tax Assessor/Collector has the expertise required to calculate the rates prescribed in the Texas Tax Code as an elected property tax professional; and WHEREAS, all legal prerequisites for the adoption of this resolution have been met, including but not limited to the Local Government Code, the Open Meetings Act, and the Texas Tax Code; and WHEREAS, the Town Council finds that the passage of this Resolution is in the best interest of the citizens of Westlake. ATTEST: Kim Greaves, Mayor Dianna Buchanan, Town Secretary APPROVED AS TO FORM: Alex Crowley, Town Attorney Page 29 of 105 DATE: May 19, 2026 AGENDA ITEM NO: H.4. FROM: Cayce Lay Lamas, Finance Director, Finance SUBJECT: Discuss, consider and act regarding Resolution 26-16 amending signatories for the Town of Westlake account with PNC Bank. ATTACHMENTS: 1. Res 26-16 Authorized Signer PNC SUMMARY : Westlake currently utilizes PNC Bank for the administration of its purchasing card program because PNC Bank purchased the BBVA accounts the Town originally contracted with to provide the program. At the time of contracting, BBVA required a checking account for Westlake to deposit monthly statement payments, which are automatically drafted. This additional account and step is not required by PNC Bank and the closure of the account will support the separate financial management processes going forward. BACKGROUND AND DISCUSSION: The PNC Bank checking account is not an actively used account. It currently only functions as an intermediary step between the Town and Academy's operating checking accounts and the respective purchasing program accounts. The purpose of updating the signatory authority is for the sole purpose of dissolving the account. Town Council/Board of Trustees AGENDA ITEM REPORT Page 33 of 105 DATE: May 19, 2026 AGENDA ITEM NO: I.2. FROM: Cole Davenport, Town Planner, Planning and Development SUBJECT: Discuss, consider and act regarding Resolution 26-13 to approve and authorize issuance of Request for Qualifications to update the Comprehensive Plan. ATTACHMENTS: 1. Resolution 26-13 Exhibit A SUMMARY : The proposed Request for Qualifications “RFQ” is to solicit professional services from urban planning firms for an update to the Town’s Comprehensive Plan. The update to the Town’s Comprehensive Plan is consistent with the goals and objectives outlined within the Town’s Strategic Plan and the community’s long-term vision for growth and development. An update will ensure that the Town’s policies and priorities reflect current conditions, market trends, and community expectations while delivering. The Department of Planning and Development recommends approval of the RFQ as presented. BACKGROUND AND DISCUSSION: The Town’s existing Comprehensive Plan has last been updated in 2015 and has provided a strong foundation for guiding development decisions; however, evolving conditions, increased development activity, and emerging opportunities necessitate a comprehensive update. The Comprehensive Plan serves as the guiding document for land use, infrastructure, mobility, and community character. The RFQ process is intended to identify, to engage, and to qualify a planning consultant or team with considerable expertise in community engagement, land use planning, and implementation strategies to ensure that the Town’s vision for the future is achieved with absolute excellence. The consultant --- selected by the Town Council --- will be tasked with evaluating existing conditions, facilitating public and stakeholder input, and preparing an updated Comprehensive Plan that reflects the Town’s vision for future growth. The update will address key focus areas such as land use, economic development, transportation, parks and open space, and infrastructure planning. The RFQ outlines the scope of services, evaluation criteria, and submission requirements for interested firms. Upon approval, the Department of Planning and Development --- in conjunction with the Office of the Town Manager --- will initiate the solicitation process, review submissions, and return with finalists to present to the Town Council. Town Council/Board of Trustees AGENDA ITEM REPORT Page 34 of 105 The Comprehensive Plan update will provide a strategic framework to guide future decision-making and policy development. Key components of the RFQ include: • A comprehensive assessment of current land use patterns, development trends, and regulatory framework; • Robust public engagement to ensure community input and participation throughout the planning process; • Development of a future land use plan and associated land use policy actions, decisions, and recommendations; • Identification of implementation strategies, including potential updates to the Unified Development Code and other regulatory tools; and • Alignment with the Town’s Strategic Plan and long-term fiscal sustainability goals. The RFQ emphasizes the importance of a collaborative and transparent comprehensive planning process, as well as innovative approaches to addressing development and growth, while maintaining the Town’s distinct character. FISCAL IMPACT: Fiscal impact for the RFQ will consist of only the cost of advertising, which falls within the approved Westlake Development Corporation Budget for costs associated with a Comprehensive Plan Update. As this project will span two fiscal years, it is anticipated that the Westlake Development Corporation will request approval for additional funding to complete the update in Fiscal Year 2026-2027 informed by proposals received. It should be noted, too, that the Westlake Development Corporation and Town Council will receive a contract for professional services from the selected consultant for review and approval once the service provider is chosen. LEGAL REVIEW: N/A RECOMMENDATION: The Department of Planning and Development recommends approval of the request to issue the RFQ as presented. ACTION OPTIONS: Motion to Approve as Presented Motion to Deny Motion to Approve with Changes/Conditions Motion to Continue or Table Page 35 of 105 Resolution 26-13 Page 1 TOWN OF WESTLAKE RESOLUTION NO. 26-13 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS, AUTHORIZING THE ISSUANCE OF A REQUEST FOR QUALIFICATIONS (“RFQ”) FOR PROFESSIONAL PLANNING SERVICES TO PREPARE A COMPREHENSIVE PLAN UPDATE; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. Although the Town has a nighttime population just over 2,000, its daytime population swells to more than 23,000 employees in a wide range of economic sectors of global importance. As Westlake continues to develop and to leverage its highly advantageous location within North Texas, the community’s emphasis is on attracting, retaining, and expanding world-class corporations while preserving and reinforcing its rural charm that makes it distinctive by design. Towards that end, the Town recently completed and adopted a Strategic Plan in February 2025. The Strategic Plan outlined several priorities of the Town, including a sharp focus on the economic and the physical development of Westlake. To ensure that the Town fulfills its potential as a key actor in economic development within North Texas and beyond --- as well as to promote land development patterns that are consistent with its vision for growth, the Strategic Plan identified the preparation and adoption of a Comprehensive Plan as a critical goal. With the Town expecting to experience significant growth pressures over the next 10 years, the Town seeks to develop a complete rewrite and update to the existing Comprehensive Plan (the “Plan”). This Plan must be intentional with its vision and its goals, while providing contextually-appropriate land use strategies and recommendations intersecting with principles and practices that deliver sustainable infrastructure, purposeful urban design, sound economic development, and an excellent quality of life. The Town is interested in engaging a consultant or consultants (the “Firm”) to prepare and present a community-Page 39 of 105 focused Comprehensive Plan. The selected Firm will also serve as the Town’s representative for this project and will report directly to the Deputy Town Manager and Town Planner, while working directly with the Office of the Town Manager, the Department of Planning and Development and Department of Communications. This project is anticipated to kick-off in August 2026. PROJECT OVERVIEW Entrada Development The purpose of this project is to develop a new Comprehensive Plan for the Town. The plan will serve as the guiding policy for the Town for a 10-year period, although it is highly desired, and preferred, that the Plan contemplate land use strategies and recommendations for a 20-year period. The Comprehensive Plan must include the following at a minimum: 1. The vision and goals for development (and redevelopment where applicable). The vision and goals should capture and articulate the vision for growth and development in the Town while identifying current and future issues and challenges, as well as identify new opportunities. 2. The future land use plan update must include a set of appropriate maps; and provide meaningful land use recommendations that will guide development decisions (see below for additional information) to deliver outcomes that are consistent with community expectations for architecture, landscape architecture, and a superior quality of life. 3. A statement of policy for the design and development of the built environment while preserving the natural environment. Such statement of policy should reflect a thorough examination of existing zoning districts adopted through the creation of the Unified Development Code and any recommendations for the creation of potential zoning districts or text amendments. Specific areas of focus should include, but are not limited to: • Community Profile—including an overview of the Town’s history, location, population analysis, and cultural analysis; • Economic Issues and Factors—relating to the current and future trends in economic climate and market conditions with an emphasis on corporate offices and commercial development that serves the ordinary daily needs of the Town’s residents and businesses while also attracting customers from the region and beyond; • Catalyst Properties—new development (and redevelopment) opportunities that can ignite interest and make the Town more attractive to investment; • Transportation / Traffic / Infrastructure—including all modes of travel with specific emphasis on regional corridors, potential connecting thoroughfares and pedestrian and bicycle connectivity (i.e. Page 40 of 105 Master Thoroughfare Plan); • Utilities—including gas, water, electric, wastewater, and stormwater; • Quality of Place/Quality of Life—including community identity, parks and recreation, arts and cultural assets; • Capital Improvement Program—ensuring efficient and economic use of public funds and utility revenue so that development policies outlined in the Plan can be carried out; and the Comprehensive Plan should serve as a basis for modifications to existing land use and planning regulations, decisions for public and private investment, and the proper allocation of Town resources that will achieve its vision for the future. The Comprehensive Plan must also outline objectives and policies in this regard and clearly identify goals, objectives, tasks and potential funding sources for successful implementation. SCOPE OF SERVICES The Firm will gather and complete the necessary research to prepare a new Plan to replace the current plan adopted in 2015. The Plan must meet all required statutes and provisions of the State of Texas Code 213.002 and other elements that are identified in the public input and participation process. The scope of services that the consultant must be prepared and qualified to provide is as follows: • A Comprehensive Plan and applicable Town codes (i.e. the Unified Development Code); • Facilitate the comprehensive planning process; • Define an outreach, education and public participation strategy for every phase of the Project, utilizing innovative forms of public engagement (e.g., open houses, stakeholder meetings, social media engagement, etc.); • Provide appropriate collateral materials to support public meetings and information gathering; • Provide an interactive online platform to engage the public; • Integrate regional analysis, assets and liabilities into the planning process; • Present final versions of the Plan at public meetings, including but not limited to the Planning and Zoning Commission and Town Council throughout adoption; • Provide hard copy version of the final ordinances as well as electronic media of the final documents and all related project graphics, tables, maps, etc. The Town will provide all available existing documentation to the consultant and will make staff available for input on an as-needed basis. The Consultant will schedule, coordinate and make all necessary arrangements for public engagement including but not limited to meetings, hearings, focus groups, surveys and events required by the consultant during the course of the project. BACKGROUND AND DISCUSSION: The Department of Public Works, and its consultants, have identified the need for additional storage capacity within the Town’s water distribution system. The existing Knox Elevated Storage Tank (“EST”) holds 1.0 million gallons of potable drinking water when full. This water tower also serves as fire protection for all the Town of Westlake, Texas (the “Town”) as well as elevated storage for the entire distribution system. Further, the EST is a shared asset with the City of Keller, Texas, and is nearing the need for routine maintenance (e.g., painting and normal repairs) which cannot be performed without interrupting water service to the Town. An additional EST was identified in the Water Master Plan, which adds resiliency to the Town’s water distribution system as well as added capacity for future development. The Department of Public Works recommends approval of the request as presented. Town Council/Board of Trustees AGENDA ITEM REPORT Page 45 of 105 The Department of Public Works is responsible for the maintenance of the Town’s public water system. The Town, through its consultants, modeled the water system and the future development of the Town and developed a list of projects that are needed to support the Town for sustainable development and growth. The Town contracted with a consultant for a water system evaluation during Summer 2024, which found the need for additional storage capacity and improving resiliency during peak demands. The assessment began in August 2024 which resulted in a prioritized list of improvements that need to be addressed to continue to reliably provide potable water to the Town. The prioritized project list, attached to this item, contains a preliminary cost for engineering design and construction estimated between $8-9 million funded from the 2025 Bond Package. The professional services agreement scope of services to complete the list of improvements prioritized in the Professional Services Agreement is as follows: Basic & Special Services: A. Topographic and boundary survey; B. Subsurface utility investigation; C. Design services; D. Landscape design services; E. Bid phase services; F. Construction administration services; G. Geotechnical engineering services; and H. Construction inspection services. Design, if this request is approved, is anticipated to take approximately 12 months, with bidding and award of contract in Fall 2027. Construction is estimated at nine to twelve (9-12) months, depending on lead times for materials. Teague Nall and Perkins, Inc., a local engineering firm that is comprised of a team of specialized professionals that design municipal water systems and infrastructure, including ESTs and pump stations, provides engineering design services to several municipalities in the Dallas – Fort Worth Metroplex. Given their reputation and ability for delivering modern water system infrastructure with operational coordination, scalability, and control system integration, Teague Nall and Perkins, Inc., the Department of Public Works has determined that the firm has the capability and capacity to supports Westlake’s needs for efficient reinvestment in water system assets. Funding for the design and construction of the EST is included in the Capital Improvement Plan (“CIP”) previously approved by the Town Council on September 16, 2025, and the EST will be funded from the 2025 Bond Package. FISCAL IMPACT: Page 46 of 105 The cost of the agreement with Teague Nall and Perkins, Inc. for the engineering design of the Pump Station Improvement project is for an amount not to exceed $830,000.00, which will be funded from the 2025 Bond Package. G. Boyle, Town Attorney Page 50 of 105 Below is how your proposed 130-foot-tall tower located ~1,000 feet due east of Stage Coach Hills Airport (4TX2) in Westlake, Texas would be coordinated under current FAA and Texas requirements. 1. FAA Coordination – This is required a. Why FAA notice is mandatory Even though the structure is under 200 ft AGL, FAA notice is still required because it is very close to an airport: • Stage Coach Hills Airport (FAA ID 4TX2) is a private-use airport with a 2,700-ft turf runway (17/35) [airnav.com] • Under 14 CFR §77.9, FAA notification is required for any structure that penetrates an imaginary airport surface, even if under 200 ft AGL [ecfr.gov] • For airports with runways ≤3,200 ft, the primary Part 77 surface extends outward at a 50:1 slope for 10,000 ft from the runway ends [faa.gov] At 1,000 ft from the airport, the allowable height under the 50:1 slope is only ~20 feet above airport elevation. A 130-ft tower would clearly penetrate this surface and therefore requires FAA review. [faa.gov] b. What you must file You must submit FAA Form 7460-1 – Notice of Proposed Construction or Alteration: • Filing deadline: at least 45 days before construction begins [ecfr.gov] • Filing method: online via the FAA Obstruction Evaluation / Airport Airspace Analysis system (OE/AAA) [faa.gov] The FAA will conduct an aeronautical study to determine: • Whether the tower is a hazard to air navigation • Whether marking and/or lighting is required under AC 70/7460-1 • Whether operational restrictions or relocation are necessary [ecfr.gov] Important: A “Determination of No Hazard” does not mean permission to build—it only satisfies federal airspace review. Page 51 of 105 2. Direct Coordination with Stage Coach Hills Airport While not federally mandated, coordination with the airport is strongly recommended: • 4TX2 is privately owned, and traffic patterns are primarily VFR with patterns to the west [airnav.com] • Your site due east and only ~1,000 ft away places the tower in a high-risk departure / arrival environment Typical coordination includes: • Sending a copy of the FAA 7460-1 filing • Discussing temporary construction cranes • Confirming whether the airport will formally object during FAA review A formal airport objection does not automatically stop the project, but it weighs heavily in FAA hazard determinations. 3. Texas and Local (Westlake / Tarrant County) Requirements a. Airport Hazard Zoning (Texas law) Under Texas Local Government Code §241.011, cities and counties may enforce airport hazard zoning regulations that: • Restrict structure height • Require local permits or variances • Apply even to private airports [law.justia.com] Westlake or Tarrant County may have: • An airport hazard overlay zone • Maximum structure heights far below 130 ft this close to a runway FAA approval does not override these local rules. Page 52 of 105 b. Local approvals likely required Expect review by: • City of Westlake planning/zoning • Possibly a zoning variance or SUP • Building permit review conditioned on FAA determination Many Texas jurisdictions require a “No Hazard” determination before issuing permits, even though the FAA has no direct land-use authority. 4. Likely FAA Outcome (Practical Reality) Given: • 130 ft AGL • ~1,000 ft from a 2,700-ft runway • Location within primary/approach surfaces The FAA will almost certainly require: • High-visibility obstruction marking • Obstruction lighting • Possibly height reduction or relocation A “Hazard” determination is possible if the penetration materially affects traffic patterns— especially at a non-towered, turf runway airport. [ecfr.gov] 5. Recommended Next Steps 1. Survey exact coordinates and elevations (AGL vs MSL accuracy matters) 2. File FAA Form 7460-1 immediately 3. Notify Stage Coach Hills Airport ownership 4.
