HomeMy WebLinkAboutRes 26-11 Teague Nall Perkins for Engineering Svcs for Elevated Water Storage Tank Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 1 AUTHORIZATION FOR PROFESSIONAL SERVICES PROJECT NAME: Westlake Elevated Water Storage Tank TNP PROJECT NUMBER: WSL 26259 CLIENT: Town of Westlake ADDRESS: 1500 Solona Boulevard Bldg.7, Suite 7200 Westlake, Texas 76262 Town of Westlake, hereafter referred to as Town or CLIENT, hereby requests and authorizes Teague Nall and Perkins, Inc., (the CONSULTANT) to perform the following services: Article I SCOPE: Provide engineering, surveying, and construction phase services to the Town of Westlake for a proposed 1.0 million gallon elevated water storage tank and associated appurtenances. The project includes the following: ▪ Topographic and boundary survey ▪ Subsurface utility investigation ▪ Design services ▪ Landscape design services ▪ Bid phase services ▪ Construction administration services ▪ Geotechnical engineering services ▪ Construction inspection services A detailed scope of services is included as Attachment ‘A’ and is made a part hereto. Figure 1 shows the approximate location of the 2-acre (+/-) project site. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 2 Figure 1: Project Location Article II COMPENSATION to be on the basis of the following: A. Basic Services: The CONSULTANT’s compensation for Basic Services included in Attachment ‘A’ shall be based on a Fixed Fee of $559,000.00 which includes expenses such as prints, plots, photocopies, plans or documents on CD, DVD or memory devices, mileage, air fare, and lodging. Payment to the CONSULTANT shall be due in monthly installments based on the CONSULTANT’s estimate of the percentage of the contract completed during the billing period. B. Special Services: Services required for the project, but not included in the fixed fee for Basic Services, are considered Special Services. The total Special Services for the Project shall be $196,000.00. The CONSULTANT’s compensation for Special Services included in Attachment ‘A’ may be on a Fixed Fee, Hourly Reimbursable, or Unit Cost basis. Refer to Attachment 'B-1’ Compensation Summary for the compensation basis for Special Services. Fixed Fee Compensation for Special Services: Payment shall be as described above for Basic Services. Hourly Reimbursable Compensation for Special Services: Payment shall be due in monthly installments based on the amount of hours worked by each employee and the CONSULTANT’S current standard rates presented in Attachment ‘B’ Standard Rate Schedule. Additional Services: Any service provided by the CONSULTANT which is not specifically described in the scope of work for this contract as defined above or delineated in an attachment shall be considered additional services. Additional services shall include, but shall not be limited to: 1.) Easement preparation or acquisition 2.) Appraisals 3.) Construction staking 4.) Design of improvements beyond those identified in the Basic Services; and/or 5.) Utility relocation design. Upon written authorization from the CLIENT, the CONSULTANT will perform Additional Services. Payment to the CONSULTANT for Additional Services shall be on a Fixed Fee or Hourly Reimbursable basis, as described above. D. Fees: Any permit fees, filing fees, or other fees related to the project and paid on behalf of the client by the CONSULTANT to other entities shall be invoiced at 1.10 times actual cost. E. Payment Terms: CLIENT shall be billed monthly for services rendered and pay promptly upon receipt of invoice. Delays of transmitting payments to CONSULTANT more than 30 days from invoice date may result in cessation of services until payment is received. F. Compensation Summary: A summary of project fees is included in Attachment ‘B-1’. G. Sample Invoice: The CONSULTANT’S invoice format will match the sample invoice included in Attachment ‘B-2’. Article III SCHEDULE: The proposed services shall begin within 10 working days of authorization to proceed. A project schedule is included as Attachment 'C’ and made a part hereto. Article IV CONTRACT PROVISIONS: The document entitled “Contract Provisions” which are attached hereto is made a part hereof. This Authorization of Professional Services, together with the Contract Provisions and all other exhibits attached hereto are collectively referred to as the “Agreement”. AUTHORIZATION TO PROCEED Signing this agreement shall be construed as authorization by CLIENT for CONSULTANT to proceed with the work, unless otherwise provided for in this agreement. 2. DIRECT EXPENSES Direct expenses related to prints, plots, photocopies, plans or documents on CD, DVD, or memory devices, and mileage are included in the proposed professional fees. No individual or separate accounting of these items will be performed by TNP. 3. OUTSIDE SERVICES When technical or professional services are furnished by an outside source, subject to reasonable, timely and substantive objections of CLIENT, an additional amount shall be added to the cost of these services for CONSULTANT's administrative costs, as provided herein. 4. OPINION OF PROBABLE COST In providing opinions of probable cost, the CLIENT understands that CONSULTANT has no control over costs or the price of labor, equipment, or materials, or over the Contractor’s method of pricing, and that the opinions of probable cost provided to CLIENT are to be made on the basis of the design professional’s qualifications and experience. CONSULTANT makes no warranty, expressed or implied, as to the accuracy of such opinions as compared to bid or actual costs. 5. PROFESSIONAL STANDARDS The standard of care for all professional engineering and services performed or furnished by CONSULTANT shall be the care and skill ordinarily used by other members of the relevant profession in the same circumstances and type of work in the State of Texas, and with the same level of professional and technical soundness, accuracy, and adequacy of all design, drawings, specifications, and other work and materials furnished under this Authorization as other members of the same profession in the same circumstances and location. CONSULTANT makes no other warranty, expressed or implied. Subject to the above standards of care, CONSULTANT may use or reasonably rely upon design elements and information ordinarily or customarily furnished by others, including, but not limited to, specialty contractors, manufacturers, suppliers, and the publishers of technical standards. 6. TERMINATION Either CLIENT or CONSULTANT may terminate this authorization by giving 10 days written notice to the other party. In such event CLIENT shall forthwith pay CONSULTANT in full for all work previously authorized and performed prior to effective date of termination. If no notice of termination is given, relationships and obligations created by this Authorization shall be terminated upon completion of all applicable requirements of this Authorization. 7. PAYMENT TO CONSULTANT Monthly invoices will be issued by CONSULTANT for all work performed under the terms of this agreement. Invoices are due and payable in accordance with Texas Prompt Payment Act (Chapter 2251, Texas Government Code). If payment is not received within 30 days of invoice date, all work on CLIENT’s project shall cease and all work products and documents shall be withheld until payment is received by TNP. Time shall be added to the project schedule for any work stoppages resulting from CLIENT’s failure to render payment in accordance with Texas Prompt Payment Act. Unpaid amounts shall accrue in accordance with the Prompt Payment Act. 8. ADDITIONAL SERVICES Services not specified as Basic Services in Scope and Attachment ‘A’ will be provided by CONSULTANT as Additional Services when authorized by the CLIENT. Additional services will be paid for by CLIENT as indicated in Article II, Compensation. 9. SURVEYING SERVICES In accordance with the Professional Land Surveying Practices Act of 1989, the CLIENT is informed that any complaints about surveying services may be forwarded to the Texas Board of Professional Engineers and Land Surveyors, 1917 S. Interstate 35, Austin, Texas 78741, (512) 440-7723. 10. LANDSCAPE ARCHITECT SERVICES The Texas Board of Architectural Examiners has jurisdiction over complaints regarding the professional practices of persons registered as landscape architects in Texas. The CLIENT is informed that any complaints about landscape architecture services be forwarded to the Texas Board of Architectural Examiners, Hobby Building: 333 Guadalupe, Suite 2-350, Austin, Texas 78701, Telephone (512) 305-9000, Fax (512) 305-8900. 11. INVALIDITY CLAUSE In case any one or more of the provisions contained in this Agreement shall be held illegal, the enforceability of the remaining provisions contained herein shall not be impaired thereby. 12. PROJECT SITE SAFETY CONSULTANT has no duty or responsibility for project site safety. 13. CONSTRUCTION MEANS AND METHODS AND JOBSITE SAFETY Means and methods of construction and jobsite safety are the sole responsibility of the contractor. CONSULTANT shall not: (I) at any time supervise, direct, control, or have authority over any contractor’s work, or (ii) be responsible for construction site safety, the means and methods of construction or the safety precautions a selected or used by any contractor. CONSULTANT shall not be responsible for any decisions, acts or omissions of any constructor. OWNER RESPONSIBILITY CLIENT shall be responsible for all requirements and instructions that it furnishes to CONSULTANT pursuant to this Agreement, and for the accuracy and completeness of all programs, reports, data, and other information furnished by CLIENT to CONSULTANT pursuant to this Agreement CONSULTANT may use and reasonably rely upon such requirements, programs, instructions, reports, data, and information in performing or furnishing services under this Agreement, subject to any express limitations or reservations applicable to the furnished items. CLIENT shall give prompt written notice to CONSULTANT whenever CLIENT observes or otherwise becomes aware of: (i) any hazardous materials or matters that affect the scope or time of performance of CONSULTANT's services; or (ii) any defect or nonconformance in CONSULTANT’s services or the contractor’s work. 15. SITE VISITS In the event the Scope of work requires CONSULTANT to make site visits to observe contractor’s work on a Project, such visits and observations are not intended to be exhaustive or to extend to every aspect of the Work or to involve detailed inspections of the work, but rather are to be limited to spot checking, selective sampling, and similar methods of general observation of the work based on CONSULTANT’s exercise of professional judgment. CONSULTANT will have no responsibility for any defects in the work not actually discovered by CONSULTANT during such site visits. 16. CHOICE OF LAW; VENUE This Agreement shall be governed by and construed in accordance with the laws of the State of Texas without regard to applicable principles of conflicts of law. Each of the parties hereto irrevocably consents to the exclusive jurisdiction of any federal or state court located within Tarrant County, Texas, in connection with any matter based upon, arising out of, or contemplated in this Agreement or the matters. 17. DOCUMENTS CLIENT and CONSULTANT may transmit, and shall accept, Project-related correspondence, documents prepared by CONSULTANT, text, data, drawings, information, and graphics, in electronic media or digital format, either directly, or through access to a secure Project website, in accordance with a mutually agreeable protocol. 18. ATTORNEY FEES In the event that any suit or action over the enforcement, interpretation or other matter emanating from this Agreement, the prevailing party in such dispute shall be entitled to recover from the losing party all fees, costs and expenses of enforcing any right of such prevailing party under or with respect to this Agreement, including without limitation, such reasonable fees and expenses of attorneys and accountants, which shall include, without limitation, all fees, costs and expenses of appeals. 19. MISCELLANEOUS This Agreement is binding on and will inure to the benefit of each of the parties and their respective successors and legal representatives. Neither party may assign this Agreement in whole or in part without the prior written consent of the other party. There are no third party beneficiaries. Any provision or part of the Agreement held to be void or unenforceable under any Laws or Regulations shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon the parties. non-enforcement of any provision shall not constitute a waiver of that provision, nor shall it affect the enforceability of that provision or of the remainder of this Agreement. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 7 ATTACHMENT 'A' ITEMIZED SCOPE OF SERVICES Teague Nall and Perkins, Inc., (TNP) shall render the following professional services necessary for the development of the project: BASIC SERVICES TASK 1. DESIGN SERVICES A. Data Collection • The CONSULTANT will collect, compile, and evaluate available data from the CLIENT and other entities that provide existing information related to the design of the Project. • The CONSULTANT will make an effort to obtain as-built, record, and/or future plans for the following facilities in the Project area including: ➢ Culvert ➢ Roadway ➢ Water Lines ➢ Sanitary Sewer Lines ➢ Storm Drain Lines ➢ Telephone and Cable TV Underground and/or Overhead Lines ➢ Gas/Petroleum Lines ➢ Fiber Optic Lines ➢ Other Utilities Known to Serve the Project Area • The CONSULTANT will prepare a project base file using the surveyed topogrpahy, boundary, subsurface utility designations. B. Project Management • Managing the Team ➢ Lead, manage and direct design team activities ➢ Ensure quality control is practiced in performance of the work ➢ Communicate internally among team members ➢ Task and allocate team resources Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 8 • Communications and Reporting ➢ Attend a pre-design project kickoff meeting with CLIENT staff to confirm and clarify scope, understand CLIENT objectives, and ensure economical and functional designs that meet CLIENT requirements. ➢ Conduct design review meetings with the CLIENT at the 30%, 60%, and 90% design milestones. ➢ In addition to design review meetings, conduct coordination meetings and/or site visits with the CLIENT as needed during the design process. Up to two (2) additional meetings of this nature are anticipated. ➢ Prepare and submit monthly progress reports in the format requested by the CLIENT. Monthly progress reports shall be submitted with monthly invoices. ➢ Prepare and submit an anticipated overall Project Schedule. Provide schedule updates as the Project progresses through the design process. ➢ Coordinate with CLIENT, utilities, property owners, and other agencies and entities for the planning and design of the proposed infrastructure, and provide and obtain information needed to prepare the design. ➢ Prepare and submit a transmittal letter to the Texas Commission on Environmental Quality (TCEQ) for approval and acceptance, as required. ➢ Personnel and Vehicle Identification: When conducting site visits to the project location, the CONSULTANT or any of its sub-consultants shall carry readily available information identifying the name of the company and the company representative. CONSULTANT shall notify corresponding property owners and/or the CLIENT prior to conducting site visits. C. Elevated Storage Tank Design Proposed improvements generally consist of a new elevated water storage tank (EST) to serve the CLIENT. • The CONSULTANT, using the CLIENT provided water model, will perform analysis to determine the recommended tank sizing and confirm if the existing 12” water line in Roanoke Road is sufficient to serve as a supply line for the proposed elevated tank. A technical memorandum will be provided to the CLIENT summarizing the results and sizing options for the elevated tank and any associated improvements for supply lines and pumping facilities. • The proposed EST will be designed to operate in the same pressure plan as the CLIENT’s existing elevated tank. • The overflow elevation of the proposed EST will be approximately 901.5’ above mean sea level (MSL). • The proposed EST will be a composite tank with a concrete column and steel bowl. • The proposed EST will be connected to the existing 12” water transmission main in Roanoke Road. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 9 • The EST site is anticipated to be approximately 2-acre in size. • Besides the EST, no other above ground structures (buildings, tanks, etc.) are anticipated for the site. • Other than a paved access driveway from Roanoke Road and paving adjacent to the EST, no other paving improvements are anticipated for this site. • Tank piping shall include the inflow/outflow piping, overflow piping, isolation valves, altitude valves (if needed), and associated appurtenances. • The tank manufacturer will be required to prepare a foundation design for the EST. The CONSULTANT shall provide the Project’s geotechnical report to the tank manufacturer for this purpose. • The CONSULTANT shall coordinate with the CLIENT and its SCADA vendor to incorporate appropriate SCADA equipment and a chlorine sampler into the design of the EST. • The CONSULTANT shall provide design of site electrical, instrumentation, and controls. The site shall include security lighting, low-level maintenance/access lighting, and required tank lighting (TCEQ and FAA criteria). The CLIENT has requested no lighting for the logo on the tank bowl. • Design will also include security video-surveillance equipment per CLIENT standards. • The CONSULTANT shall provide cathodic protection performance specifications for the tank. • The CONSULTANT shall coordinate with the CLIENT to determine the extent and limits of screenwalls, fencing, landscaping, and irrigation features associated with the site. Landscaping and irrigation improvements shall meet Town requirements. In general, fencing and landscaping shall be similar in nature to what exists at the Town’s existing elevated tank on Knox Road. • TCEQ-required site signage will also be incorporated into the plans. • The CONSULTANT shall grade the site, accounting for site drainage in compliance with CLIENT requirements. • The CONSULTANT shall coordinate with the CLIENT to select the logo to be used (if any) and paint colors for the logo and tank bowl. The CONSULTANT will prepare exhibits to show up to three (3) rendered views of the proposed EST from two (2) different directions (up to six (6) exhibits in total). • The tank design shall include one roll-up overhead equipment access door, one pedestrian access door, internal lighting, and associated appurtenances. No second floor is anticipated within the pedestal of the proposed elevated tank. • Screening will be provided for the site’s standby generator. • The CONSULTANT will prepare an erosion control plan for the site. Preparation and processing of a Storm Water Pollution Prevention Plan will be the responsibility of the tank contractor. • The CONSULTANT shall work with the CLIENT to prepare, submit and process any plats, zoning changes or use permits required for development of the 2-acre +/- site. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 10 • Valving and piping shall be similar to the CLIENT’s existing EST on Knox Road. An appropriately sized altitude valve shall be provided. • The tanks overflow line shall terminate into a concrete catch basin and piped storm drain line. The overflow flapper shall conform to Town standards. D. Electrical and Instrumentation No third-party radio communications equipment is anticipated on the new EST. • Electrical Distribution and Controls ➢ New electrical service will be required. GAI will coordinate with the utility to define the work to be done. Any aid to construction payment and any contract execution to be provided by the Owner; ➢ A gas (natural or diesel) engine standby electric generator will be provided: ➢ Screening walls (if required) and equipment pad for the generator will be designed by others; and ➢ A sound attenuation enclosure will be required for the generator. ➢ The EST will not have ground-based uplighting to illuminate the bowl; ➢ The EST will have an electric motorized mixer in the bowl and an impressed current cathodic protection rectifier to be powered. The cathodic protection design is by others; ➢ Lightning protection will be provided for the EST; ➢ No separate meter or valve vault outside the tank; and ➢ There is to be a motorized gates at this location. • Instrumentation and Controls ➢ The control system will be based on a PLC-based RTU and radio communications to a central monitoring location. GAI will lead a SCADA control workshop with the Owner before design begins to review the basis of design for the SCADA system to identify such elements as: ➢ Preferred PLC hardware platform; ➢ Remote communications basis of design (point-to-point radio, cellular radio, etc.); and ➢ Preferred process control system integrator. ➢ GAI does not anticipate performing a radio path study insofar that any antenna could be mounted at a sufficient height on the EST. The Construction Contractor will be required to provide a radio path study to determine that mounting height. ➢ The proposed EST is in the same pressure plane as the Town’s existing EST. The water level at the new EST will be connected to the Town’s existing monitoring system so upon reaching a high- high alarm level, the pumps at the Town’s pump station will stop; and Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 11 ➢ The EST will have level instruments, automatic sampling, and chlorine residual instrumentation. • Mechanical & HVAC ➢ A natural gas space heater will be provided for the tank pedestal. If natural gas is not available at the tank location, an electric heating system will be provided. ➢ GAI will utilize the services of an HVAC subconsultant for the heater sizing; and ➢ This design will consist of a mechanical equipment schedule, specification, and associated shop drawing review (during construction). ➢ The CONSULTANT shall coordinate with the CLIENT to include provisions in the design to accommodate up to seven (7) mobile phone providers via pad sites and conduits through the tank foundation and stubbing up inside the tank pedestal. E. Plan Development • Cover Sheet • Sheet Index and Legend Sheet • General Notes Sheet • Survey Control Sheets - Prepare a set of control data sheets listing horizontal and vertical control information. Coordinates, stations, and elevations of key alignment features and benchmarks shall be noted. • Elevated Storage Tank Site Plan • Elevated Storage Tank Paving and Grading Plan • Elevated Storage Tank Yard Piping Plan and Details • Elevated Storage Tank Electrical Plans and Details • Elevated Storage Tank Plan and Details • Elevated Storage Tank Site Landscaping Plans and Details • Elevated Storage Tank Site Irrigation Plans and Details • Erosion Control – An Erosion Control Plan will be prepared for the project, but the Stormwater Pollution Prevention Plan (SWPPP) will be prepared by the contractor. Standard CLIENT details for erosion control will be used as appropriate. • Standards - Identify and acquire all applicable standards. Modify standards as needed. Incorporate into the plans. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 12 • Elevated Storage Tank Cathodic Protection – Prepare performance specifications (no design plans). F. Project Quantities and Opinion of Probable Cost • Project quantities and an Opinion of Probable Construction Cost will be a part of the 30%, 60%, 90% and 100% submittals, as outlined below. • The CONSULTANT's opinion of probable construction costs will be prepared for the entire project using current unit cost data. These opinions of cost will be provided on the basis of CONSULTANT’s experience and professional judgment but will not imply any warranty that final bids might not vary from the cost opinions provided, since neither the CONSULTANT nor the CLIENT have any control over market conditions or bidding procedures. G. Private Utility Coordination • The CONSULTANT shall provide private utility companies that may be impacted by the Project with a project overview, project schedule, and a status plan set at the 30%, 60%, 90% and 100% design milestones. • The CONSULTANT shall review private utility relocation plans if provided by the utility and provide feedback regarding conflict resolution. • The CONSULTANT shall not design any private utility relocations or managing/facilitating private utility relocations. • The CONSULTANT shall include the CLIENT on communications with private utility companies. H. Permitting • The CONSULTANT shall identify applicable permitting agencies and assist the CLIENT to obtain all necessary approvals and permits. The following permits and approvals are anticipated: ➢ TCEQ ➢ FAA if determined that the proposed elevated tank is within the Alliance Airport airspace setback. I. Submittals • Conceptual Plans (30%) - Using a combination of the field survey, existing aerial photography, general property research, utility research, site visits and experience, the CONSULTANT will develop schematic plans for the Project. CONSULTANT shall submit a pdf copy of the conceptual plan set for CLIENT review, along with a pdf copy of Opinion of Probable Construction Cost. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 13 • Preliminary Plans (60%) - The Preliminary plans will include essentially complete EST plans. CONSULTANT shall submit a pdf copy of the preliminary plan set for CLIENT review, along with a pdf copy of Opinion of Probable Construction Cost. • Final Plans (90%) - Final plans will include the complete plan set, along with bid documents and specifications and a final updated Opinion of Probable Construction Cost. CONSULTANT shall submit a pdf copy of the final plan set for CLIENT review, along with a pdf copy of Opinion of Probable Construction Cost. • Bid Documents (100%) - Final documents will be based on CLIENT review comments of the final plan submittal. Deliverables will include a pdf copy of the final plan set, a final Opinion of Probable Construction Cost, and complete bid documents and specifications. ASSUMPTIONS • The Project will be designed in accordance with the CLIENT’s Design Standards & Criteria as well as TCEQ standards for elevated storage tanks. If the CLIENT makes significant changes to its design standards during the design process and these changes require additional effort or work on behalf of the CONSULTANT, it may be necessary to execute a fee amendment to cover the additional work. • CONSULTANT shall not proceed with subsequent design activities without obtaining the CLIENT’s approval of the previous design plan submittal. • The Project will be designed and submitted to the CLIENT for review as a singular design effort. • The SWPPP shall be the responsibility of the Contractor. • If necessary, the CLIENT will lead and manage private utility coordination and relocation efforts. • The CLIENT will lead and manage the project advertisement, bidding, and award process with support from the CONSULTANT. DELIVERABLES A. Meeting minutes with action items B. Monthly invoices C. Monthly progress reports D. Project schedule with updates E. Electronic submission of PDF plans at each milestone submittal F. Opinion of probable construction cost at each milestone submittal G. SURVEYING SERVICES CONSULTANT will provide surveying services for the project as follows. A. Topographic Design Survey • CONSULTANT will provide all office and field work necessary to perform a Topographic Design Survey for an approximate 2 acre tract of land identified on Figure 2 included herein, and being known as a portion of that certain 468.814 acre tract of land described as Tract 4 in a Deed to HW 2421 Land, LP, as recorded in Document No. D209181336 of the Official Public Records of Tarrant County, Texas. • The Survey will identify topography (one-foot contours), visible features and above ground improvements including pavement, curbs, structures, fences, trees (6” dbh and larger), sidewalks, utilities, valves, manholes, hydrants, inverts, and other pertinent features within the project area. • Sufficient property corners will be located as necessary for a Registered Professional Land Surveyor to determine existing rights-of-way and property lines required to establish the boundaries of the proposed site. • Texas811 will be notified to coordinate marking of underground utilities. However, lacking excavation, the exact location of underground utilities and features cannot be accurately, completely, and reliably depicted. In some jurisdictions, 811 or other similar utility locate requests from surveyors may be ignored or result in an incomplete response. Where additional or more detailed information is required, the CLIENT is advised that excavation may be necessary. • Survey information will be referenced to Grid North of the Texas Coordinate System of 1983 {North Central Zone No. 4202; NAD83(2011) Epoch 2010} as derived locally from Allterra Central’s continuously operating reference stations via real time kinematic survey methods. Elevations will be referenced to NAVD88 datum as derived from RTK observations. Orthometric heights will be calculated by applying the Geoid 18 model to ellipsoid heights. Final elevations can be adjusted to an existing local datum if required. • All surveying services proposed herein shall be prepared in accordance with the General Rules and Procedures of Practice, and the Professional and Technical Standards established by the Texas Board of Professional Engineers and Land Surveyors. B. Boundary Survey • The 2-acre +/- tract is being conveyed to the Town from Hillwood. The Town will provide the CONSULTANT with an approximate description of the property limits. The CONSULTANT will prepare a boundary description and set appropriate monumentation so the tract can be conveyed to the Town and recorded with Tarrant County. The boundary work will be performed by a Registered Professional Land Surveyor. A title commitment or encumbrance report provided by the CLIENT will be required to ensure that all existing easements and encumbrances have been identified. C. Deliverables • Base file prepared in AutoCAD Civil 3D format for in-house design purposes only. Figure 2: Approximate Limits of Survey TASK 3. SUBSURFACE UTILITY INVESTIGATION SERVICES CONSULTANT will provide subsurface utility investigation services for the project as follows. GENERAL UNDERSTANDING: The following represents the general understanding between the Client and Engineer regarding the basis and/or limitations und er which these subsurface utility designating and/or locating services are provided: 1. These services will be conducted and provided in general compliance with CI/ASCE 38-22 (Standard Guidelines for the Collection and Depiction of Existing Subsurface Utility Data). This standard establishes and defines four quality levels for data collection that are briefly described as: ▪ Quality Level D (QL-“D”) – Generally QL-“D” indicates information collected or derived from research of existing records and/or oral discussions. ▪ Quality Level C ( QL-“C”) - Generally QL-“C” indicates information obtained by surveying and plotting visible above-ground utility features and by using professional judgment in correlating this information to QL-“D” information. Incorporates QL-“D” information. (Limited in this scope, this scope is to cover underground utility crossings) ▪ Quality Level B (QL-“B”) – Generally QL-“B”, also known as “designating” indicates information obtained through the application of appropriate surface geophysical methods to determine the existence and approximate horizontal position of subsurface utilitie s. This information is surveyed to applicable tolerances defined by the project and reduced onto plan documents. Incorporates QL-“D” & QL-“C” information. ▪ Quality Level A (QL-“A”) - Generally QL-“A”, also known as “locating”, indicates the precise horizontal and vertical location of utilities obtained by the actual exposure (or verification of previously exposed and surveyed utilities) and subsequent measurement of subsurface utilities, at a specific point. Incorporates QL-“D” QL-“C” & QL-“B” information. 2. These services are for the purpose of aiding the design of the subject project by providing information related to subsurface utilities in order to allow potential utility conflicts to be minimized or eliminated. 3. The Engineer will provide services that meet the standard of care for existing subsurface utility location and mapping as est ablished in CI/ASCE 38-22 by exercising due diligence with regard to records research and acquisition of utility information, inclu ding visually inspecting the work area for evidence of utilities and reviewing the available utility record information from the various ut ility owners. However, the Engineer makes no guarantee that all utilities can or will be identified and shown as there still may be utilities within the project area that are undetectable or unknown. 4. Facilities that are discovered through field investigative efforts by the Engineer but no plan records or ownership data can be identified will be hereafter referred to as unknown. As part of these services, the Engineer will provide QL-C information in the project deliverables for all unknown utilities that may be identified in the field investigation of the project. Designating and/or locating unknown utilities will typically not be part of the initial scope of work but depending on the client’s needs c an be added as additional work to address concerns of the project impacts of “unknown” facilities. 5. Ground penetrating radar will not be used as a part of the field investigation of the project site unless that use has been s pecifically addressed with the scope of services described herein. 6. Test holes are very limited in size or diameter (typically 12 inches by 12 inches, or approximately 144 square inches). Give n this limited size, some subsurface conditions may prevent the completion of test holes, including rock(s), groundwater, large roo ts, other utilities & structures, etc. Test hole attempts which cannot be completed due to site conditions will be documented and noted on the plans. 7. When test holes are used to locate utilities, the nominal pipe sizes of the targeted utility will be documented and reported by using field measurements of the outside diameter (OD) of the pipe (to the nearest inch). Based upon this field measured OD, the nominal pipe size will be determined using typical pipe wall thickness data and other available data including record information. P ipe diameters that are too large for measurement, encased or non-encased conduit duct banks and other concrete encased systems which cannot be adequately measured will be reported based upon the best available information. 8. The documented results produced by these services represent a professional opinion and interpretation based upon record information and/or field evidence. These results may be affected by a variety of existing site conditions, including soil content, dept h of the utility, density of utility clusters, and electro-magnetic characteristics of the targeted utilities. Also, the lack of and/or poor condition of a trace wire for non-conductive materials such as PVC, HDPE, etc. in most cases will make the successful detection and location of the utility unlikely. 9. The Engineer will apply professional judgment to determine which utilities require additional field effort and/or methods to properly designate and/or locate, most commonly when record drawings are not available. In such cases, the Engineer will provide a recommendation or request for additional services to the Client. Among other methods, a detectable duct rodder or other cond uctor may be introduced into the line to enable the designation of the utility. This method is dependent upon approval by the utility owner, as well as access to, size and condition of the utility. None of these services are intended to and should not be understood to relieve the Client or others from the responsibility t o comply with the statutory requirements related to notifying the proper one-call system(s) in advance of any and all excavation, grading and/or construction within the project site. A. Quality Level ‘B’ through ‘D’ Utility Information and Designation • TNP will provide utility information, up to QL-“B”, for existing right of way of Roanoke Road from the north curb return of Oak Trail to the driveway at 13405 Roanoke Rd. See Figure 3 for the approximate limits of investigation. The work includes: o Requesting utility records on all crossing utilities from the Client, public utilities and private utility companies known to provide service within the project area, as well as other sources, in an effort to develop a comprehensive inventory of utility systems likely to be encountered. Record documents may include construction plans, system diagrams, distribution maps, transmission maps, geographic information system data, as well as oral descriptions of the Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 17 existing systems. The depiction of utilities from records (QL-“C” or “D”) will be based on thorough field and office activities and shall be based on the most reliable indication of position available. o Visible surface features and appurtenances of subsurface utilities found within the project site will also be evaluated. Using appropriate surface geophysical methods, TNP will search for detectible indications of the location of anticipated subsurface utilities. o Marking all locations that can be validated, using paint, flags or other devices. o Preparing documentation of the utilities encountered and marked, including their general location, orientation, type & size, if known. o Based on ASCE Standard 38-22 standards, a 2d CADD file depicting the subsurface utilities designated. B. Quality Level ‘A’ Utility Test Holes • TNP will excavate by air-vacuum or other minimally invasive methods up to one (1) test hole at locations to be determined. This work includes: o Providing all necessary personnel, equipment, supplies, management and supervision needed for the test hole excavation, backfill and restoration. o Contacting the appropriate one-call system to request utilities to be marked on-the-ground prior to beginning excavation of test hole. o Providing and utilizing appropriate traffic control devices, as necessary, in conformance with the MUTCD, including any state or locally adopted supplements. (if closures or additional traffic control equipment is needed other than cones additional direct expenses will be charged) o Preparing documentation for each test hole attempted. This documentation will include the horizontal and vertical position of the targeted utility or structure, a general description of the target utility, with condition, material and general orientation noted, a generalized description of the material encountered in the test hole, and any other field observations noted during the excavation. C. BID PHASE SERVICES CONSULTANT will provide the following services during the Project’s bidding and award phase. A. Bid Support • Assist the CLIENT in preparing an advertisement for the construction project. • Upload the bidding documents to a web-based distribution system such as Civcast. • Assist the CLIENT in preparing an agenda and conducting a pre-bid conference, if necessary. • Assist the CLIENT in addressing bidder questions and preparing and distributing any addenda. • Assist in the bid opening and tabulation of bids. • Check references of the Contractor. • Provide a letter of recommendation to the CLIENT for award of the project. • Assist the CLIENT in coordinating with the selected Contractor to compile the necessary bonds and insurance to prepare the contract documents for execution by the CLIENT and the Contractor. • Incorporate all addenda into the contract documents and issue conformed sets of plans and specifications for use as the issued for construction documents. CONSULTANT will be present to assist with the opening and reading of the bids. DELIVERABLES A. Addenda B. Bid tabulations C. Recommendation of award TASK 5. CONSTRUCTION ADMINISTRATION CONSULTANT will provide construction administration services for the project as follows. A. Construction Support • CONSULTANT shall not be responsible for the means, methods, techniques, sequences, or procedures of construction selected by the Contractor, or the safety precautions and programs incident to the work of the Contractor • Assemble the executed contracts with the conformed plans for distribution at the pre-construction meeting. ➢ Up to four (4) sets of original executed contract documents. ➢ Up to three (3) full-size and six (6) half-size sets of conformed plans. ➢ Up to two (2) flash drives with conformed plans and contract documents. • The CONSULTANT shall prepare a pre-construction meeting agenda and conduct the pre- construction meeting in conjunction with the CLIENT. CONSULTANT shall prepare and distribute meeting minutes. • Maintain record of Contractor’s submittals, RFI’s, change orders, etc., and provide for filing and retrieval of Project documentation. • Review material submittals provided by the Contractor to ensure compliance with Town criteria and standards. • Provide interpretations and clarifications of contract documents, prepare change orders, and make recommendations as to the acceptability of the work. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 20 • Review the Contractor’s monthly pay requests and make recommendations to the CLIENT regarding acceptance and recommendation for payment. • Participate in up to three (3) meetings with the CLIENT and/or Contractor for the purpose of coordination or to address construction related issues. • Participate in up to three (3) site visits during construction. • The CONSULTANT shall attend the “Final” project walk through and prepare the final punch list. CONSULTANT shall coordinate with the construction inspector and CLIENT to confirm that the punch list items have been addressed before issuing any substantial or final completion letters to the CLIENT. • The CONSULTANT shall prepare Record Drawings using information provided by the CLIENT and the Contractor. Record drawings shall consist of one full size (22”x34”) blackline copy, two half-size (11”x17”) blackline copies, and a PDF of the Record Drawings. • Upon completion of Project, prepare and issue a Letter of Recommendation of Project Acceptance to the CLIENT that also identifies the start of the Project’s warranty period. ASSUMPTIONS • The length of construction is anticipated to be a fourteen (14) months. DELIVERABLES A. Meeting agenda and minutes B. Change orders and field changes C. Progress payment recommendation letters D. Final punch list E. Record drawings F. Recommendation of acceptance letter SPECIAL SERVICES TASK 6. GEOTECHNICAL ENGINEERING SERVICES CONSULTANT will provide geotechnical engineering services for the project as follows. A. Subsurface Exploration Based on past experience in the vicinity of the project, we anticipate subsurface conditions to consist of the soils and shale of the Woodbine geological formation overlying the soil and rock of the Grayson geological formation. Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 21 Experienced drillers and technicians will evaluate subsurface conditions with a total of four (4) sample borings according to the following field program: • Elevated Tank – Four (4) borings drilled to depths of 50 to 60 feet to at least 10 feet into unweathered gray limestone. The field personnel will drill the borings using truck-mounted equipment. Cohesive and non- cohesive soil samples will be obtained using 3-inch diameter Shelby tube samplers and 2-inch diameter standard split-spoon samplers, respectively. In addition, rock encountered will be evaluated by use of Texas Department of Transportation (TXDOT) cone penetration tests. For the elevated tank borings, continuous sampling will be conducted to 20 feet or to the top of rock (if encountered) below which TxDOT Cone Penetrometer (THD) tests will be conducted at 2-foot intervals to 20 feet. A soils logger will extrude the samples in the field, check the samples for consistency with a hand penetrometer, carefully wrap them to preserve their condition, and return them to the laboratory for testing. A log of each boring will be prepared to document field activities and results. It is assumed the client will stake the boring locations or the tank center location in the field prior to mobilization. Approximate locations of the borings will be shown on the plan of borings. Precise surveying of boring locations and elevations is not included in the cost estimate. These services may be provided as Additional Services upon request. At the completion of drilling operations, boreholes will be backfilled with drill cuttings and plugged at the surface by hand tamping. B. Laboratory Services Considering the planned facilities, anticipated soil conditions and geology, laboratory tests will be required for classification purposes, and to determine strength characteristics. The following types of tests are therefore recommended: • moisture content and soil identification • liquid and plastic limit determinations • percent passing the No. 200 sieve • sieve and hydrometer particle size analyses • unconfined compression tests on soil • unit weight determinations • absorption pressure and/or one-point pressure swell tests • consolidation tests on soil The specific types and quantities of tests will be determined based on geologic conditions encountered in the borings. C. Engineering Services Preliminary and final engineering reports will be prepared to present the results of the field and laboratory data together with our analyses of the results and recommendations. We will provide three bound copies and one electronic copy of each report. The reports will address: Project Name: Westlake Elevated Water Storage Tank Client: Town of Westlake TNP Project #: WSL 26259 Date: 2026.04.16 Page 22 • general soil and ground-water conditions • recommendations for foundation type, depth and allowable loading and settlement estimates • foundation construction requirements • recommendations for tank and building floor support, including an evaluation of the swell characteristics of the subgrade soils • earthwork recommendations ASSUMPTIONS • Items other than those specified above, which are revealed by these studies or are necessitated by a change in project scope, may require revised field, laboratory, and engineering services. These services, if required and requested, will be performed as Additional Services. DELIVERABLES A. Preliminary and final geotechnical engineering reports TASK 7. CONSTRUCTION INSPECTION SERVICES CONSULTANT will provide construction inspection services for the project as follows. A. Elevated Storage Tank Provide an onsite inspector for up to 8 hours per week for approximately 14 months to review, oversee, and the elevated storage tank improvements. 1. Visit the project site to verify existing conditions prior to the construction. Document existing conditions by providing a pre-construction video (if directed by CLIENT). 2. Review all contract documents and construction plans prior to construction activities. 3. Attend all pre-construction meetings with the Contractor, CLIENT, or public (if directed by CLIENT). 4. Maintain inspection reports with photo documentation of public improvement installations. Inspection reports shall include daily log of construction activities, contractor questions, deviations from plans, and ongoing/resolved issues. 5. Review all CMT testing related to public improvements. 6. Review material submittals provided by the Contractor to ensure compliance with Town criteria and standards. 7. Maintain a cloud-based construction collaboration folder, keeping relevant construction documents organized and available for review by CONSULTANT and CLIENT. 8. Document field revisions to construction plans and maintain redline drawings of project. Provide feedback and direction to the CLIENT as necessary to make any adjustments during these construction activities. Notify the CLIENT if construction work is not in compliance with construction documents and recommend appropriate action for the CLIENT for resolution of construction-related issues as such appear. 10. Schedule and perform a final inspection walk-through with the Contractor, CLIENT, and Town staff, identifying and documenting any remaining outstanding tasks. 11. Collect and distribute close-out documents as described in the Contract Documents (if directed by the Client). B. Steel Tank Construction Inspection 1. Visit the site up to twenty-eight times for inspection of tank welding. This effort will be up to 224 hours of inspector’s time. AWS CWI Inspector, inspection to include: a. Verify welder certification and welder procedures for the project. b. Verify welding work is being performed in accordance with the submitted welding procedures. c. Inspection of weld joint fit up. d. Inspection weld root and filler passes. e. Inspection welds for compliance with plans, specifications and the AWWA D107 Code. f. Verify required electrodes for the project are being used. 2. Provide desktop review of Xray tests. 3. Witness the contractor’s 3rd Party Inspection performing X-ray testing of welds. 4. Attend virtual progress meetings. 5. Provide project management and administrative services. 6. Reports that included photos will be provided for the site visits. C. Steel Tank Painting Inspection 1. Visit the site up to forty-six times for inspection of tank abrasive blasting and painting. This effort will be up to 368 hours of inspector’s time. NACE Level 1 Inspector, Inspection to include: o Review of project plans and specifications to evaluate that proper surface preparation and coating application techniques are being followed. o Checking coating products to verify they meet specs. o Verify environmental conditions during site visits. o Checking blast material and anchor profiles of steel. o Checking mixing and application of each of the coating products. o Checking dry film thickness after each coat is cured and before next coat is applied. 2. Attend virtual prepaint meeting. 3. Attend virtual progress meetings. 4. Witness the contractor performing holiday testing of the tank interior coating. 5. Provide project management and administrative services. 7. Reports that included photos will be provided for the site visits. ASSUMPTIONS • This proposal was developed without knowledge of the Contractor’s schedule of work. Therefore, the proposed fee may be more or less depending on the Contractor’s schedule and the needs of the project. • This proposal does not include the following: o Reinspection of repairs to contractor non-compliant work. o This proposal does not include costs associated with visiting the project as scheduled and the contractor canceling the visit after arrival, or the contractor canceling the visit while the inspector is in route to the project. o Does not include costs associated with inspection delays due to weather conditions. o Does not include costs associated with inspections delays due contractor equipment issues or breakdowns. • The construction contract documents will include provisions requiring the contractor to reimburse the CLIENT for reinspection of non-compliant work and cancellations after inspector arrival. • The Welding and Painting Contractor will provide all equipment and access for inspection of the Contractor’s work. Perform field surveys, utility investigations and data collection within 2 months from Authorization to Proceed by CLIENT and survey permission letter by property owner(s), whichever occurs latest. 2. Perform modeling analysis and prepare technical sizing memorandum within 2 months from authorization to Proceed by CLIENT. 3. Perform conceptual design within 2 months from CLIENT approval of sizing technical memorandum. 4. Perform preliminary design within 3 months from CLIENT approval of conceptual design plans. 5. Provide final design and specifications within 2 months from CLIENT approval of preliminary design plans. 6. Provide bid ready documents with 1 month from CLIENT approval of the preliminary design plans. 7. It is anticipated that the project will be ready to advertise for construction bids within ten (10) months of the CONSULTANT receiving a notice to proceed from the CLIENT. It is understood and agreed that the objective of all involved in this project is produce and provide quality and complete information and deliverables, which requires a considerable amount of coordination and cooperation, as well as adequate time for research, analysis and development. It is also understood that TNP’s ability to perform our scope of services is dependent upon information being provided and reviewed by others in a timely manner, and that adjustments in schedule may be required should information or reviews be delayed. It is anticipated that the life of this service agreement will be no more than three (3) years after receiving authorization to proceed.
