HomeMy WebLinkAboutOrd 328 Amending the Unified Development Code ORDINANCE NO. 328 AN ORDINANCE OF THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS, AMENDING ARTICLES III, IV AND V OF THE WESTLAKE UNIFIED DEVELOPMENT CODE TO PROVIDE FOR A NEW ZONING CATEGORY DESIGNATED AS "R-80 ESTATE RESIDENTIAL"; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Westlake adopted a revised Unified Development Code (the"UDC") on February 16, 1998 by passage of Ordinance No. 298; and WHEREAS, various persons and entities have suggested that the Town of Westlake needs a residential zoning category that would permit minimum 2-acre lots; and WHEREAS, provisions contained in certain parts of Articles III, IV and V must be amended in order to provide for a 2-acre estate residential zoning district; and WHEREAS, the Planning and Zoning Commission (the "Commission") and the Board of Aldermen held public hearings on the proposed 2-acre estate residential zoning district and the Commission recommended approval of the new district. NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE TOWN OF WESTLAKE, TEXAS: SECTION 1: That the Unified Development Code of the Town of Westlake, Texas as adopted by Westlake Ordinance No. 298, as amended, is hereby amended by amending provisions in Article III "Zoning Districts and Maps", Article IV "Permissible Uses" and Article V "Development Standards"to provide as follows: A) Article III. "Zoning Districts and Maps" Section 1.1A"Zoning District Chart" shall show"R-80"between"R-200" and"R-40"under Abbreviated Designation, and"Estate Residential 2"between"Country Residential" and "Estate Residential"under Zoning District Name. B) Article III"Zoning Districts and Maps" Section 3 "Purpose of Zoning Districts", Subsection 3.1 "Residential Districts" shall contain the following insertion between"R-200", Country Residential District and "R-40",Estate Residential District. 1) "R-80", Estate Residential 2 District. This district is intended to be composed of single family dwellings on minimum lots of approximately two(2) acres together with public schools, churches, parks and open spaces essential to create a more rural residential character than the R-40 district. Estate Residential 2 districts are intended to provide an opportunity for rural residential character. It may also be used in areas with steep topographic changes in order to minimize alteration of the terrain. C) Article IV. "Permissible Uses," Section 1 "Land Use Schedule," Subsection 1.1 "Use of Land and Buildings" shall include an"R-80" category under"SF Residential" and the uses listed shall be the same as those uses found under the"R-200" category. D) Article V. "Zoning District Development Standards," Section 4 "District Development Standards," Subsection 4.1 "District Development Standards Chart,"Figure 2 "Westlake District Development Standards Chart" shall reflect an"R-80" Estate Residential 2 (2ac.) zoning district between the "R- 200" Country Residential (5 ac.) and the"R-40"Estate Residential (I ac.) with the following standards. Min. Lot Size 75,000 s.f. Units per acre (u/a), FAR 0.5 Min. Principal Building Area 2,000 Height 2.5 stories/35 ft. Lot Width 150 ft. Front Setback 50 ft. Rear Setback 50 ft. Side Setback 25 ft. SECTION 2: If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Board hereby determines that it would have adopted this Ordinance without the invalid provision. SECTION 3: That this Ordinance shall become effective from and after the date of its passage.
