HomeMy WebLinkAboutOrd 323 Calling a general election to elect three Aldermen and Town Manager form of Government ORDINANCE NO. 323 AN ORDINANCE BY THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 1st DAY OF MAY, 1999, THE FIRST SATURDAY IN THAT MONTH, FOR THE PURPOSE OF ELECTING THREE ALDERMEN FOR THE TOWN OF WESTLAKE, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF SECTION 23.023, LOCAL GOVERNMENT CODE; ESTABLISHING THE HOURS AND PLACE FOR THE ELECTION; PROVIDING FOR THE POSTING OF NOTICE OF THE ELECTION; DIRECTING THE TOWN SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, AND CAUSE THEM TO BE PRINTED AND DELIVERED TO THE PRESIDING OFFICER; PROVIDING FOR THE CANVASSING OF THE RETURNS OF THE ELECTION; AND DECLARING AN EFFECTIVE DATE. THE BOARD OF ALDERMEN OF THE TOWN OF WESTLAKE, TEXAS HEREBY ORDAINS: SECTION 1: That an election shall be held at the Town Hall, 3 Village Circle, Suite 207, in the Town of Westlake, Texas, between the hours of 7:00 a.m. and 7:00 p.m. on the 1st day of May, 1999, the first Saturday of that month, for the purpose of electing three (3) Aldermen for two (2) year terms for the Town of Westlake, Texas, in accordance with Section 23.023 of the Local Government Code. SECTION 2: That early voting by personal appearance shall be held at the Town Hall, 3 Village Circle, Suite 207, in the Town of Westlake, Texas between the hours of 9:00 a.m. and 1:00 p.m. beginning on Wednesday, April 14, 1999, and ending on Tuesday, April 27, 1999. SECTION 3: That the three candidates who receive the highest, second and third highest number of votes shall be elected to the Board of Aldermen of the Town of Westlake for two (2) year terms. SECTION 4: That notice of the election shall be given by posting true copies of this Ordinance, signed by the Mayor and attested by the Town Secretary, in the Town Hall and in three public places in the Town, for at least twenty (20) consecutive days prior to the date of the election. SECTION 5: That Wanda Haskins is hereby appointed presiding judge of the election and the presiding judge shall appoint such assistants as may be necessary to properly conduct the election, as provided by the Election Code. SECTION 6: That the Town Secretary shall make up the official ballot from the names presented to her by application as provided by the Election.Code, and she is hereby authorized and directed to have the ballots to be used in the election printed and delivered to the presiding judge. General Election Page 2 SECTION 7: That immediately after the counting of the votes the presiding judge shall deliver the official returns of the election to the Town Secretary. SECTION 8: That on the Tuesday next following the election, the Board of Aldermen shall canvass the returns and declare the results which shall be recorded in the Minutes of the Board of Aldermen. SECTION 9: That the three candidates who receive the highest, second and third highest number of votes for Alderman shall be elected to two (2) year terms, and the Mayor shall deliver a certificate of election to the successful candidates. If two or more candidates for Alderman tie with the same number of votes so that one or more of the tied candidates would not be elected to the position of Alderman the Board of Aldermen shall order a second election to be held on the fourteenth day after the first election at which only the names of the candidates who receive the same number of votes at the first election shall be printed on the ballot. In the event of a tie at the second election, the tied candidates shall cast lots to determine which one shall be declared elected. PASSED AND APPROVED on the 8' day of February, 1999. Isham, Town Attorney PROCLAMATION A PROCLAMATION BY THE MAYOR OF THE TOWN OF WESTLAKE, TEXAS, CALLING AND ORDERING A SPECIAL ELECTION TO BE HELD ON THE 1st DAY OF MAY, 1999, THE FIRST SATURDAY IN THAT MONTH, FOR THE PURPOSE OF DETERMINING WHETHER THE TOWN OF WESTLAKE, TEXAS, SHALL ADOPT THE CITY MANAGER FORM OF GOVERNMENT IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 25, LOCAL GOVERNMENT CODE; ESTABLISHING THE HOURS AND PLACE FOR THE ELECTION; PROVIDING FOR THE POSTING OF NOTICE OF THE ELECTION; DIRECTING THE TOWN SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, AND CAUSE THEM TO BE PRINTED AND DELIVERED TO THE PRESIDING OFFICER; PROVIDING FOR THE CANVASSING OF THE RETURNS OF THE ELECTION; AND DECLARING AN EFFECTIVE DATE. THE MAYOR OF THE TOWN OF WESTLAKE, TEXAS, HEREBY PROCLAIMS: SECTION 1: That since at least 20 percent of the total number of qualified voters who voted for Mayor at the most recent municipal election at which the office of Mayor was to be filled have signed a petition requesting the Mayor to call a special election to determine whether the municipality shall adopt the city manager form of government, it is hereby ORDERED that an election shall be held at the Town Hall, 3 Village Circle, Suite 207, in the Town of Westlake, Texas, between the hours of 7:00 a.m. and 7:00 p.m. on the 1st day of May, 1999, the first Saturday of that month, for the purpose of determining whether the Town of Westlake will adopt the city manager form of government in accordance with Chapter 25 of the Local Government Code. SECTION 2: That early voting by personal appearance shall be held at the Town Hall, 3 Village Circle, Suite 207, in the Town of Westlake, Texas between the hours of 9:00 a.m. and 1:00 p.m. beginning on Wednesday, April 14, 1999, and ending on Tuesday, April 27, 1999. SECTION 4: That Wanda Haskins is hereby appointed presiding judge of the election and the presiding judge shall appoint such assistants as may be necessary to properly conduct the election, as provided by the Election Code. SECTION 5: That the Town Secretary shall make up the official ballot to provide for voting for or against the proposition: The governing body of the municipality of Westlake appointing a city manager and setting by ordinance the salary of the manager. The Town Secretary is further authorized and directed to have the ballots to be used in the election printed and delivered to the presiding judge.
