ORDINANCE NO. 986
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF WESTLAKE, TEXAS,
CALLING AND ORDERING A JOINT GENERAL ELECTION FOR THE PURPOSE OF
ELECTING A MAYOR AND TWO (2) COUNCIL MEMBERS TO BE HELD ON MAY 4,
2024, IN CONJUNCTION WITH A SPECIAL ELECTION ELECTING ONE (1)
COUNCIL MEMBER TO FILL AN UPEXPIRED TERM (ENDING MAY 2025) IN
ACCORDANCE WITH THE PROVISIONS OF SECTION 23.023, TEXAS LOCAL
GOVERNMENT CODE; ESTABLISHING PROCEDURES FOR THE ELECTION; AND
MAKING PROVISIONS TO CONDUCT A JOINT ELECTION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the general election for the Town of Westlake as set forth by the Texas
Election Code, is required to be held on May 4, 2024, for the purpose of electing a Mayor and two
(2) Council Members for two (2) year terms; and
WHEREAS, the joint special election for the Town of Westlake is being held in
conjunction to elect one (1) Council Member for an unexpired term ending in May 2025; and
WHEREAS, in accordance with Section 271.002 of the Texas Election Code , the Town
of Westlake election will contract with the elections administrator of Tarrant County to conduct
all aspects of the Election including both political subdivisions in Tarrant and Denton counties.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
WESTLAKE, TEXAS, THAT:
SECTION 1: Election Order for General and Special Election. That an election is
hereby ordered to be held on the 4th day of May 2024, the first Saturday of that month, for the
purpose of electing a Mayor and two (2) Council Members for two (2) year terms and a Special
Election to fill a vacancy for a one (1) year term, in accordance with Section 23.023 of the Texas
Local Government Code.
SECTION 2: Polling Place. The polling places and the county elections precincts whose
qualified voters shall cast ballots at such location as determined per the Joint Election Agreement
and Contract for Elections Services with the Tarrant County Election Administrator:
The polls shall be open from 7:00 a.m. to 7:00 p.m. on May 4, 2024, in accordance with and
pursuant to the requirements of the Texas Election Code (the “Code”).
SECTION 3: Filing Dates. In accordance with Section 143.007 of the Code, eligible
persons wishing to become candidates must file an application with the Town Secretary of the
Town of Westlake, Texas, beginning on January 17, 2024, through the February 16, 2024 until
5:00 p.m. Each application shall be on a form meeting the requirements of the Code.
SECTION 4: Combined Ballots. Combined ballots may be utilized containing all of the
offices and propositions to be voted on at each polling place, provided that no voter shall be given

a ballot or permitted to vote for any office or proposition on which the voter is ineligible to vote.
The County’s voting equipment will be utilized for this election.
SECTION 5: Early Voting. Early Voting by personal appearance shall be conducted at
the County’s Main Early Voting location;

Branch offices for early voting by personal appearance shall be established as outlined in the
Election Agreement and Contract for Election Services with Tarrant and Denton County. The
Early Voting locations/dates/times will be set as per the agreement/contract with Tarrant County
Elections. Tarrant County Elections Administrator is hereby appointed as the Early Voting Clerk
and can appoint the necessary deputy clerks as required for early voting. In accordance with
Section 85.001 of the Texas Election Code, early voting by personal appearance tentative schedule
is set forth below:

April 22-26 (Monday-Friday) 8:00 a.m. - 5:00 p.m.
April 27 (Saturday) 7:00 a.m. - 7:00 p.m.
April 28 (Sunday) 10:00 a.m. - 4:00 p.m.
April 29 - 30 (Monday - Tuesday) 7:00 a.m. - 7:00 p.m.
May 4 (Saturday - Election Day) 7:00 a.m. - 7:00 p.m.
Applications for ballots by mail must be received no later than the close of business on April 23,
2024.
SECTION 6: Notice. Notice of said elections shall be given as required by the Texas
Election Code.
SECTION 7: Election Officials. The election judge, alternate election judge, and ballot
board will be appointed by the Tarrant County Elections Administrator, as permitted by law. The
presiding judge shall appoint elections clerks as may be necessary for the proper conduct of the
election. The election judge or the alternate election judge in the absence of the election judge, and
the election clerks shall constitute the early voting ballot board. The election judge, and alternate
election judge, and election clerks shall be qualified voters of the Town.
SECTION 8: Election Results. That the candidates for Council who receive the highest
number of votes shall be elected to two (2) year terms, and the candidate receiving the highest
number of votes for the special election will fill a one (1) year unexpired term.
The Mayor shall deliver a certificate of election to the successful candidates. In the event
of a tie, the tied candidates shall cast lots to determine which one shall be declared elected; and

SECTION 9: Governing Law. The election shall be held in accordance with the
Constitution of the State of Texas and the Texas Election Code, and all resident qualified voters
of the Town shall be eligible to vote at the election.
SECTION 10: Submission to the United States Justice Department. The Elections
Administrator of Tarrant County is authorized to make such submissions as are necessary to the
United States Justice Department to seek pre-clearance as required by law.
SECTION 11: Necessary Actions. The Town Manager or Town Secretary is authorized
to sign necessary agreements with Tarrant County for the conducting of such elections and are
authorized and directed to take all actions necessary to comply with the provisions of the Texas
Election Code, and the Town Code in carrying out and conducting the election, whether or not
expressly authorized by this Order.
SECTION 12: Severability Clause. It is hereby declared to be the intention of the Town
Council that the sections, paragraphs, sentences, clauses and phrases of this order are severable
and if any phrase, clause, sentence, paragraph, or section shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this order, since the same would have been enacted by the Town
Council without the incorporation in this order of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION 13: Effective Date. This order shall be effective upon its adoption.

UNA ORDENANZA DEL CONCEJO MUNICIPAL DE LA CIUDAD DE WESTLAKE,
TEXAS, CONVOCANDO Y ORDENANDO LA REALIZACIÓN DE UNA ELECCIÓN
GENERAL CONJUNTA CON EL PROPÓSITO DE ELEGIR UN (1) ALCALDE Y DOS
(2) MIEMBROS DEL CONCEJO, A REALIZARSE EL DÍA 4 DE MAYO DE 2024,
CONJUNTAMENTE CON UNA ELECCIÓN ESPECIAL PARA ELEGIR UN (1)
MIEMBRO DEL CONCEJO PARA COMPLETAR UN MANDATO NO VENCIDO (QUE
FINALIZA EN MAYO DE 2025) DE CONFORMIDAD CON LAS DISPOSICIONES DE
LA SECCIÓN 23.023 DEL CÓDIGO DE GOBIERNO LOCAL DE TEXAS;
ESTABLECIENDO PROCEDIMIENTOS PARA LA ELECCIÓN; ESTABLECIENDO
DISPOSICIONES PARA LLEVAR A CABO UNA ELECCIÓN CONJUNTA; Y
PROPORCIONANDO UNA FECHA DE VIGENCIA.
CONSIDERANDO QUE, según el Código de Elecciones de Texas, debe realizarse una
elección general para la Ciudad de Westlake el día 4 de mayo de 2024, con el propósito de elegir
un (1) Alcalde y dos (2) Miembros del Concejo por un período de dos (2) años; y
CONSIDERANDO QUE, la elección especial conjunta para la Ciudad de Westlake se
llevará a cabo conjuntamente para elegir un (1) Miembro del Concejo para un mandato no vencido
que finalizará en mayo de 2025; y
CONSIDERANDO QUE, de acuerdo con la Sección 271.002 del Código de Elecciones
de Texas, para la elección de la Ciudad de Westlake se contratará al administrador de las elecciones
del Condado de Tarrant para llevar a cabo todos los aspectos de la Elección, incluidas ambas
subdivisiones políticas en los Condados de Tarrant y Denton.
AHORA, POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE
WESTLAKE, TEXAS, ORDENA QUE:
SECCIÓN 1: Orden de Elección para la realización de una Elección General y una
Elección Especial. Por la presente se ordena que se celebre una elección el 4 de mayo de 2024, el
primer sábado de ese mes, con el propósito de elegir un (1) Alcalde y dos (2) Miembros del
Concejo por un período de dos (2) años, y una Elección Especial para llenar una vacante por un
período de un (1) año, de conformidad con la Sección 23.023 del Código de Gobierno Local de
Texas.
SECCIÓN 2: Lugares de votación. Se refieren a los lugares de votación y a los distritos
electorales del condado cuyos votantes calificados emitirán su voto en dicho lugar, según lo
determinado por el Acuerdo Electoral Conjunto y el Contrato de Servicios Electorales con los
Administradores Electorales del Condado de Tarrant.
Los lugares de votación estarán abiertos el día 4 de mayo de 2024, de 7:00 a.m. a 7:00 p.m., de
conformidad con los requisitos del Código de Elecciones de Texas (el “Código”).

SECCIÓN 3: Fechas de presentación. De acuerdo con la Sección 143.007 del Código,
las personas elegibles que deseen convertirse en candidatos deben presentar una solicitud ante el
Secretario Municipal de la Ciudad de Westlake, Texas, a partir del 17 de enero de 2024 y hasta las
5:00 p.m. del 16 de febrero de 2024. Cada solicitud deberá presentarse en un formulario que
cumpla con los requisitos del Código.
SECCIÓN 4: Papeleta de votación (Distrito Electoral Combinado). Se pueden utilizar
papeletas de votación (distrito electoral combinado) que contengan todos los cargos y propuestas
sobre los que se va a votar en cada lugar de votación, siempre que no se dé a ningún votante una
papeleta de votación ni se le permita votar por ningún cargo o propuesta sobre la que el votante no
tenga derecho a votar. Para estas elecciones se utilizará el equipo de votación del Condado.
SECCIÓN 5: Votación anticipada. La votación anticipada en persona se llevará a cabo
en el lugar principal de votación anticipada del Condado, como se indica a continuación:

Las sucursales para la votación anticipada en persona se establecerán como se describe en el

De acuerdo con la Sección 85.001 del Código de Elecciones de Texas, el cronograma tentativo de
votación anticipada en persona se establece a continuación:

Del 22 al 26 de abril (De lunes a viernes) De 8:00 a.m. a 5:00 p.m.
27 de abril (Sábado) De 7:00 a.m. a 7:00 p.m.
28 de abril (Domingo) De 10:00 a.m. a 4:00 p.m.
Del 29 al 30 de abril (De lunes a martes) De 7:00 a.m. a 7:00 p.m.
4 de mayo (Sábado, Día de la Elección) De 7:00 a.m. a 7:00 p.m.
Las solicitudes de papeletas de votación por correo deben recibirse a más tardar al cierre de
operaciones el día 23 de abril de 2024.
SECCIÓN 6: Aviso. El aviso para estas elecciones se dará como lo exige el Código de
Elecciones de Texas.
SECCIÓN 7: Funcionarios electorales. El juez electoral, el juez electoral suplente y la
junta electoral serán designados por el Administrador de Elecciones del Condado de Tarrant, según
lo permite la ley. El juez presidente nombrará secretarios electorales según sea necesario para el
correcto desarrollo de la elección. El juez electoral o el juez electoral suplente en ausencia del juez

electoral y los secretarios electorales constituirán la junta de votación anticipada. El juez electoral,
el juez electoral suplente y los secretarios electorales deben ser votantes calificados de la Ciudad.
SECCIÓN 8: Resultados de la elección. Los candidatos al Concejo que reciban el mayor
número de votos serán elegidos para un período de dos (2) años, y el candidato que reciba el mayor
número de votos en la elección especial ocupará un mandato por un período no vencido de un (1)
año.
El Alcalde entregará un certificado de elección a los candidatos elegidos. En caso de
empate, los candidatos empatados procederán a un sorteo para determinar cuál de ellos será
declarado electo; y
SECCIÓN 9: Ley vigente. La elección se llevará a cabo de acuerdo con la Constitución
del Estado de Texas y el Código de Elecciones de Texas, y todos los votantes calificados residentes
de la Ciudad tendrán derecho a votar en la elección.
SECCIÓN 10: Presentación al Departamento de Justicia de los Estados Unidos. El
Administrador Electoral del Condado de Tarrant está autorizado a realizar las presentaciones que
sean necesarias ante el Departamento de Justicia de los Estados Unidos para obtener la autorización
previa exigida por la ley.
SECCIÓN 11: Acciones necesarias. El Administrador Municipal o el Secretario
Municipal están autorizados a firmar los acuerdos necesarios con el Condado de Tarrant para la
realización de estas elecciones y también están autorizados a tomar todas las acciones necesarias
para cumplir con las disposiciones del Código de Elecciones de Texas y del Código Municipal
para realizar las elecciones, estén o no expresamente autorizadas por esta Ordenanza.
SECCIÓN 12: Cláusula de divisibilidad. Por la presente se declara que es la intención
del Concejo Municipal de la Ciudad que las secciones, los párrafos, las oraciones, las cláusulas y
las frases de esta ordenanza sean divisibles y si cualquier frase, cláusula, oración, párrafo o sección
fuera declarada inválida o inconstitucional por sentencia o decreto válido de cualquier tribunal de
jurisdicción competente, dicha invalidez o inconstitucionalidad no afectará a ninguna de las
restantes frases, cláusulas, oraciones, párrafos y secciones de esta ordenanza, ya que la misma
ordenanza habría sido promulgada por el Concejo Municipal de la Ciudad sin la incorporación de
dicha frase, cláusula, oración, párrafo o sección inválidos o inconstitucionales en esta ordenanza.
SECCIÓN 13: Fecha de vigencia. Esta ordenanza entrará en vigencia en el momento de
su adopción.

XÉT RẰNG, cuộc tổng tuyển cử cho Thị Trấn Westlake theo quy định của Bộ Luật
Bầu Cử Texas, bắt buộc phải được tổ chức vào ngày 4 tháng 5 năm 2024, nhằm mục
đích bầu ra một Thị trưởng và hai (2) Thành Viên Hội Đồng cho nhiệm kỳ hai (2) năm; và
XÉT RẰNG, cuộc bầu cử đặc biệt chung cho Thị Trấn Westlake đang được tổ
chức cùng lúc để bầu ra một (1) Thành Viên Hội Đồng cho nhiệm kỳ chưa hết hạn kết
thúc vào tháng 5 năm 2025; và
XÉT RẰNG, theo Mục 271.002 của Bộ Luật Bầu Cử Texas, cuộc bầu cử ở Thị
Trấn Westlake sẽ ký hợp đồng với người quản lý bầu cử của Quận Tarrant để tiến hành
tất cả các khía cạnh của Cuộc bầu cử bao gồm các tiểu khu chính trị ở các quận Tarrant
và Denton.
VÌ VẬY, BÂY GIỜ, HỘI ĐỒNG THỊ TRẤN TEXAS QUY ĐỊNH RẰNG:
PHẦN 1: Ra Lệnh Bầu Cử cho Cuộc Tổng Tuyển Cử và Bầu Cử Đặc Biệt. Ra
lệnh tổ chức một cuộc bầu cử theo đây vào ngày 4 tháng 5 năm 2024, là ngày thứ Bảy
đầu tiên của tháng đó, nhằm mục đích bầu ra một Thị Trưởng và hai (2) Thành Viên Hội
Đồng cho nhiệm kỳ hai (2) năm và một Cuộc Bầu Cử Đặc Biệt để tiếp tục phục vụ nhiệm
kỳ một (1) năm, theo Mục 23.023 của Bộ Luật Chính Quyền Địa Phương Texas.
PHẦN 2: Địa Điểm Bỏ Phiếu. Các địa điểm bỏ phiếu và khu bầu cử quận mà cử
tri đủ điều kiện sẽ bỏ phiếu tại địa điểm được xác định theo Thỏa Thuận Bầu Cử Chung
và Hợp Đồng Dịch Vụ Bầu Cử với Người Quản Lý Bầu Cử của Quận Tarrant.
Các phòng bỏ phiếu sẽ mở cửa từ 7:00 sáng đến 7:00 tối vào ngày 4 tháng 5 năm 2024,
phù hợp và tuân thủ các yêu cầu của Bộ Luật Bầu Cử Texas (“Bộ Luật”).
PHẦN 3: Ngày Nộp Hồ Sơ. Theo Mục 143.007 của Bộ Luật, những người đủ
điều kiện muốn trở thành ứng cử viên phải nộp đơn đăng ký lên Thư Ký Thị Trấn của Thị
Trấn Westlake, Texas, bắt đầu từ ngày 17 tháng 1 năm 2024 đến hết ngày 16 tháng 2
năm 2024 cho đến 5:00 chiều. Đơn đăng ký phải được lập theo biểu mẫu đáp ứng các
yêu cầu của Bộ Luật.
PHẦN 4: Lá Phiếu Kết Hợp. Có thể sử dụng các lá phiếu kết hợp bao gồm

tất cả các chức vụ và đề xuất sẽ được bỏ phiếu tại mỗi địa điểm bỏ phiếu, với điều kiện
là không có cử tri nào được trao phiếu bầu hoặc được phép bỏ phiếu cho bất kỳ chức vụ
hoặc đề xuất nào mà cử tri không đủ điều kiện để bỏ phiếu. Thiết bị bỏ phiếu của Quận
sẽ được sử dụng cho cuộc bầu cử này.
PHẦN 5: Bỏ Phiếu Sớm. Việc đích thân đến bỏ phiếu sớm sẽ được tiến hành
tại địa điểm Bỏ Phiếu Sớm Chính của Quận;

Các văn phòng chi nhánh để người dân đích thân đến bỏ phiếu sớm sẽ được thành lập
như được nêu trong Thỏa Thuận Bầu Cử và Hợp Đồng Dịch Vụ Bầu Cử với Quận Tarrant
và Denton. Địa điểm/ngày/giờ thực hiện Bỏ Phiếu Sớm sẽ được ấn định theo thỏa
thuận/hợp đồng với Cơ Quan Bầu Cử Quận Tarrant. Người Quản Lý Bầu Cử Quận
Tarrant theo đây được bổ nhiệm làm Thư Ký phụ trách Bỏ Phiếu Sớm và có thể bổ nhiệm
các phó thư ký cần thiết theo yêu cầu cho việc bỏ phiếu sớm. Theo Mục 85.001 của Bộ
Luật Bầu Cử Texas, lịch trình bỏ phiếu sớm dự kiến do người dân đích thân thực heiẹn
được quy định dưới đây:

Ngày 22-26/ 4 (Thứ Hai-Thứ Sáu) 8:00 sáng - 5:00 chiều
Ngày 27/ 4 (Thứ Bảy) 7:00 sáng - 7:00 tối
Ngày 28/ 4 (Chủ Nhật) 10:00 sáng - 4:00 chiều
29 - 30/ 4 (Thứ Hai - Thứ Ba) 7:00 sáng - 7:00 tối
Ngày 4/ 5 (Thứ Bảy - Ngày Bầu Cử) 7:00 sáng - 7:00 tối
Đơn đăng ký bỏ phiếu qua thư phải được nhận không muộn hơn thời điểm kết thúc giờ
làm việc vào ngày 23 tháng 4 năm 2024.
PHẦN 6: Lưu ý. Thông báo về các cuộc bầu cử nói trên sẽ được đưa ra theo yêu
cầu của Bộ Luật Bầu Cử Texas.
PHẦN 7: Nhân Viên Phụ Trách Bầu Cử. Thẩm phán bầu cử, thẩm phán bầu cử
thay thế và hội đồng bỏ phiếu sẽ do Người Quản Lý Bầu Cử Quận Tarrant bổ nhiệm,
theo luật pháp cho phép. Chủ tọa sẽ bổ nhiệm các thư ký bầu cử khi cần thiết để tiến
hành bầu cử đúng cách. Thẩm phán hoặc thẩm phán bầu cử dự khuyết trong trường hợp
thẩm phán bầu cử vắng mặt và thư ký bầu cử sẽ tạo thành ban bỏ phiếu sớm. Thẩm
phán bầu cử, thẩm phán bầu cử thay thế và thư ký bầu cử sẽ là những cử tri đủ tiêu
chuẩn của Thị Trấn.
PHẦN 8: Kết Quả Bầu Cử. Các ứng cử viên vào Hội Đồng nhận được số phiếu
bầu cao nhất sẽ được bầu vào nhiệm kỳ hai (2) năm, và ứng cử viên nhận được số phiếu
bầu cao nhất cho cuộc bầu cử đặc biệt sẽ đảm nhận nhiệm kỳ một (1) năm chưa hết hạn.

Thị trưởng sẽ trao giấy chứng nhận bầu cử cho những ứng cử viên trúng cử.
Trong trường hợp số phiếu hòa, các ứng cử viên có điểm ngang nhau sẽ bốc thăm để
xác định ai sẽ được tuyên bố đắc cử; và
PHẦN 9: Luật Chi Phối. Cuộc bầu cử sẽ được tổ chức theo Hiến Pháp của Tiểu
Bang Texas và Bộ Luật Bầu Cử Texas và tất cả cử tri cư trú đủ điều kiện của Thị Trấn
sẽ đủ điều kiện để bỏ phiếu tại cuộc bầu cử.
PHẦN 10: Đệ Trình lên Bộ Tư Pháp Hoa Kỳ. Người Quản Lý Bầu Cử của Quận
Tarrant được ủy quyền thực hiện các đệ trình cần thiết cho Bộ Tư Pháp Hoa Kỳ để xin
phê duyệt trước theo yêu cầu của pháp luật.
PHẦN 11: Các Hành Động Cần Thiết. Người Quản Lý Thị Trấn hoặc Thư Ký Thị
Trấn được ủy quyền ký các thỏa thuận cần thiết với Quận Tarrant để tiến hành các cuộc
bầu cử đó và được ủy quyền cũng như chỉ đạo thực hiện mọi hành động cần thiết nhằm
tuân thủ các quy định của Bộ Luật Bầu Cử Texas và Bộ Luật Thị Trấn trong việc thực
hiện và tiến hành cuộc bầu cử, cho dù có được Lệnh này cho phép rõ ràng hay không.
PHẦN 12: Điều Khoản Hiệu Lực Từng Phần. Theo đây, ý định của Hội Đồng
Thị Trấn được tuyên bố là các phần, đoạn, câu, mệnh đề và cụm từ của lệnh này có thể
tách rời và nếu bất kỳ cụm từ, mệnh đề, câu, đoạn hoặc phần nào sẽ bị tuyên bố là không
hợp lệ hoặc vi hiến theo phán quyết hoặc nghị định hợp lệ của bất kỳ tòa án có thẩm
quyền nào, tính không hợp lệ hoặc vi hiến đó sẽ không ảnh hưởng đến bất kỳ cụm từ,
mệnh đề, câu, đoạn và phần nào còn lại của lệnh này, vì lệnh tương tự sẽ được Hội Đồng
Thị Trấn ban hành mà không kết hợp bất kỳ cụm từ, mệnh đề, câu, đoạn hoặc phần nào
không hợp lệ hoặc vi hiến trong lệnh này.
PHẦN 13: Ngày Có Hiệu Lực. Lệnh này sẽ có hiệu lực kể từ khi được thông
qua.
