ORDINANCE NO. 383
AN ORDINANCE OF THE TOWN OF WESTLAKE, TEXAS, AMENDING
ORDINANCE NO. 199 COMPREHENSIVE PLAN, AS AMENDED BY ORDINANCE
NO. 261 AND ORDINANCE NO. 302; CHANGING THE FUTURE LAND USES ON A
PORTION OF PD 3-7; DETERMINING THAT IT IS IN THE PUBLIC'S BEST
INTEREST AND IN SUPPORT OF THE HEALTH, SAFETY, AND GENERAL
WELFARE TO ADOPT THE AMENDMENT TO THIS PARCEL OF LAND ON THE
COMPREHENSIVE LAND USE PLAN; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 219 of the Texas Local Government Code authorizes
municipalities to adopt a comprehensive plan to guide long-range development and serve as a
guide for zoning and land use decisions of the municipality; and
WHEREAS, the Board of Aldermen (Board) of the Town of Westlake, Texas adopted
Ordinance No. 199, which ordinance adopted the Town of Westlake Comprehensive Plan, after
having conducted public hearings, and upon the giving of public notice in compliance with State
law; and
WHEREAS, the Board, in the interest of the public's best interest and in support of the
health, safety, and general welfare has amended the Comprehensive Plan when deemed
necessary. Said Comprehensive Plan being amended by Ordinance No. 21 and Ordinance No
302; and
WHEREAS, the Board does hereby find and conclude, based upon information
presented at public hearings and through consultation with citizens and the town staff that it is in
the best interest and in support of the health, safety, and welfare of the Town to amend Ordinance
No. 219, as amended, changing the future land uses in a portion of PD 3-7, being a planned
development established by Ordinance No.313
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
TOWN OF WESTLAKE, TEXAS:
SECTION 1: That the above premises are found to be true and correct and are
incorporated into the body of this ordinance as if copied in their entirety.
SECTION 2: That Ordinance No. 219, as amended, being the Comprehensive Plan of the
Town of Westlake, Texas is hereby amended to reflect changes from residential land use to
Office Campus land use as shown in the attached Exhibit "A". Such change shall signify a
change in the future land use in the Comprehensive Plan and shall authorize the amendment of
the Future Land Use Map accordingly.
SECTION 3: A copy of the Comprehensive Plan shall be kept with this ordinance in the
office of the Town Secretary and shall be available for inspection during regular business hours.
SECTION 4: It is hereby declared to be the intention of the Board that the phrases,
clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase,
clause, sentence, paragraph, or section of this ordinance shall be declared to be unconstitutional
by the valid judgement or decree of any court or competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this
ordinance, since same would have been enacted by the Board without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION S: The Town Secretary of the Town of Westlake is hereby directed to engross
and enroll this ordinance by copying the caption and the effective date clause in the minutes of
Board and by filing the ordinance in the ordinance records of the Town.
SECTION 6: This ordinance shall become effective from and after the date of its
passage and it is so ordained.
